Korean Waste Management and Extended Producer Responsibility (EPR) for Foreign Manufacturers
South Korea operates one of the most rigorous waste management and Extended Producer Responsibility (EPR) frameworks in Asia. Foreign companies manufacturing, importing, or distributing products in Korea must understand the obligations imposed under the Act on the Resource Circulation of Electrical and Electronic Equipment and Vehicles (WEEE/ELV Act), the Act on the Promotion of Saving and Recycling of Resources (APSRR), and the broader Framework Act on Resource Circulation (FARC, 자원순환기본법). Non-compliance can result in criminal fines, mandatory recall orders, and suspension of business registration — consequences that foreign companies are frequently unprepared for.
1. Overview of Korea's EPR System
Korea's EPR system was introduced in 2003 and has been comprehensively reformed under the APSRR (자원의 절약과 재활용촉진에 관한 법률) and the FARC (자원순환기본법, enacted 2016, effective 2018). The Ministry of Environment (MOE, 환경부) and the Korea Environment Corporation (KECO, 한국환경공단) jointly administer EPR targets, data reporting, and enforcement.
Under EPR, producers and importers of designated products are legally responsible for financing and ensuring the collection and recycling of their products once those products reach end-of-life. The system covers:
- Packaging materials (paper, glass, metal, plastic —
- Electrical and electronic equipment (TV, washing machine, air conditioner, mobile phones —
- Batteries and tires
- End-of-life vehicles (ELVs)
- Lubricant oils
2. Who Is Subject to EPR Obligations?
Under Article 16 of the APSRR, any entity that manufactures or imports designated products for domestic sale is subject to EPR obligations. This explicitly includes:
- Foreign companies operating through a Korean subsidiary or branch
- Foreign companies importing directly into Korea through a customs broker or agent
- Online cross-border retailers if their products are physically imported into Korea
A common misconception among foreign companies is that EPR obligations attach only to large Korean conglomerates (chaebol). In fact, any importer of record (IOR) — regardless of nationality — bears direct EPR liability from the moment goods clear Korean customs. Foreign companies that sell through Korean distributors may contractually shift some obligations, but ultimate statutory liability cannot be fully transferred.
3. Packaging Material EPR: Calculation and Compliance
The packaging EPR obligation is calculated based on the weight of packaging materials placed on the Korean market in the previous year. Producers/importers must:
- Register with KECO's EPR portal
- Report annual tonnage of each packaging type (paper, plastic, glass, metal) by March 31
- Meet mandatory recycling rates (재활용 의무량) set by MOE annually — typically 70–90% depending on material
- Either self-fulfill recycling obligations or join a Producer Responsibility Organization (PRO, 생산자책임재활용제도 공제조합) by paying a collective fee
Failure to meet recycling targets results in recycling charges (재활용부과금) assessed at 130–200% of the standard recycling cost. In 2023, Korea significantly tightened the list of "difficult-to-recycle" packaging (재활용 어려움 표시 의무화), requiring companies to redesign packaging or pay premium surcharges.
4. E-Waste (WEEE) EPR for Electronics Manufacturers
Foreign electronics companies must comply with Korea's WEEE regime under the Act on Resource Circulation of Electrical and Electronic Equipment and Vehicles Key obligations include:
- Substance restrictions: Korea mirrors EU RoHS — six hazardous substances (lead, mercury, cadmium, hexavalent chromium, PBB, PBDE) are restricted in electronic products.
- Take-back obligation: Manufacturers/importers must operate or contribute to a take-back network for end-of-life electronics. KECO administers a collective scheme that companies can join by paying annual fees based on sales volume.
- Reporting: Annual reports on quantities placed on market and quantities collected/recycled must be filed with KECO by March 31 each year.
Since 2022, Korea has implemented mandatory recycled content requirements for certain plastic products, aligning with its Carbon Neutrality and Green Growth Act (탄소중립기본법) goals. Foreign plastic product manufacturers must use a minimum percentage of recycled plastic (PCR content) or pay compensatory levies.
5. Waste Disposal Fees and Volume-Based Waste Fee (종량제)
Korea's pioneering Volume-Based Waste Fee System (종량제, VBWF) has been in operation since 1995. Under this system, commercial businesses — including foreign-invested companies — must use designated paid waste bags (종량제 봉투) or pay volume-based disposal fees for general waste. Separate collection obligations apply for recyclables, food waste, and large items.
