IP Border Measures and Customs Enforcement for IP Rights in Korea

For foreign brand owners, manufacturers, and rights holders, counterfeit goods entering or exiting Korea represent a serious commercial threat. Korea's customs enforcement system provides powerful tools to intercept fake products at the border — before they reach Korean consumers or are re-exported to third countries. Understanding and proactively using Korea's IP border measures is an essential part of any foreign company's Korea IP protection strategy.

This guide explains how Korea's customs IP enforcement system works, how foreign rights holders can register their IP with Korean Customs, and what legal steps to take when counterfeit or infringing goods are detected at the border.

1. Legal Framework for IP Customs Enforcement in Korea

Korea's IP border enforcement is primarily governed by:

  • Customs Act (관세법): Articles 235–235-3 prohibit the import and export of goods that infringe intellectual property rights and authorize Korean customs to seize infringing goods.
  • Trademark Act (상표법): Provides substantive rights that underpin trademark-related border seizures.
  • Copyright Act (저작권법): Authorizes customs enforcement of copyright in imported goods.
  • Design Protection Act (디자인보호법): Extends border enforcement to registered design rights.
  • Patent Act (특허법): Patent rights can also be enforced at the border.
  • Trade Secret Protection Act (부정경쟁방지법): Relevant to trade dress and unfair competition claims.

Korea is a party to the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS Agreement), which requires WTO member states to provide IP border measures. Korea's customs system is generally considered one of the most effective in Asia for IP enforcement.

2. Korea Customs Service (KCS) IP Enforcement Division

The Korea Customs Service (관세청) operates a dedicated IP Enforcement Division within its Investigation Bureau. KCS works closely with the Korean Intellectual Property Office (KIPO, 특허청), the Korea Copyright Commission (한국저작권위원회), and rights holders to identify and intercept counterfeit goods.

Korea has significantly strengthened its anti-counterfeiting enforcement in recent years, particularly for goods transshipped through Korean ports en route to other Asian or North American markets. The Incheon International Customs and Busan Customs are the major enforcement chokepoints.

3. IP Registration with Korean Customs: The Customs IP Registration System

Foreign rights holders can proactively register their intellectual property rights with Korean Customs through the Customs IP Registration System Registration enables Customs officers to automatically flag shipments that may contain infringing goods matching the registered IP profile.

Eligible IP Rights for Customs Registration

  • Registered trademarks (including well-known marks)
  • Copyrights and neighboring rights
  • Registered design rights
  • Patents and utility model rights
  • Geographical indications
  • Plant variety rights

Registration Process

  1. Submit a registration application to the KCS Intellectual Property Division
  2. Provide proof of IP ownership (registration certificate, assignment records)
  3. Submit product identification information (photographs, authentic product descriptions, distinguishing features vs. counterfeits)
  4. Designate a Korean contact person or agent for customs notifications
  5. Pay the registration fee (nominal — approximately KRW 30,000–50,000 per registration)

Once registered, the IP remains on the customs watch list for 2 years, renewable upon expiration. KCS officers are authorized to detain suspected infringing goods and notify the rights holder within 3 working days.

4. Seizure and Detention Procedures

When KCS officers identify a suspected infringing shipment at the border, the standard procedure is:

  1. Provisional detention: Goods are provisionally detained, and both the importer/exporter and the rights holder are notified in writing within 3 working days.
  2. Rights holder inspection: The rights holder (or their Korean representative) has the opportunity to inspect the detained goods and provide a written determination as to whether they are authentic or infringing.
  3. Security deposit: The importer may provide a security deposit (typically 120% of the value of the detained goods) to secure release of the goods while the dispute is resolved.
  4. Seizure and forfeiture: If the goods are confirmed as infringing, KCS may permanently seize and destroy them. Criminal referral to the prosecution is also possible.
  5. Release: If the goods are found to be non-infringing (or if the rights holder does not respond within the statutory period), the goods are released to the importer.

The statutory response period for rights holders is generally 10 working days (extendable in complex cases). Failure to respond within this period results in automatic release of the detained goods.

5. Ex Officio Enforcement (Without Rights Holder Registration)

KCS officers have the authority to seize suspected counterfeit goods ex officio — without a prior registration request from the rights holder — where counterfeiting is obvious and the infringement is clear. This power covers:

  • Well-known trademarks (globally recognized brands)
  • Obvious counterfeits bearing famous marks
  • Shipments matching previously flagged counterfeit patterns

Ex officio seizures are a valuable complement to the rights holder registration system. However, for consistent and proactive protection, formal registration is strongly recommended.

6. Criminal Penalties for IP Infringement at the Customs Border

Importing or exporting goods that infringe IP rights in Korea carries significant criminal consequences:

  • Trademark infringement: Up to 7 years imprisonment or a fine of up to KRW 100 million
  • Copyright infringement: Up to 5 years imprisonment or a fine of up to KRW 50 million
  • Patent infringement: Up to 7 years imprisonment or a fine of up to KRW 100 million
  • Design infringement: Up to 5 years imprisonment or a fine of up to KRW 50 million

Corporate entities can face fines up to 3–5 times higher under the "양벌규정" (dual punishment) provisions of each IP statute. KCS regularly refers serious commercial-scale counterfeiting cases to the prosecution.

