Korean Food Import Regulations and Product Labeling for Foreign Food Companies

South Korea is one of Asia's most dynamic consumer markets for imported food products, with a sophisticated regulatory framework governing food safety, import procedures, and product labeling. Foreign food companies — whether exporting finished consumer products to Korea, supplying ingredients to Korean manufacturers, or operating food service businesses — face a dense web of rules enforced by the Ministry of Food and Drug Safety (MFDS, 식품의약품안전처) and the Korea Customs Service (KCS).

This guide provides a practical overview of the key legal requirements, common compliance pitfalls, and best practices for foreign food businesses entering or operating in the Korean market.

1. Legal Framework: Key Statutes

The primary laws governing food imports and labeling in Korea are:

  • Food Sanitation Act (식품위생법): The foundational food safety law. It sets general standards for food safety, hygiene, business registration, and prohibited substances. Any food sold in Korea must comply with its provisions.
  • Food Labeling Standards (식품 등의 표시기준): Issued by MFDS, these detailed regulations specify exactly what information must appear on food labels, in what language, font size, and format.
  • Health Functional Food Act (건강기능식품에 관한 법률): A separate regime for health functional foods (similar to dietary supplements). Products making health claims are subject to stricter approval requirements under this act.
  • Special Act on Imported Food Safety Management (수입식품안전관리 특별법): The core statute governing food import inspection and registration of foreign food businesses. Importers and foreign manufacturers must comply with this act's registration and documentation requirements.
  • Customs Act (관세법): Governs customs clearance procedures, import duties, and tariff classifications for food products.

2. Import Procedures: Step by Step

Importing food into Korea involves several sequential steps:

Step 1: Foreign Manufacturer Registration

Under the Special Act on Imported Food Safety Management, foreign food manufacturers exporting to Korea must be registered in the Foreign Manufacturer Registration System (해외제조업소 등록) maintained by MFDS. Registration requires:

  • Submission of facility information, production capacity, and HACCP/food safety certifications
  • Documentation showing the manufacturer is licensed/approved in the country of origin
  • Appointment of a Korean importer or authorized agent

Without registration, food products cannot be imported regardless of their safety profile. MFDS conducts periodic audits and can revoke registration for non-compliance.

Step 2: Import Declaration and Customs Clearance

Each shipment must be declared to KCS at the port of entry. The importer submits:

  • Import declaration form
  • Commercial invoice and packing list
  • Certificate of origin
  • Health/sanitary certificate from the exporting country's competent authority
  • Any required certification documents (organic certification, kosher/halal if claimed, etc.)

Step 3: MFDS Import Inspection

All food imports are subject to inspection by MFDS at the point of entry. The inspection regime has three tiers:

  1. Document Review: Basic check of import paperwork and label compliance. Applied to most repeat shipments from established manufacturers with clean compliance records.
  2. Organoleptic Inspection: Physical examination of product appearance, odor, and packaging. Applied more frequently to new product types or manufacturers.
  3. Laboratory Testing: Full chemical/microbiological testing for food safety compliance against Korean MRLs (Maximum Residue Limits) and food additive standards. Applied to higher-risk products, first-time imports, or products flagged by MFDS alerts.

Products failing inspection are either returned or destroyed at the importer's expense. Repeated failures can result in mandatory 100% inspection for all subsequent shipments and ultimately manufacturer registration cancellation.

Step 4: Release and Distribution

Upon successful inspection clearance, the importer takes delivery and the product enters Korean distribution channels. Post-market surveillance by MFDS continues throughout the product's distribution life.

3. Korean Food Labeling Requirements

Korean food labeling requirements are among the most detailed in Asia. Key mandatory elements include:

3.1 Language Requirement

All mandatory label information must be in Korean (한글). Foreign language text may appear in addition to Korean, but Korean must be at least as prominent. This applies to all pre-packaged food products sold to Korean end consumers.

3.2 Mandatory Label Elements

  • Product name: Must reflect the actual nature of the food and conform to Korean food product category naming conventions
  • Food type (식품 유형): The official MFDS food type designation must be listed
  • Ingredients list: All ingredients in descending order by weight; compound ingredients must be broken down; Korean names of ingredients required
  • Allergen declaration: 22 major allergens must be declared (includes tree nuts, sesame, shellfish, gluten-containing grains, milk, eggs, peanuts, soybeans, fish, and others)
  • Net weight/volume
  • Country of origin: For certain ingredients (raw agricultural products, key ingredients exceeding thresholds), country of origin must be stated separately
  • Importer information: Name, address, and phone number of the Korean importer
  • Best before date / use-by date: Korean format (year/month/day)
  • Storage conditions
  • Nutrition labeling: Required for most packaged foods; must list calories, carbohydrates, sugars, fat, saturated fat, trans fat, cholesterol, sodium, and protein

3.3 Prohibited Claims

Labels may not make therapeutic or disease-prevention claims unless the product is registered as a health functional food. Claims implying the product can treat, cure, or prevent disease are prohibited under the Food Sanitation Act and the Health Functional Food Act.

