Korean Hydrogen Economy and Green Energy Law for Foreign Investors

South Korea has staked its industrial future on hydrogen. The Korean government's Hydrogen Economy Roadmap targets making Korea a global leader in hydrogen production, storage, transport, and application by 2040. With a legal infrastructure built specifically to support this ambition — including the world's first dedicated hydrogen economy legislation — Korea presents both significant market opportunities and a complex regulatory environment for foreign companies seeking to participate in the hydrogen and broader green energy sector.

This article provides a practical legal guide to Korea's hydrogen economy framework, green energy regulations, and the specific licensing, investment, and compliance requirements that foreign businesses must navigate.

1. The Hydrogen Economy Promotion and Hydrogen Safety Management Act

1.1 Background and Scope

The Hydrogen Economy Promotion and Hydrogen Safety Management Act (수소경제 육성 및 수소 안전관리에 관한 법률), enacted in 2020 and commonly known as the "Hydrogen Act," is the world's first dedicated hydrogen economy law. It establishes the comprehensive framework for:

  • National hydrogen economy planning and target-setting
  • Hydrogen production, import, storage, and distribution licensing
  • Hydrogen safety standards for vehicles, stations, and industrial facilities
  • Support for hydrogen technology R&D and commercialization
  • Mandatory purchase obligations for hydrogen energy (analogous to renewable portfolio standards)

1.2 National Hydrogen Economy Committee

Chaired by the Prime Minister, the National Hydrogen Economy Committee coordinates hydrogen policy across government ministries. Foreign investors should understand that hydrogen policy involves multiple ministries: the Ministry of Trade, Industry and Energy (MOTIE) leads on production and supply, the Ministry of Environment oversees green hydrogen certification, the Ministry of Land, Infrastructure and Transport governs hydrogen vehicle infrastructure, and the Ministry of Science and ICT funds R&D programs.

2. Hydrogen Production: Legal Classifications and Requirements

2.1 Color-Coded Hydrogen and Legal Implications

Korea's regulatory framework makes a critical distinction between production methods:

  • Green Hydrogen: Produced via electrolysis using renewable energy. Eligible for the highest support rates and "clean hydrogen" premium pricing under the Hydrogen Act
  • Blue Hydrogen: Produced from natural gas with carbon capture and storage (CCS). Eligible for intermediate support levels, subject to carbon emission verification
  • Pink Hydrogen: Produced via nuclear-powered electrolysis. Korea is actively developing this pathway, with legal status clarified in 2023 amendments
  • Grey/Brown Hydrogen: Produced from fossil fuels without CCS. Eligible only for general industrial use, no special support incentives

2.2 Clean Hydrogen Certification System (청정수소 인증제)

Korea's Clean Hydrogen Certification System, launched in 2023, requires hydrogen producers and importers to obtain certification for any hydrogen sold under "clean" or "green" labels. Certification involves:

  1. Life-cycle carbon emission assessment (target: below 4kg CO₂e per kg H₂ for clean status)
  2. Third-party verification by accredited certification bodies
  3. Annual renewal with updated emission data
  4. Registry entry in the Korea Hydrogen Certification Registry

Foreign hydrogen importers — including those shipping liquefied hydrogen or ammonia as a hydrogen carrier — must obtain clean hydrogen certification for their products to access the premium hydrogen power purchase agreements and mandatory purchase programs available under the Hydrogen Act.

3. Hydrogen Infrastructure: Licensing and Permits

3.1 Hydrogen Refueling Stations

Operators of hydrogen refueling stations (수소충전소) in Korea must obtain:

  • Location permit from the local municipal authority
  • Safety inspection and completion certificate from the Korea Gas Safety Corporation (KGS)
  • Business registration as a hydrogen supply business under the Hydrogen Act
  • Environmental impact review if located near residential zones

3.2 Hydrogen Storage and Transport

Large-scale hydrogen storage facilities (compressed gas, liquid hydrogen, or solid-state storage) are classified as hazardous facilities and regulated under both the High-Pressure Gas Safety Control Act (고압가스 안전관리법) and the Hydrogen Act. Foreign companies operating such facilities must:

  • Designate a qualified safety manager (안전관리자) under Korean law
  • Conduct periodic safety inspections by KGS-accredited inspectors
  • Maintain emergency response plans approved by the local fire authority
  • Carry mandatory liability insurance for hydrogen facility incidents

3.3 Hydrogen Pipeline Networks

The construction and operation of hydrogen pipeline infrastructure is governed by the Urban Gas Business Act (도시가스사업법) as amended to cover hydrogen, and requires a separate hydrogen pipeline business license from MOTIE. Pipeline projects affecting public roads require additional permits from MOLIT.

