Korean Carbon Credits and Emissions Trading Scheme (K-ETS): A Legal Guide for Foreign Companies
South Korea operates one of Asia's most advanced carbon markets. The Korean Emissions Trading Scheme (K-ETS), launched in 2015 under the Act on the Allocation and Trading of Greenhouse Gas Emission Permits (온실가스 배출권의 할당 및 거래에 관한 법률, hereinafter "ATEGEP"), is a mandatory cap-and-trade system covering approximately 73% of the country's total greenhouse gas (GHG) emissions. For foreign companies with Korean operations, manufacturing subsidiaries, or joint ventures, understanding K-ETS compliance obligations is no longer optional — it is a legal and financial imperative.
This article provides a comprehensive legal analysis of K-ETS for foreign-invested enterprises (FIEs), covering allocation methodology, compliance obligations, trading mechanisms, penalties, and strategic considerations under Korean environmental law.
1. Legal Framework: Key Statutes and Regulations
The K-ETS legal architecture rests on several interlocking instruments:
- Act on the Allocation and Trading of Greenhouse Gas Emission Permits (ATEGEP) — primary enabling legislation
- Enforcement Decree of ATEGEP — implementation rules, allocation methodology
- National Basic Plan for Climate Change Response — 5-year strategic direction
- Framework Act on Carbon Neutrality and Green Growth (탄소중립기본법, enacted 2021) — overarching net-zero legal target by 2050
- Act on the Management of Greenhouse Gas Emissions and Energy Statistics — GHG reporting obligations
- Industrial Site and Community Development Act — sector-specific compliance links
Regulatory oversight is divided between the Ministry of Environment (MOE), which manages the overall scheme, and the Ministry of Trade, Industry and Energy (MOTIE), which handles energy-intensive sector allocations.
2. Who Must Comply? Coverage and Thresholds
K-ETS applies to entities — regardless of ownership nationality — that meet the following criteria:
| Category | Threshold |
|---|---|
| Business entity (사업장) | Annual GHG emissions ≥ 125,000 tCO₂eq for 3 consecutive years |
| Individual facility (시설) | Annual GHG emissions ≥ 25,000 tCO₂eq for 3 consecutive years |
| Voluntarily designated | Entities below threshold may apply to join |
Covered sectors include steel, cement, petrochemicals, refining, power generation, aviation (domestic), buildings, and waste. Foreign-invested manufacturing plants, data centers above threshold, and large retail or logistics operations are commonly subject to K-ETS.
3. Allocation Phases: Free vs. Auctioned Permits
K-ETS operates in multi-year compliance periods. The current Phase 3 (2021–2025) features the following allocation structure:
- Free allocation (무상할당): The majority of permits are still allocated free of charge based on historical emissions (grandfathering) or benchmark intensity. However, free allocation is declining: by Phase 4 (2026–2030), auctioning is expected to increase significantly.
- Auctioned allocation (유상할당): A growing portion of permits must be purchased at government-run auctions managed by the Korea Exchange (KRX) and the Korea Environment Corporation (KECO/KECOhub).
- Market trading: Covered entities may buy and sell Korean Allowance Units (KAUs) on the secondary market.
- Korean Offset Credits (KOCs): Companies may use domestic offset credits generated from reduction projects (limited to 10% of surrender obligation).
Foreign-invested companies receive the same allocation treatment as Korean-owned entities; there is no nationality distinction in permit allocation under ATEGEP.
4. MRV: Monitoring, Reporting and Verification Obligations
Compliance under K-ETS requires rigorous MRV (Monitoring, Reporting, Verification):
- Annual GHG Emission Report: Covered entities must submit verified emission reports to MOE by March 31 of the following year, using approved calculation methodologies (Tier 1–4).
- Third-Party Verification: Reports must be verified by an accredited verification body (검증기관) within the KRX/KECO ecosystem before submission.
- Permit Surrender: By June 30, entities must surrender KAUs equal to prior-year verified emissions.
- Registry Account: All covered entities must maintain a Korea GHG Registry (온실가스종합정보센터) account for holding, transferring, and surrendering KAUs.
5. Trading Mechanisms: Secondary Market and Price Dynamics
KAU trading occurs on the Korea Exchange (KRX) Emissions Market. Key features:
- Trading hours: 09:30–15:30 KST (spot market)
- Price corridor: MOE can intervene with price stabilization measures if market price deviates excessively from a reference band
- Borrowing: Covered entities may borrow permits from the next year's allocation (up to 20% of annual obligation) — requires prior MOE approval
- Banking: Unused KAUs can be carried forward to future compliance periods
- Foreign participation in KAU spot trading is restricted; only domestic registered entities may hold and trade KAUs directly
For foreign parent companies wishing to monetize surplus KAUs held by their Korean subsidiaries, transfers must be routed through the Korean subsidiary's registry account and proceeds repatriated under normal foreign exchange rules (FETA).