7. Parallel Imports and Gray Market Goods

A common issue for foreign brand owners is parallel imports (병행수입) — genuine goods imported through unauthorized channels. Korea's position on parallel imports is nuanced:

  • Korea's Supreme Court has held that genuine goods sold by the rights holder or with their consent abroad can generally be parallel imported without constituting trademark infringement.
  • However, if the imported goods have been materially altered, repackaged, or differ significantly from goods intended for the Korean market (in terms of safety standards, labeling, warranties), parallel importation may infringe the Korean trademark.
  • Customs enforcement focuses on counterfeit goods, not parallel imports. Parallel import disputes are typically resolved through civil trademark litigation rather than customs proceedings.

8. Strategic Recommendations for Foreign IP Rights Holders

  1. Register with KCS proactively: Don't wait for a counterfeit incident. Register your trademarks, copyrights, and patents with Korean Customs before you have a problem.
  2. Maintain up-to-date product authentication information: Provide KCS with current product descriptions, photographs, hologram or serial number authentication features, and contact information for rapid response.
  3. Designate a Korean representative: A Korean IP attorney or authorized representative can respond to KCS notifications within the 10-day window, inspect detained goods, and coordinate enforcement action.
  4. Train your Korean distributors: Authorized distributors are often the first to identify parallel imports or counterfeit goods in the Korean market — engage them as enforcement allies.
  5. Coordinate customs enforcement with civil litigation: Border seizures alone are insufficient for commercial-scale counterfeiting operations. Parallel civil IP litigation against counterfeit producers and distributors is essential for deterrence.
  6. Monitor online platforms: Many counterfeit goods destined for Korea are listed on Korean e-commerce platforms (Coupang, 11Street, G-market). Coordinate online takedowns with physical border enforcement.

Frequently Asked Questions (FAQ)

Q1: Do I need to have a Korean trademark registration to use the customs enforcement system?

Yes, in most cases. Korean Customs enforcement requires a registered IP right in Korea. Unregistered trademarks or rights registered only in other jurisdictions are generally not eligible for customs registration. Therefore, foreign rights holders should prioritize registering their key trademarks and designs with KIPO before pursuing customs enforcement. Well-known marks may receive some limited protection even without registration, but formal registration is far more effective.

Q2: How quickly can Korean Customs respond to a suspected infringing shipment?

Once a shipment is flagged (either through a registration hit or ex officio), KCS officers can provisionally detain the goods and notify the rights holder within 3 working days. The rights holder then has 10 working days to respond. This means the entire initial determination process can be completed in approximately 2–3 weeks — relatively fast by international standards.

Q3: What happens if the importer provides a security deposit?

If the importer or exporter provides a security deposit equivalent to approximately 120% of the detained goods' value, the goods may be released pending the outcome of the IP dispute. The rights holder can then pursue civil or criminal proceedings. If the rights holder wins, they can recover damages from the security deposit. This mechanism prevents legitimate traders from being permanently delayed at the border while disputes are resolved.

Q4: Can I use customs enforcement for goods that are transshipping through Korea (not destined for the Korean market)?

Yes. Korea's Customs Act applies to goods in transit through Korean territory, not just goods for Korean consumption. Goods transshipping through Korean ports that infringe registered IP rights can be detained and seized. This makes Korean customs enforcement particularly valuable for rights holders concerned about counterfeit goods manufactured in East Asia and routed through Korean ports to North America or Europe.

Q5: What is the cost of registering IP with Korean Customs?

The official KCS registration fee is relatively nominal (approximately KRW 30,000–50,000 per IP right). However, rights holders should also budget for Korean legal counsel to prepare and submit the application, respond to customs notifications, and coordinate enforcement actions. Total costs for a well-managed KCS registration and enforcement program are modest relative to the commercial value of the protection obtained.

Q6: Are there any IP rights that cannot be enforced through Korean Customs?

Trade secrets and certain utility model rights have limited customs enforcement mechanisms compared to registered trademarks, patents, and copyrights. Additionally, the customs enforcement system is better suited for physical goods than digital content piracy — digital enforcement typically requires a separate KIPO or Korea Copyright Commission process. For trade dress claims not covered by a registered trademark or design, civil court proceedings are the primary enforcement route.

Q7: How does Korean Customs coordination work with KIPO and the police?

KCS, KIPO, and the National Police Agency (through its Cyber Investigation Bureau and specialized IP crime units) coordinate enforcement actions against serious commercial-scale IP infringement. For large-scale operations, KCS may initiate a joint investigation with the police or the Supreme Prosecutors' Office IP Crimes Unit. Foreign rights holders should engage Korean IP counsel who can navigate all three enforcement channels simultaneously for maximum effectiveness.

📋 Perspectiva Jurídica Coreana | Propiedad Intelectual y Aduanas