4. Renewable Energy Framework and Green Hydrogen Integration

4.1 Renewable Portfolio Standard (RPS) and Hydrogen Connection

Korea's Renewable Portfolio Standard (RPS) under the Act on the Promotion of Development, Use and Diffusion of New and Renewable Energy (신에너지 및 재생에너지 개발·이용·보급 촉진법) requires major power generators (capacity above 500MW) to source a mandatory percentage of their electricity from renewable sources (currently approximately 13%, rising annually). Green hydrogen produced from RPS-eligible renewable electricity can generate Renewable Energy Certificates (RECs), which are tradeable under the RPS system.

4.2 Hydrogen Power Purchase Agreements (H-PPA)

Under the Hydrogen Act framework, Korea has introduced mandatory purchase obligations for hydrogen-blended gas and pure hydrogen power. Power generators can enter into long-term Hydrogen Power Purchase Agreements (H-PPAs) with hydrogen suppliers, with pricing regulated by the Korea Power Exchange (KPX). Foreign hydrogen importers and green hydrogen producers should structure their supply agreements to qualify as H-PPA counterparties.

4.3 Offshore Wind Integration for Green Hydrogen

Korea's offshore wind development plan (targeting 14.3GW by 2030) is explicitly connected to green hydrogen production targets. Foreign offshore wind developers participating in Korea's offshore wind program can negotiate hydrogen offtake agreements alongside their Power Purchase Agreements, subject to MOTIE's integrated energy planning guidelines.

5. Foreign Investment in Korea's Hydrogen Sector

5.1 Investment Incentives

Korea actively courts foreign investment in the hydrogen sector through multiple channels:

  • Cash Grants: Foreign investments in hydrogen production, storage, or fuel cell manufacturing exceeding KRW 50 billion with significant job creation may qualify for cash grants under FIPA's investment incentive scheme
  • Tax Incentives: Corporate tax reductions of 100% (first 5 years) and 50% (next 2 years) for foreign-invested companies in the hydrogen sector locating in Foreign Investment Zones (FIZ) or Free Economic Zones (FEZ)
  • Special Hydrogen Economy Zones: MOTIE has designated several Special Hydrogen Economy Zones (수소경제 규제특구) with streamlined permitting and testing environments for hydrogen technologies
  • Green Energy Fund: State-backed green energy fund providing low-interest financing for hydrogen infrastructure projects involving foreign investment

5.2 Key Procurement Opportunities

Korea's hydrogen economy program creates substantial procurement opportunities for foreign companies:

  • Electrolysis equipment (alkaline, PEM, SOEC systems) for green hydrogen production
  • Fuel cell systems for distributed power generation, buildings, and transportation
  • Hydrogen storage technologies (compressed tanks, liquid hydrogen systems, LOHC)
  • Hydrogen carrier import infrastructure (ammonia terminals, LH₂ carriers)
  • Carbon capture and storage (CCS) systems for blue hydrogen production
  • Hydrogen pipeline materials and safety monitoring systems

6. Carbon Neutrality and Emissions Trading Interface

Korea's Emissions Trading Scheme (K-ETS) under the Act on the Allocation and Trading of Greenhouse Gas Emission Permits intersects with the hydrogen economy at several points:

  • Steel companies and other heavy industries using hydrogen as a reducing agent can claim carbon credits for avoided emissions
  • Green hydrogen producers can generate and sell carbon offset credits under K-ETS
  • Blue hydrogen projects must demonstrate net carbon savings accounting for the CCS efficiency rate to benefit from K-ETS credit generation
  • Hydrogen fuel cell power plants count as low-carbon generation for K-ETS allocation purposes

7. Safety Regulations for Hydrogen Technologies

The Korean gas safety regulatory framework is among the world's most rigorous. Foreign companies entering Korea's hydrogen market must ensure that their products comply with Korea's hydrogen safety standards, which are administered by the Korea Gas Safety Corporation (KGS) and are largely consistent with (but not identical to) ISO and IEC standards. Key compliance areas include:

  • Hydrogen vehicle systems: compliance with KGS safety standards for hydrogen fuel cell vehicles and hydrogen internal combustion engine vehicles
  • Electrolyzers: KGS certification for pressurized electrolyzer systems
  • Storage vessels: compliance with Korean Pressure Vessel Safety Standards (KS B 6750)
  • Piping systems: compliance with Korean gas piping safety standards (KS D 3595)

