Korean Cosmetics and K-Beauty Industry Regulations for Foreign Companies

South Korea's cosmetics industry — the engine behind the global K-beauty phenomenon — is one of the most rigorously regulated sectors in the country. For foreign companies seeking to manufacture, import, or sell cosmetic products in Korea, navigating the Cosmetics Act (화장품법) and the oversight of the Ministry of Food and Drug Safety (MFDS, 식품의약품안전처) is not optional; it is the bedrock of market entry compliance. This guide provides a comprehensive legal overview for international businesses aiming to tap into Korea's multi-billion-dollar beauty market.

1. Legal Framework: The Cosmetics Act

The primary legislation governing cosmetics in Korea is the Cosmetics Act, first enacted in 2000 and comprehensively revised in 2012 and again in 2020. The Act classifies cosmetics into two main categories:

  • General Cosmetics (일반화장품): Standard beauty products such as skincare, haircare, and makeup. Subject to notification rather than pre-market approval.
  • Functional Cosmetics (기능성화장품): Products claiming specific efficacy — such as whitening, UV protection (SPF), anti-wrinkle, or hair loss prevention. These require prior review and approval or reporting to the MFDS before sale.

The Act also governs safety standards, labeling requirements, advertising restrictions, and good manufacturing practices (GMP). Violations can result in product recalls, license revocations, and criminal penalties.

2. Market Entry Pathways for Foreign Companies

Foreign companies wishing to enter the Korean cosmetics market must choose one of two primary pathways:

A. Establishing a Responsible Person (책임판매업자)

Under Korean law, every cosmetic product sold domestically must be registered under a licensed Cosmetic Responsible Seller A foreign company may either:

  • Set up a Korean subsidiary or branch and register as the Responsible Person directly, or
  • Appoint a local Korean entity (importer or distributor) to act as the Responsible Person on its behalf.

The Responsible Person must register with the local authority (시·도지사) and bears legal accountability for product safety, labeling compliance, and post-market surveillance.

B. Contract Manufacturing and OEM/ODM

Many foreign brands leverage Korea's sophisticated OEM (Original Equipment Manufacturer) and ODM (Original Design Manufacturer) ecosystem. Under this model, a Korean manufacturer produces the cosmetics, and the foreign brand acts as the Responsible Seller. This requires careful contractual arrangements — including quality agreements, IP ownership clauses, and confidentiality terms.

3. Product Registration and Notification

General cosmetics do not require pre-market approval in Korea. Instead, the Responsible Person must submit a product notification to the MFDS Cosmetics Information System before marketing begins. The notification includes:

  • Full ingredient list (INCI names)
  • Product type and intended use
  • Manufacturing site information
  • Safety assessment data

For functional cosmetics, a formal efficacy review and product report submission is required. The MFDS reviews safety and efficacy data before granting authorization. Processing times typically range from 30 to 60 days.

4. Ingredient Restrictions and Safety Standards

Korea maintains one of the world's most comprehensive cosmetic ingredient control systems. The MFDS publishes positive lists, negative lists, and restricted ingredient lists:

  • Prohibited ingredients: Over 1,600 substances are banned outright (e.g., certain heavy metals, carcinogens).
  • Restricted ingredients: Substances that may only be used below specified concentration limits or for specific purposes (e.g., preservatives, colorants).
  • Permitted functional ingredients: Only approved whitening agents, UV filters, and anti-wrinkle actives may be used in functional cosmetics.

Foreign companies must map their formulations against Korean ingredient lists before entering the market. EU-compliant or FDA-approved formulations may still contain ingredients restricted in Korea.

5. Labeling Requirements

All cosmetic products sold in Korea must comply with strict labeling rules under the Cosmetics Act:

  • Product name, company name, and address of the Responsible Person
  • Manufacturing date or expiry date
  • Full ingredient list in Korean (Korean INCI names)
  • Usage instructions and precautions
  • Batch number and capacity/volume
  • Country of origin (for imported products)

Labels must be in Korean language. Secondary language labeling is permitted but Korean must be the primary language. Products marketed as functional cosmetics must clearly state their approved functional claims.