3.4 Label Placement Options

For imported products, Korean labels may be:

  • Printed directly on the original packaging
  • Affixed as a sticker label over or alongside the original label
  • Applied as a separate Korean label insert if space does not permit sticker labeling

The Korean label must be affixed before the product reaches consumers — it can be applied by the importer or at the bonded warehouse before customs release.

4. Special Regimes: Health Functional Foods and Novel Foods

4.1 Health Functional Foods (건강기능식품)

Products marketed with specific health benefit claims — such as immune support, joint health, digestive health — must be registered as health functional foods. The registration process requires:

  • Scientific substantiation of the claimed health function
  • MFDS product review and approval (can take 6–24 months for new ingredients)
  • Manufacture in GMP-certified facilities
  • Specific labeling requirements including approved function claims

Foreign health supplement companies must either register under this regime or position their products as general food (forgoing health claims).

4.2 Novel Foods and Ingredients

Foods or ingredients not previously used in Korea may be classified as "novel foods" requiring MFDS safety evaluation before commercialization. This includes certain plant extracts, insect-based protein products, CBD-containing foods (which remain broadly prohibited in Korea), and new food processing technologies (e.g., high-pressure processing of certain products).

5. Food Additives

Korea maintains its own positive list of permitted food additives. An additive permitted in the EU, U.S., or Japan is not automatically permitted in Korea. Foreign manufacturers must check the Korean Food Additives Standards (식품첨가물의 기준 및 규격) to ensure all additives in their formulations are approved for use in the applicable food category. Products containing non-listed additives will fail MFDS inspection.

6. Organic Certification and Eco-Labeling

Foreign foods marketed as "organic" in Korea must comply with the National Agricultural Products Quality Management Service (NAQS) organic certification requirements. Products certified under recognized foreign organic certification schemes (USDA Organic, EU Organic) may qualify for equivalence recognition, but the importer must apply for NAQS equivalency verification. Unauthorized "organic" claims on food labels violate the Act on Quality Management and Safety of Agricultural and Fishery Products.

7. Country of Origin Labeling (COOL)

Korea enforces strict country of origin labeling rules for certain food products, particularly:

  • Fresh and processed meat products: origin of the animal and processing country if different
  • Rice and rice-based products: origin of rice
  • Aquatic products: catch area or aquaculture country
  • Restaurant menus: country of origin required for beef, pork, chicken, rice, and kimchi ingredients on restaurant menus

False country of origin labeling carries criminal penalties under the Act on Origin Labeling of Agricultural and Fishery Products.

Frequently Asked Questions (FAQ)

Q1: Do I need a Korean importer to sell food products in Korea?

Yes. Under the Special Act on Imported Food Safety Management, all imported food must be handled by a registered Korean importer The Korean importer is legally responsible for compliance with all food safety and labeling requirements. Foreign companies can establish their own Korean subsidiary as the importer, or appoint an independent Korean distributor/importer.

Q2: How long does MFDS import inspection typically take?

Document review inspections are typically completed within 1–3 working days. Laboratory testing can take 7–14 working days depending on the tests required. For first-time imports of certain categories, the full inspection process including waiting time at the inspection center can take 2–4 weeks. Planning your initial import timeline with this buffer is advisable.

Q3: Can I use the same English-language label I use in the U.S./EU for Korean distribution?

No. All mandatory label information must be provided in Korean. The original English label must either be reprinted to include Korean text, or a Korean sticker label must be affixed before the product reaches consumers. The Korean label must be fully compliant with MFDS labeling standards — not merely a translation of the original label, since Korean requirements often differ from other markets.

Q4: Are food additives approved in the U.S. or EU automatically approved in Korea?

No. Korea maintains its own positive list of permitted food additives, and an additive approved in another country is not automatically permitted in Korea. Before exporting food products to Korea, all additives in your formulation must be verified against the Korean Food Additives Standards published by MFDS. Products containing non-approved additives will fail import inspection.

Q5: What happens if my product fails MFDS inspection?

Products that fail inspection must either be re-exported or destroyed at the importer's expense. MFDS will issue a formal inspection failure notice and records the failure in the food safety database. Repeated failures trigger escalating inspection intensity — the product may be placed on mandatory 100% sampling for subsequent shipments. Systematic failures can result in the foreign manufacturer's registration being suspended or revoked.

Q6: Are there food safety certificate requirements from the exporting country?

Yes. Most food categories require a health certificate or food safety certificate issued by the competent authority of the exporting country. The required format and issuing authority varies by product type. For example, meat products require an official veterinary certificate; processed food products generally require a free sale certificate. Confirm the specific requirements for your product category with MFDS or your Korean importer before shipment.

Q7: How are food contact materials (packaging) regulated?

Food contact materials — including plastics, rubber, metal, paper, and glass packaging that comes into contact with food — are regulated under the Food Sanitation Act and the MFDS Food Contact Material Standards Foreign manufacturers must ensure their packaging materials comply with Korean migration limits and material composition standards, which can differ from EU or U.S. standards. This is a frequently overlooked compliance area.
