Korean Design Rights and Trade Dress Protection for Foreign Brands
For foreign companies entering the Korean market, protecting the visual identity of their products is as critical as registering trademarks. Korea's design rights regime — governed by the Design Protection Act (디자인보호법) — offers robust protection for the ornamental features of products, while trade dress claims may be pursued under the Unfair Competition Prevention and Trade Secret Protection Act (부정경쟁방지 및 영업비밀보호에 관한 법률). This article provides foreign brand owners with a comprehensive guide to securing and enforcing design rights in Korea.
1. What is a Registered Design Right in Korea?
Under Korea's Design Protection Act (DPA), a design is defined as the shape, pattern, color, or combination thereof of an article that creates an aesthetic impression through the eye. A registered design right grants the holder exclusive rights to commercially work the registered design for a period of 20 years from the registration date.
Protectable subject matter includes:
- Product shapes (3D industrial designs)
- Surface patterns and colors of products
- Partial designs (parts of a product — since 2014 amendment)
- Interior designs (since 2021 amendment)
- Sets of articles (e.g., matching dinnerware sets)
Software UI/UX screen designs (icons, GUI) are also registrable since the 2014 amendment to the DPA, significantly broadening protection for tech companies.
2. Registration Requirements
To register a design in Korea, the applicant must satisfy:
- Novelty: The design must not have been publicly disclosed in Korea or internationally before the filing date
- Creativity: The design must not be easily created by a person skilled in the art from publicly known designs
- Industrial applicability: The design must be applicable to an article used in industry
- Statutory subject matter: Must be a "design of an article" (excludes software per se, fine arts used for aesthetic purposes only)
3. Application Process at KIPO
Design applications are filed with the Korean Intellectual Property Office (KIPO). The process:
- File application with drawings, photographs, or specimen showing all views of the design
- Formality examination: KIPO checks completeness (approximately 1–2 months)
- Substantive examination: Novelty and creativity assessment (approximately 6–12 months for standard track)
- Registration: Upon allowance, payment of registration fee → Certificate of Design Registration issued
Korea also offers a Fast Track (accelerated examination) for design applications, reducing examination time to approximately 2–3 months. This is particularly useful for products with short market lifecycles.
Multiple and Secret Designs
- Multiple design application: Up to 100 designs in one application if they belong to the same category (significant cost saving)
- Secret design system: The applicant may request that the registered design remain confidential for up to 3 years from registration — useful for protecting designs not yet commercially launched
4. International Route: Hague System
Foreign companies may protect designs in Korea via the Hague Agreement (Geneva Act), administered by WIPO. Korea has been a member since 2014. A single international application can designate Korea along with other member states. KIPO will conduct substantive examination and may issue a refusal within 6 months of the international registration date.
5. Trade Dress Protection Without Registration
Even without a registered design, foreign brand owners may protect their product trade dress (distinctive product appearance) under the Unfair Competition Prevention and Trade Secret Protection Act (UCPA).
5-1. Article 2(1)(j) — General Unfair Competition Clause
The 2014 amendment introduced a catch-all provision prohibiting acts that infringe another's commercial interests in a manner contrary to good commercial practice. This provision has been used to protect product configurations, packaging design, and brand ambiance (store design, layout) that are well-known but not registered.
5-2. Article 2(1)(ga) — Product Configuration Misappropriation
This provision (added in 2018) protects the shape, appearance, color, pattern, or combination thereof of goods that are widely known in Korea as identifying a particular business. It effectively allows trade dress claims similar to those in the U.S. under the Lanham Act, without requiring registration.
Key requirements for trade dress protection under UCPA:
- The trade dress must be distinctive (either inherently or acquired through use)
- The trade dress must be non-functional
- The defendant's use must create a likelihood of confusion as to origin
- The rights holder must show recognition by Korean consumers (important for foreign brands)
6. Design Rights Infringement: What Constitutes Infringement?
Infringement of a registered design occurs when a third party works a registered design or a design that is substantially similar to the registered design without authorization. Korea's "substantial similarity" standard considers whether ordinary consumers would perceive the designs as creating the same overall aesthetic impression.
Activities constituting infringement include:
- Manufacturing, using, selling, leasing, importing, or exporting infringing products
- Advertising or displaying infringing products
- Offering infringing products for sale
7. Enforcement Options
Civil Enforcement
- Injunction: Courts may grant preliminary and permanent injunctions against infringers
- Damages: Presumed damages based on (i) infringer's profits, (ii) royalty equivalent, or (iii) actual loss. Intentional infringement can result in up to 3× punitive damages (since 2020)
- Account of profits: Design holder may claim infringer's profits as damages
- Reputation restoration: Court may order publication of correction notice
Criminal Enforcement
Design infringement is a criminal offense: up to 7 years imprisonment or fines up to KRW 100 million for registered design infringement. Criminal complaints are filed with the police or prosecutors.
