Korean Patent Registration for Foreign Technology Companies: A Complete Legal Guide
South Korea is home to some of the world's most aggressive patent filers. Samsung, LG, and Hyundai IP portfolios rank among the largest globally. For foreign technology companies seeking to enter or operate in Korea—whether in semiconductors, software, biotech, or advanced manufacturing—understanding Korea's patent registration system is not optional. It is a business imperative.
This guide provides a comprehensive overview of Korean patent law, the registration process at the Korean Intellectual Property Office (KIPO), strategic considerations for foreign applicants, and practical tips for protecting technology assets in Korea.
1. Overview of Korean Patent Law
Korean patent law is governed primarily by the Patent Act (특허법), most recently amended in 2024. The Korean Intellectual Property Office (KIPO, 특허청) is the central authority for receiving, examining, and granting patents in Korea.
Korea is a member of:
- The Patent Cooperation Treaty (PCT) — allowing foreign companies to file international applications designating Korea
- The Paris Convention — enabling priority claims within 12 months of the priority application date
- The World Intellectual Property Organization (WIPO) treaties
Korea operates a first-to-file system: the first applicant to file wins the patent right, regardless of who invented it first. This makes early, strategic filing critical for foreign companies.
2. What Can Be Patented in Korea?
Under Article 2 of the Korean Patent Act, a patentable invention must be a "creation of technical ideas utilizing natural laws." Specifically, the invention must be:
- Novel (신규성) — not previously disclosed anywhere in the world
- Inventive step (진보성) — not obvious to a person skilled in the art
- Industrially applicable (산업상 이용가능성)
Software and business method patents: Korea allows software-related patents where a specific technical solution is implemented. Pure business methods without a technical implementation are typically not patentable. Post-2014 KIPO guidelines have liberalized software patent acceptance somewhat, but careful claim drafting remains essential.
Biotech and pharmaceutical patents: These are fully patentable in Korea, including gene sequences, microorganisms, and novel compounds. Data exclusivity protections under the Korea-US FTA (KORUS FTA) also apply.
Not patentable: Laws of nature, mathematical theories, mental activities, and inventions that may harm public order or morality (Article 32).
3. The Korean Patent Registration Process
Step 1: Prior Art Search
Before filing, conduct a thorough prior art search using:
- Kipris (KIPO's patent database, kipris.or.kr) — free, Korean/English searchable
- Espacenet or Google Patents for international prior art
KIPO examiners search extensively. Undiscovered prior art can cause rejection or later invalidation.
Step 2: Prepare the Application
A patent application in Korea must include:
- Request for examination
- Specification (명세서) — background, summary, detailed description, claims
- Abstract
- Drawings (if applicable)
The application can be filed in Korean or English. However, if filed in English, a Korean translation must be submitted within 14 months from the priority date (or filing date if no priority). Foreign applicants must appoint a registered Korean patent attorney (변리사) to file on their behalf.
Step 3: Filing and Official Receipt
Applications are filed electronically via the KIPO e-filing system. Upon receipt, KIPO assigns an application number. Filing fees apply based on the number of claims.
Step 4: Request for Substantive Examination
Korea uses a deferred examination system. After filing, you have up to 3 years to request substantive examination. If no request is made within 3 years, the application is deemed abandoned. The examination request triggers a formal examination of novelty, inventive step, and other requirements.
Strategic tip: Many foreign companies delay examination to assess commercial value before incurring examination costs.
Step 5: Examination and Office Actions
KIPO examiners issue office actions (거절이유통지) listing grounds for rejection. Applicants have the right to respond with arguments and/or claim amendments. The typical response period is 2 months (extendable upon request). KIPO aims for a first office action within 10 months of the examination request.
Step 6: Registration and Maintenance
Upon allowance, the applicant pays the registration fee. The patent is published in the Korean Patent Gazette. Annual maintenance fees (연차등록료) must be paid to maintain the patent. Korean patents are valid for 20 years from the filing date.
4. PCT Applications Designating Korea
Foreign technology companies frequently use the PCT route:
- File an international PCT application in your home country
- Enter the Korean national phase within 30 months from the priority date
- Submit a Korean translation (if the PCT application was not in Korean)
- Appoint a Korean patent attorney
- Request examination within 3 years of the Korean filing date
PCT applicants benefit from the international search report (ISR), which can guide prosecution strategy in Korea.
5. Patent Examination Accelerated Programs
KIPO offers several fast-track examination programs:
Priority Examination (우선심사)
Available for:
- Inventions already being commercially implemented
- Green technology patents
- Inventions covered by overseas applications already granted
- SMEs and startups
Priority examination typically results in a first action within 2–4 months.
Patent Prosecution Highway (PPH)
Korea participates in PPH agreements with over 25 patent offices, including the USPTO, EPO, JPO, and CNIPA. If claims have been allowed in a partner office, you can request accelerated examination in Korea based on those allowed claims. PPH applications see examination within an average of 1.8 months.
6. Patent Enforcement in Korea
Holding a Korean patent gives you the right to:
- Exclude others from making, using, selling, importing, or offering for sale the patented invention in Korea
- License the patent (exclusively or non-exclusively)
- Sue infringers before Korean civil courts or the Patent Court (특허법원)
- Request customs border measures to seize infringing imports
Patent Litigation
Patent infringement cases in Korea are filed before District Courts (civil infringement claims) while invalidity proceedings go before the Intellectual Property Trial and Appeal Board (IPTAB, 특허심판원). Appeals from IPTAB go to the Patent Court, and further appeals to the Supreme Court.
