Korean Pharmaceutical and Medical Device Regulatory Approval for Foreign Healthcare Companies
South Korea is one of Asia's most sophisticated healthcare markets, home to globally renowned pharmaceutical companies, cutting-edge medical device manufacturers, and a national health insurance system that drives high product uptake. For foreign healthcare companies seeking to enter this market—whether by marketing drugs, medical devices, in-vitro diagnostics, or biologics—understanding the Korean regulatory framework is not merely advisable: it is legally mandatory before any commercial activity begins.
Korea's primary regulatory authority for healthcare products is the Ministry of Food and Drug Safety (MFDS, 식품의약품안전처). The MFDS administers approval, licensing, post-market surveillance, and enforcement for all pharmaceutical drugs, biologics, medical devices, and cosmetics sold in Korea. Foreign companies must navigate a system that, while increasingly aligned with international standards such as ICH, ISO, and FDA/CE frameworks, retains distinct Korean requirements that can catch unprepared companies off guard.
1. Drug Marketing Authorization in Korea
Foreign pharmaceutical companies wishing to sell prescription or over-the-counter drugs in Korea must obtain a Drug Marketing Authorization (DMA) from the MFDS, governed by the Pharmaceutical Affairs Act (약사법, Act No. 17472). Key requirements include:
- Local Authorized Pharmaceutical Importer: Foreign companies must designate a Korean-licensed pharmaceutical importer (수입품목허가). This Korean entity acts as the local regulatory sponsor and assumes legal liability for product compliance within Korea.
- Full Dossier Submission (CTD Format): The Common Technical Document (CTD) format is accepted, including Modules 1–5 covering administrative data, quality (CMC), non-clinical, and clinical data. Korean-specific Module 1 administrative documents are required in Korean.
- GMP Certification: The manufacturing facility (domestic or foreign) must hold current Good Manufacturing Practice (GMP) certification recognized by the MFDS. Foreign facilities may use ICH Q7, EMA, or FDA-GMP equivalency, but the MFDS may conduct on-site GMP inspections.
- Clinical Data Requirements: Bridging studies (교량시험) may be required if the clinical data were generated in non-Asian populations. The MFDS increasingly accepts ICH E5-compliant bridging data, but this must be carefully evaluated for each product.
- Approval Timeline: Standard DMA review takes approximately 120–180 days from submission. Priority review (우선심사) is available for orphan drugs, rare diseases, and designated innovative pharmaceuticals, reducing review time to 90 days.
2. Medical Device Registration and Approval
Medical devices in Korea are regulated under the Medical Devices Act (의료기기법, Act No. 17535). The MFDS classifies medical devices into four risk-based classes:
- Class I (Low Risk): Self-certification (자기인증) with basic manufacturing or import license
- Class II (Moderate Risk): MFDS notification after third-party certification
- Class III (Moderate-High Risk): MFDS approval required with technical documentation
- Class IV (High Risk): Full MFDS approval with clinical evidence and strict post-market surveillance
Foreign medical device manufacturers must appoint a Korean Authorized Representative (KAR)—often called the "local representative" (국내 대리인)—who registers the product on behalf of the foreign manufacturer. The KAR assumes responsibility for post-market obligations including adverse event reporting and recall coordination.
For Class II–IV devices, a Technical File (기술문서) or full approval dossier must be submitted to the MFDS. CE-marked devices or FDA 510(k)-cleared devices may benefit from an abbreviated review pathway, but a separate MFDS approval is always required—there is no automatic mutual recognition with CE or FDA clearance.
3. In-Vitro Diagnostics (IVD) Regulations
IVDs in Korea were historically regulated under the Medical Devices Act, but since January 2024, standalone IVD regulations under the In Vitro Diagnostic Medical Device Act (체외진단의료기기법) have been in full effect. IVDs are now classified into performance categories A (lowest) through D (highest risk), with Class C and D requiring MFDS pre-market approval and clinical performance studies conducted in Korean laboratories or with Korean patient samples for certain high-risk tests.
4. Biologics and Advanced Therapy Products
Biologic drugs—including biosimilars, cell therapies, gene therapies, and regenerative medicine products—face additional regulatory layers. The Biological Products Act (생물학적제제 등의 제조·판매 관리 규칙) and relevant MFDS guidelines govern these products. Korea has become a leading biosimilar manufacturing and approval hub in Asia, with a well-defined pathway for biosimilar approval using comparative analytical, non-clinical, and clinical data.
5. National Health Insurance (NHI) Listing and Reimbursement
Regulatory approval alone does not guarantee commercial viability. Foreign healthcare companies must separately pursue NHI reimbursement listing with the Health Insurance Review and Assessment Service (HIRA, 건강보험심사평가원) and the National Health Insurance Service (NHIS, 국민건강보험공단). The process involves:
- Health Technology Assessment (HTA) review by HIRA
- Economic evaluation (cost-effectiveness analysis)
- Price negotiation with the NHIS
- Final listing decision by the Ministry of Health and Welfare (보건복지부)
The reimbursement process typically adds 12–24 months after MFDS approval. Reference pricing (참조가격제) and rebate agreements (위험분담제) are common mechanisms that foreign companies must anticipate in their pricing strategy.