Customs Border Measures
Registered design holders may record their rights with Korean Customs to enable seizure of infringing goods at the border. Korea's Customs Act allows for both ex officio seizure and holder-initiated complaints.
8. Comparison: Korea vs. EU vs. U.S. Design/Trade Dress Protection
| Feature | Korea | EU | United States |
|---|---|---|---|
| Protection Type | Registered Design Right (DPA) + Trade Dress (UCPA) | RCD (Community Design) + Unregistered CD | Design Patent + Trade Dress (Lanham Act §43(a)) |
| Duration (Registered) | 20 years (DPA) | 25 years (EUIPO) | 15 years (Design Patent) |
| Novelty Grace Period | 6 months | 12 months | 12 months |
| Unregistered Protection | Yes (UCPA §2(1)(ga)) | Yes (UCD — 3 years) | Yes (§43(a) — if distinctive) |
| GUI/Icon Protection | Yes (since 2014) | Yes | Yes (as Design Patent) |
| Interior Design | Yes (since 2021) | Yes | Limited |
| Hague System | Member (since 2014) | Member | Member (since 2015) |
9. Strategic Tips for Foreign Brand Owners
- File early: Korea is a first-to-file jurisdiction. File before any public disclosure to avoid novelty destruction
- Use the secret design system for designs not yet launched in Korea
- Multiple design applications reduce filing costs significantly when protecting product families
- File Hague designations simultaneously with other key markets
- Document distinctiveness of trade dress from market entry (surveys, sales data) for unregistered protection
- Pursue customs recordal for registered designs to stop infringing imports
- Consider the Paris Convention 6-month priority right if filing in home country first

Frequently Asked Questions (FAQ)
Q1: Can a foreign company register a design in Korea without a Korean agent?
Foreign applicants without a business establishment in Korea must appoint a Korean patent attorney or patent agent to file with KIPO. This is a mandatory statutory requirement. The agent handles filing, prosecution correspondence, and response to office actions on behalf of the foreign applicant.
Q2: How long does design registration take in Korea?
Standard examination takes approximately 6–12 months. KIPO's Fast Track (accelerated examination) program can reduce this to 2–3 months. For products with short commercial lifecycles, the fast track is strongly recommended.
Q3: What is the difference between a design right and a trademark in Korea?
A design right protects the ornamental appearance of a specific article (2D or 3D). A trademark protects source identifiers (words, logos, shapes used as brand identifiers). Product shape can potentially be protected under both — as a registered design and as a three-dimensional trademark — if the shape functions as a source identifier. The protection periods and legal requirements differ significantly.
Q4: How does Korea protect software UI and icon designs?
Since the 2014 DPA amendment, screen designs (GUI, icons, animated designs) displayed on digital devices are registrable as designs of "articles" in Korea. Each screen state or transition may be registered separately. This is particularly valuable for app developers and tech companies entering the Korean market.
Q5: Can I protect my store layout and interior design in Korea?
Yes. Since the 2021 DPA amendment, interior designs (store layouts, restaurant interiors, hotel lobbies) can be registered as design rights in Korea. This is a significant development for global retail brands and hospitality companies. Additionally, a well-known store concept may also be protected under UCPA's general unfair competition clause.
Q6: What damages can I recover if my design is infringed in Korea?
Korean law provides several damage calculation options: (1) the infringer's profits attributable to infringement; (2) a reasonable royalty; or (3) actual losses suffered. Since 2020, courts may award up to 3× punitive damages for intentional infringement. In practice, Korean courts have become more willing to award substantial damages in IP cases, especially where the infringement was willful and commercial in scale.
Q7: Is trade dress recognized for restaurant chains and retail formats in Korea?
Yes. Korean courts have recognized trade dress protection for distinctive restaurant interiors and retail formats under UCPA Article 2(1)(j). To succeed, the foreign brand must demonstrate that the trade dress has acquired distinctiveness among Korean consumers — typically requiring evidence of long-term market presence, advertising, and consumer recognition surveys. Recent court decisions have been favorable to well-established foreign brands with documented recognition.

4. Comparativa: Corea vs. UE vs. EE. UU.
| Característica | Corea | UE | EE. UU. |
|---|---|---|---|
| Tipo de Protección | Derecho de Diseño (DPA) + Trade Dress (UCPA) | DCD (Diseño Comunitario) + DCD No Registrado | Patente de Diseño + Trade Dress (Ley Lanham §43(a)) |
| Duración (Registrado) | 20 años | 25 años | 15 años |
| Período de Gracia | 6 meses | 12 meses | 12 meses |
| Diseño de Interior | Sí (desde 2021) | Sí | Limitado |
5. Preguntas Frecuentes (FAQ)