Korean patent litigation can be swift: average first instance decisions take 12–18 months. Injunctive relief is available in urgent cases.
7. Utility Model Registration
Korea also offers utility model registration (실용신안) — a "petty patent" for less inventive but commercially valuable innovations. Requirements are lower (no inventive step examination), protection lasts 10 years, and registration is faster. Utility models are popular in manufacturing and mechanical device industries.
8. Employee Invention Ownership
Under Article 10 of the Korean Patent Act, inventions made by employees in the course of their duties (職務發明, jikmu balmyeong) may be assigned to the employer—but only if there is a written agreement or employment contract so providing. Even then, the employee retains the right to reasonable compensation. Korean courts have scrutinized employer practices around employee invention compensation, and several major Korean companies have faced significant damages awards. Foreign companies employing Korean engineers must implement proper employee invention policies.
9. Trade Secrets vs. Patents: Strategic Considerations
Not all technology innovations should be patented. Consider:
- Patent: Strong, public protection for 20 years; competitors can design around disclosed claims
- Trade secret: Potentially unlimited duration; protected under the Unfair Competition Prevention Act (부정경쟁방지법); risk of independent discovery or reverse engineering
For process-based innovations (manufacturing methods, algorithms), trade secret protection may be preferable where the process is not publicly visible in the product.
10. Cost Overview for Foreign Applicants
| Stage | Approximate Cost (USD) |
|---|---|
| Korean patent attorney filing fee | $1,500–$3,000 |
| KIPO official filing fee (basic, 3 claims) | ~$200 |
| Examination request fee | ~$400–$700 (depends on claims) |
| Translation cost (PCT to Korean) | $1,500–$3,000 |
| Annual maintenance (years 1–3) | ~$100–$150/year |
| Annual maintenance (years 4–9) | ~$250–$600/year (escalating) |

Frequently Asked Questions (FAQ)
Q1: Can a foreign company file a patent application in Korea directly without a Korean representative?
No. Under Article 5 of the Korean Patent Act, foreign entities without a domicile or business office in Korea must appoint a registered Korean patent attorney (변리사) or patent administrator to file and prosecute applications on their behalf. This representative must be registered with KIPO and the Korean Patent Attorneys Association.
Q2: How long does Korean patent examination take on average?
Standard examination typically takes 15–25 months from the examination request. Using the Patent Prosecution Highway (PPH) with an allowed application from the USPTO or EPO can reduce this to 2–4 months. Priority examination (우선심사) is available for certain categories and can yield a first office action within 2–4 months as well.
Q3: Can I file a software patent in Korea?
Yes, but the claims must be drafted to reflect a specific technical implementation. Abstract software logic or business methods without a technical feature are generally rejected. Korean courts and KIPO have accepted software patent claims where the software produces a specific technical effect in hardware operation, data processing, or system architecture. Working with experienced Korean patent counsel is essential for software claim drafting.
Q4: What happens if someone infringes my Korean patent?
You may file a civil lawsuit for infringement damages and/or injunctive relief in a Korean district court. Criminal complaints (고소) are also possible for willful infringement. Simultaneously, you may request the Korean Customs Service (관세청) to detain infringing imports. For patent invalidity challenges, the IPTAB (특허심판원) is the venue. You can also seek provisional injunctions (가처분) for urgent situations.
Q5: How does Korea's patent system compare to the US system?
| Aspect | Korea | United States |
|---|---|---|
| Priority System | First-to-file | First-inventor-to-file |
| Grace Period | 12 months (limited) | 12 months (broader) |
| Examination | Deferred (up to 3 years) | Must request; 12-month track available |
| Opposition | Post-grant invalidation via IPTAB | Inter partes review (IPR) at USPTO |
| Term | 20 years from filing | 20 years from filing |
| Software Patents | Allowed with technical effect | Allowed (post-Alice, narrow) |
Q6: What is the grace period rule in Korea?
Korea provides a 12-month grace period (Article 30 of the Patent Act) for certain prior disclosures made by the inventor. However, this grace period is narrower than the US grace period — it applies only to disclosures made by the inventor (or their successor) and does not cover third-party disclosures. Foreign companies that publicly disclose their technology before filing must be extremely careful about Korean patent rights.
Q7: Can Korean patents be monetized through licensing to Korean companies?
Yes. Patent licensing in Korea is common, particularly in the semiconductor, electronics, and pharmaceutical industries. License agreements are enforceable under Korean civil law (민법). Royalties paid to foreign patent holders are subject to Korean withholding tax (typically 16.5% including local surtax, potentially reduced under a tax treaty). KIPO also maintains a patent licensing marketplace (특허거래정보시스템) facilitating technology transfer transactions.

6. Costos para Solicitantes Extranjeros
| Etapa | Costo Aproximado (USD) |
|---|---|
| Honorarios del agente de patentes coreano | $1,500–$3,000 |
| Tasa oficial de presentación KIPO (básica, 3 reivindicaciones) | ~$200 |
| Tasa de solicitud de examen | ~$400–$700 |
| Costo de traducción PCT al coreano | $1,500–$3,000 |
| Tasas anuales (años 1-3) | ~$100–$150/año |