6. Advertising and Claims Regulation

The Cosmetics Act and the Act on Fair Labeling and Advertising strictly regulate cosmetic advertising. Key prohibitions include:

  • Claims that a general cosmetic has pharmaceutical or medical effects (e.g., "cures eczema")
  • Exaggerated or false efficacy claims (e.g., "eliminates wrinkles permanently")
  • Comparative advertising without substantiated data
  • Use of unapproved before-and-after images

The MFDS and the Korea Fair Trade Commission (KFTC) both have enforcement powers over misleading cosmetic advertising. Fines and corrective advertising orders are common penalties.

7. GMP and Manufacturing Standards

Korea's Cosmetic GMP Standard (우수화장품 제조 및 품질관리기준, CGMP) is aligned with ISO 22716. While GMP certification is currently voluntary for domestic manufacturers, it is required for export under some trade agreements and increasingly demanded by major retailers. Foreign manufacturers supplying the Korean market through local partners should ensure their facilities meet Korean GMP expectations.

8. Animal Testing Prohibition

Since 2017, Korea has banned animal testing of cosmetic ingredients and products intended for the domestic market. Imported cosmetics must also meet this requirement — products tested on animals after the ban cannot be sold in Korea. This aligns Korea with the EU and signals a broader shift toward alternative testing methods.

9. E-Commerce and Cross-Border Sales

Korea's booming online cosmetics market presents opportunities — but also compliance obligations for foreign sellers operating through Korean platforms (Coupang, Naver Shopping, Kakao Commerce) or cross-border e-commerce. Direct overseas online sales to Korean consumers are generally permitted, but customs clearance requirements, labeling obligations, and the Responsible Person system still apply for products physically shipped into Korea for resale.

10. Penalties and Enforcement

Violations of the Cosmetics Act carry serious penalties:

  • Product recalls and import bans for safety violations
  • Business license suspension or revocation for repeated infractions
  • Criminal penalties: Up to 3 years imprisonment or fines up to KRW 30 million for selling products without proper registration
  • Administrative fines (과태료): Up to KRW 1 million for labeling violations

Frequently Asked Questions (FAQ)

Q1: Does a foreign cosmetics company need a Korean legal entity to sell products in Korea?

Not necessarily. A foreign company can appoint a Korean entity (importer, distributor, or agent) to act as the Responsible Person (책임판매업자) on its behalf. This Korean entity takes on legal responsibility for regulatory compliance. However, if the foreign company wants full control over compliance and brand representation, establishing a Korean subsidiary is advisable.

Q2: What is the difference between a general cosmetic and a functional cosmetic under Korean law?

A general cosmetic is a product that cleans, moisturizes, or enhances appearance without specific therapeutic claims. A functional cosmetic makes specific efficacy claims recognized by law — such as skin whitening, UV protection (SPF), anti-wrinkle effects, or promotion of hair growth. Functional cosmetics require prior MFDS review and registration, which general cosmetics do not.

Q3: Can we use our EU or US formulation directly for the Korean market?

Not without a compliance review. Korea's ingredient restrictions differ significantly from EU Regulation 1223/2009 and US FDA rules. Some ingredients permitted in the EU or US are prohibited or restricted in Korea. A full ingredient mapping against the MFDS restricted/prohibited lists is mandatory before any product launch.

Q4: How long does functional cosmetic approval take?

The MFDS typically takes 30 to 60 business days to review functional cosmetic applications. However, products using already-approved standard formulas and ingredients may qualify for a simplified reporting process, reducing time to market significantly (as few as 7 days in some cases).

Q5: What labeling mistakes do foreign companies most commonly make?

The most frequent issues include: (1) failing to translate all required label fields into Korean; (2) using functional efficacy claims on non-registered general cosmetics; (3) omitting the Korean Responsible Person's name and address; (4) incorrect expiry date format; and (5) failing to use INCI ingredient names accepted under Korean standards. MFDS inspectors can seize and destroy non-compliant products at customs.

Q6: Is animal testing of cosmetics banned for imported products in Korea?

Yes. Korea's animal testing ban, effective since February 2017, covers both domestically manufactured and imported cosmetic products. If a product or its ingredients were tested on animals after the effective date of the ban, it cannot legally be sold in Korea regardless of origin.

Q7: What should a foreign company look for in an OEM/ODM agreement in Korea?

Key provisions to address include: IP ownership of formulations and trade dress; quality control rights and GMP audit access; exclusivity and minimum order quantities; liability allocation for regulatory non-compliance; and confidentiality obligations. Given the sophistication of Korean OEM/ODM manufacturers and the value of proprietary formulas, robust contractual protections are essential.

No necesariamente.