8. Practical Entry Strategy for Foreign Companies

  1. Map the regulatory pathway: Identify which ministry leads for your specific hydrogen activity (MOTIE for production/supply, MOLIT for transport infrastructure, MoE for environmental certification)
  2. Obtain Clean Hydrogen Certification: If importing or producing hydrogen for Korean power markets, initiate certification early — the process takes 6–12 months
  3. Identify applicable special zones: Assess whether locating in a Special Hydrogen Economy Zone or Free Economic Zone offers meaningful advantages for your project
  4. Structure for RPS/H-PPA qualification: Ensure your production or import supply chain is structured to qualify for REC generation and H-PPA pricing premiums
  5. Safety compliance planning: Engage KGS early to understand certification requirements for your specific technology (electrolyzers, storage systems, dispensing equipment)
  6. Carbon credit integration: Assess K-ETS credit generation potential and structure project to maximize carbon credit value
  7. Partner with Korean conglomerates: POSCO, Hyundai, SK, Lotte, and Hanwha are all major hydrogen investors; foreign companies often enter via technology licensing or joint venture arrangements with these groups

Frequently Asked Questions (FAQ)

Q1: Does Korea's Hydrogen Act apply to foreign companies that export hydrogen to Korea?

Yes, in part. While the Act's operational and safety provisions primarily apply to facilities and operations within Korea, the Clean Hydrogen Certification requirements apply to all hydrogen sold in Korea regardless of production origin. Foreign exporters of hydrogen (whether as gas, liquefied hydrogen, or ammonia as a hydrogen carrier) must obtain certification for their products to access Korea's premium hydrogen procurement programs and Hydrogen Power Purchase Agreements.

Q2: What is the difference between Korea's Special Hydrogen Economy Zones and Free Economic Zones?

These are distinct but potentially overlapping designations:

  • Special Hydrogen Economy Zones (수소경제 규제특구): Designated under the Act on Special Cases Concerning Regulation of the Local Government, these zones allow regulatory sandbox testing of hydrogen technologies not yet fully licensed under existing law. They focus on technology testing and regulatory experimentation, with streamlined project authorization but not necessarily tax incentives.
  • Free Economic Zones (FEZ/경제자유구역): Broader investment zones offering tax exemptions, infrastructure support, and simplified administrative procedures for all types of foreign-invested business. The key benefit for hydrogen investors is the corporate tax exemption (100% for 5 years, 50% for 2 years).
  • Foreign Investment Zones (FIZ/외국인투자지역): Project-specific designations for large foreign investments, offering the most customized incentive packages including cash grants and land lease at preferential rates.

Q3: How does Korea's green hydrogen certification compare with EU standards?

Q4: Are there local content requirements for hydrogen projects receiving government support?

Korea's hydrogen support programs do not impose formal local content requirements equivalent to, e.g., the US Inflation Reduction Act's domestic content bonus. However, practical procurement preferences and competitive bid structures for government-backed hydrogen projects typically favor suppliers with Korean manufacturing presence or technology transfer agreements with Korean partners. Foreign companies should assess whether establishing Korean manufacturing or assembly operations improves their competitive position in government procurement.

Q5: What liability exposure exists for hydrogen facility incidents in Korea?

The Hydrogen Act and underlying gas safety legislation create a strict liability framework for hydrogen facility operators. Key exposure points:

  • Third-party bodily injury and property damage from hydrogen incidents: strict liability (fault not required)
  • Regulatory fines for safety standard violations: up to KRW 100 million per violation
  • Criminal liability for operators responsible for fatal incidents: imprisonment up to 10 years
  • Business suspension or license revocation for repeated safety violations
  • Environmental liability for hydrogen-related soil or water contamination

Q6: Can foreign hydrogen companies participate in Korea's government R&D programs?

Yes, with conditions. Foreign companies with Korean subsidiaries can participate in MOTIE's hydrogen R&D programs, including the Hydrogen Energy Innovation Technology Development Project. Participation typically requires a Korean co-principal investigator and collaboration with a Korean research institution or university. The resulting IP may be subject to joint ownership with the Korean government. Foreign companies should carefully negotiate IP terms before entering into government R&D agreements.

Q7: What are the key hydrogen import terminal opportunities in Korea?

Korea plans to import significant volumes of green and blue hydrogen by 2030, primarily in the form of liquefied hydrogen (LH₂) and ammonia. Key terminal development opportunities include:

5. Preguntas Frecuentes (FAQ)