6. Penalties for Non-Compliance
Non-compliance carries significant financial and legal consequences:
| Violation | Penalty |
|---|---|
| Failure to surrender sufficient permits | 3× market price of shortfall (per tCO₂eq), minimum KRW 100,000/tCO₂eq |
| Late or inaccurate GHG report | Administrative fine up to KRW 10 million; potential criminal referral for willful falsification |
| Unauthorized permit transfer | Permit cancellation + fine up to KRW 30 million |
| Failure to register | Designation order + fine up to KRW 10 million |
Additionally, under the Framework Act on Carbon Neutrality, MOE has authority to publish names of chronic non-complying entities — a significant reputational risk for multinational brands operating in Korea.
7. Strategic Considerations for Foreign Companies
7.1 M&A Due Diligence
When acquiring a Korean target with manufacturing operations, K-ETS exposure must be assessed during due diligence. Undisclosed permit shortfalls represent contingent liabilities that can significantly affect valuation. Buyers should request allocation statements, surrender history, and verification reports for the prior three compliance years.
7.2 Carbon Offset Projects
Foreign companies may develop Korean Offset Credit (KOC) projects in Korea — including renewable energy, fuel switching, and methane capture — and monetize resulting KOCs within the K-ETS framework. This can be an attractive business opportunity for energy and technology companies.
7.3 Voluntary Carbon Markets
Beyond K-ETS, Korea has an active voluntary carbon market. Companies may purchase verified credits under international standards (Gold Standard, VCS/Verra) to meet scope 3 corporate targets, subject to MOE's non-double-counting guidance.
7.4 Phase 4 Preparation (2026–2030)
Phase 4 design is expected to introduce tighter caps, expanded auctioning, and potential Carbon Border Adjustment Mechanism (CBAM) alignment with the EU. Companies should begin scenario planning now for higher carbon costs.
8. K-ETS vs. Other Carbon Markets: Comparative Overview
| Feature | K-ETS (Korea) | EU ETS | China ETS |
|---|---|---|---|
| Launch Year | 2015 | 2005 | 2021 (national) |
| Coverage | 73% of emissions | ~40% of EU emissions | Power sector only (expanding) |
| Current Phase | Phase 3 (2021–2025) | Phase 4 (2021–2030) | Phase 1 (ongoing) |
| Free Allocation | ~90% free (declining) | ~43% free (declining) | ~100% free (benchmarks) |
| Price Corridor | Yes (government stabilization) | Market Stability Reserve | Yes (floor/ceiling) |
| Foreign Trading | Via Korean subsidiary only | Open to all EU/EEA entities | Domestic entities only |
Frequently Asked Questions (FAQ)
Q1: Is my foreign-invested subsidiary automatically subject to K-ETS?
Not automatically. Your Korean subsidiary is subject to K-ETS only if it meets the emissions thresholds (≥ 125,000 tCO₂eq at entity level or ≥ 25,000 tCO₂eq at facility level for 3 consecutive years). MOE reviews aggregated data from the National GHG Statistics system to identify newly qualifying entities.
Q2: Can a foreign parent company trade K-ETS permits directly?
No. KAU trading is restricted to entities registered in the Korean GHG Registry. Only the Korean subsidiary (as a registered "covered entity") can hold and trade permits. Foreign parent companies may instruct their Korean subsidiary but cannot participate directly in the KRX market.
Q3: What happens if we acquire a Korean company that has a permit shortfall?
The permit obligation transfers to the successor entity. Post-acquisition, the buyer is responsible for surrendering any outstanding permits. Buyers should negotiate representations and warranties, escrow arrangements, and indemnities for undisclosed K-ETS liabilities during due diligence.
Q4: Are Korean Offset Credits (KOCs) internationally tradeable?
No. KOCs are domestic instruments and cannot currently be converted to or from international carbon credits (e.g., VCUs, Gold Standard) for compliance purposes within K-ETS. However, companies may pursue KOC projects and separately manage international voluntary credits for global ESG reporting.
Q5: How does K-ETS interact with the EU Carbon Border Adjustment Mechanism (CBAM)?
As of 2024, CBAM covers steel, cement, aluminum, fertilizers, hydrogen, and electricity imports into the EU. Korean exporters in these sectors must disclose embedded carbon content. If they can demonstrate carbon costs paid under K-ETS, partial CBAM credit may apply — though the EU has not yet finalized the K-ETS equivalency determination. Legal counsel should monitor these developments closely.
Q6: What are the GHG reporting deadlines I need to know?
Key annual deadlines: (1) January 31 — submit preliminary GHG data to GHG Management System; (2) March 31 — submit verified GHG emission report to MOE; (3) June 30 — surrender KAUs equal to prior-year verified emissions; (4) October 31 — optional early banking/borrowing applications. Missing the June 30 surrender deadline triggers the 3× penalty.
Q7: Is there a de minimis or SME exemption from K-ETS?
There is no general SME exemption, but entities below the 125,000/25,000 tCO₂eq thresholds are not mandatorily covered. Small entities may voluntarily participate. Separately, the Framework Act on Carbon Neutrality provides some policy support (subsidies, technical assistance) for SMEs undertaking voluntary reduction measures.

No automáticamente.
No actualmente.