6. Post-Market Surveillance and Pharmacovigilance
Post-approval, foreign companies must maintain robust pharmacovigilance (PV) systems in Korea. For drugs, this includes:
- Designated local Drug Safety Responsible Person (의약품 안전관리책임자)
- Periodic Safety Update Reports (PSURs) submitted to MFDS
- Expedited adverse event reporting (15-day rule for serious unexpected reactions)
- Re-evaluation and re-examination programs for newly approved drugs (재심사 제도)
Medical device manufacturers must implement a Post-Market Surveillance (PMS) plan including Unique Device Identification (UDI) registration on the MFDS UDI database, mandatory adverse event reporting, and periodic safety reports.
7. Clinical Trials in Korea
Conducting clinical trials in Korea requires IND (Investigational New Drug) approval from the MFDS and approval from the Institutional Review Board (IRB) at each clinical site. Key points:
- Korea follows ICH E6 GCP standards
- Multi-regional clinical trials (MRCTs) are encouraged and accepted
- Clinical Trial Authorization (CTA) review: approximately 30 days for drugs, 15 days for medical devices
- Korean subjects must be included in clinical trials if bridging data gaps exist
- Financial compensation for clinical trial subjects is permitted within MFDS guidelines
8. Import License vs. Manufacturing License
Foreign companies exporting to Korea must understand the distinction between:
- Import License (수입허가): Required for foreign-manufactured products. Held by the Korean importer, not the foreign manufacturer. The foreign manufacturer must be listed and GMP-certified.
- Manufacturing License (제조허가): Required if the foreign company establishes a Korean manufacturing entity. Requires MFDS facility inspection.
9. Regulatory Trends and Digital Health
Korea has introduced a Digital Health regulatory sandbox and a dedicated pathway for Software as a Medical Device (SaMD) under the Medical Devices Act amendments effective 2023. AI-based diagnostic software, mobile health applications meeting certain risk thresholds, and clinical decision support tools require MFDS approval as Class II–IV medical devices. Foreign digital health companies should assess whether their products qualify as SaMD under MFDS criteria.

Frequently Asked Questions (FAQ)
Q1: Can a foreign company apply directly to the MFDS, or must it use a Korean agent?
Foreign companies cannot directly hold a Korean drug or medical device marketing authorization. They must appoint a licensed Korean pharmaceutical importer (for drugs) or a Korean Authorized Representative (for medical devices). This entity is the legal holder of the authorization and bears regulatory obligations within Korea. HANBYOL LAW LLC can assist in structuring this arrangement and drafting the necessary agency agreements.
Q2: Does CE marking or FDA clearance allow expedited MFDS approval?
There is no automatic mutual recognition between CE marking, FDA clearance, and MFDS approval. However, the MFDS has abbreviated review pathways for CE/FDA-approved products. For Class II medical devices, CE-marked products may receive a faster technical review. For drugs, prior regulatory agency approval (PRA) from the FDA, EMA, or other ICH-member authorities can support an abbreviated NDA pathway in Korea. Each case must be assessed individually.
Q3: How long does the entire approval process take for a new pharmaceutical drug?
A full DMA process typically takes 12–24 months from first submission to final approval, accounting for review time, deficiency responses, GMP inspections, and administrative processing. Priority review for innovative drugs can reduce this to 6–12 months. Post-approval NHI reimbursement adds another 12–24 months, so total market entry timelines of 2–4 years are common for new innovative drugs.
Q4: What are the penalties for selling unapproved drugs or medical devices in Korea?
Under the Pharmaceutical Affairs Act and Medical Devices Act, selling unapproved products is a serious criminal offense. Penalties include imprisonment of up to 5 years and fines of up to KRW 50 million (approximately USD 38,000) per violation. Additionally, the MFDS may issue product recalls, sales suspension orders, and revoke existing licenses. Reputational damage can permanently impair market entry prospects.
Q5: Are there special incentives for rare disease or orphan drugs?
Yes. Korea has an Orphan Drug Designation (ODD) program under the Rare Disease Management Act Designated orphan drugs benefit from: priority MFDS review, reduced clinical data requirements (bridging data more readily accepted), expedited NHI reimbursement consideration, and 10-year market exclusivity. Foreign companies developing rare disease products should consider applying for Korean ODD early in development.
Q6: What Korean-specific documentation is required that differs from EU or US submissions?
Key Korea-specific requirements include: (1) Korean-language labeling (Korean labeling must be MFDS-approved before import/sale); (2) Module 1 administrative documents in Korean (including DMA application forms, local representative agreements, fee payments); (3) Korean Patient Information Leaflet (환자용 사용설명서); (4) Korean GMP certificate or MFDS GMP equivalency confirmation; (5) Korean pharmacovigilance contact designation; and (6) for IVDs, Korean laboratory performance studies may be required for Class C/D products.
Q7: Can a foreign company conduct clinical trials in Korea to support global regulatory submissions?
Absolutely. Korea is a highly desirable clinical trial jurisdiction due to its well-trained clinical investigators, sophisticated hospital infrastructure, ICH GCP compliance, fast IRB approvals, and relatively low trial costs compared to Western markets. Data generated in Korean clinical trials are accepted by FDA, EMA, and PMDA under ICH E5/E17 guidelines. Many multinational companies conduct Korean sub-studies within global MRCTs to support both Korean approval and global regulatory strategies.

3. Regulación de Diagnósticos In Vitro (IVD)