Foreign companies operating facilities in Korea must ensure that:
- All waste is segregated at source (paper, plastic, glass, food waste)
- Industrial waste (사업장 폐기물) is handled only by licensed waste management companies
- Hazardous industrial waste (지정폐기물) requires separate disposal contracts and consignment manifests (폐기물 인계·인수서)
6. Single-Use Plastics Ban and 2030 Targets
Korea's 2022 amendments to the APSRR introduced sweeping bans on single-use plastics. As of 2023, the following are prohibited in food service establishments and retail:
- Single-use plastic cups inside cafes and restaurants
- Single-use plastic straws (except for medical/accessibility purposes)
- Single-use styrofoam containers at dine-in establishments
Korea's 2030 Resource Circulation Target mandates a 20% reduction in plastic packaging waste by 2030 compared to 2022 levels. Foreign F&B and retail companies operating in Korea must review their packaging strategies accordingly.
7. Enforcement, Penalties, and Criminal Liability
The FARC and APSRR impose graduated penalties:
- Failure to register with EPR portal: administrative fine up to KRW 10 million
- Failure to meet recycling obligations: recycling charges (130–200% of standard cost) plus administrative fine up to KRW 30 million
- Illegal dumping of industrial waste: criminal fine up to KRW 100 million and/or imprisonment up to 7 years
- Illegal disposal of designated hazardous waste: up to 10 years' imprisonment
The dual punishment rule (양벌규정) — ubiquitous in Korean regulatory law — means that both the corporate entity and its responsible officer (typically the CEO or COO of the Korean subsidiary) can face criminal charges simultaneously. Foreign executives should be aware that visa cancellation and deportation orders may follow criminal conviction.
8. Practical Compliance Checklist for Foreign Companies
- ✅ Determine whether your products/packaging fall under EPR categories (APSRR Schedule 1)
- ✅ Register with KECO's EPR portal within 30 days of commencing Korea sales
- ✅ Calculate annual tonnage of packaging/products placed on market by December 31
- ✅ Choose between self-fulfillment or joining a PRO — most foreign companies prefer PRO for simplicity
- ✅ File annual EPR report by March 31 each year
- ✅ Review packaging for RoHS substance compliance and redesign if necessary
- ✅ Contract with licensed industrial waste disposal companies for facility operations
- ✅ Implement waste segregation protocols at all Korean facilities
- ✅ Monitor regulatory updates — Korea's EPR scope is expanding annually
9. Strategic Considerations for Foreign Companies
Foreign companies entering Korea often underestimate EPR compliance costs in their initial market entry budgets. PRO membership fees can be significant for high-volume importers. Additionally, Korea's 2024 regulatory updates have imposed eco-design obligations (생태설계의무): products must be designed for disassembly and recycling, and companies must submit Product Environmental Footprint (PEF) declarations for certain categories by 2026.
Companies in the battery and EV supply chain should pay particular attention to the Battery Act (이차전지 특별법) interface with EPR: batteries must carry recycling marks, and manufacturers must establish separate take-back arrangements certified by MOE.

Frequently Asked Questions (FAQ)
Q1: Does EPR apply to my company if we sell through a Korean distributor?
Statutory EPR liability falls on the importer of record (IOR). If your Korean distributor acts as IOR and imports goods in their name, they bear primary EPR liability. However, if you import in your company's name and then sell to a distributor, you remain liable. It is essential to clearly define EPR responsibility in your distribution agreement and to verify that your Korean partner is actually meeting their EPR obligations — MOE audits are increasingly targeting the upstream supply chain.
Q2: What are the penalties for failing to join the PRO or self-fulfill recycling obligations?
Companies that fail to meet their recycling quota face a recycling non-fulfillment charge (재활용부과금) set at 130% of the standard recycling cost for first-time shortfalls and 200% for repeat violations. These charges are assessed annually by KECO and are non-deductible for corporate tax purposes. Persistent non-compliance can result in MOE issuing a business improvement order (개선명령) and ultimately referring the case to the prosecutor's office.
Q3: How does Korea's WEEE regime compare to the EU's?
| Criterion | Korea (WEEE Act) | EU (WEEE Directive 2012/19/EU) |
|---|---|---|
| Scope | 10 product categories (household appliances, IT, telecom, consumer electronics, lighting, tools, toys, medical, monitoring, dispensers) | 10 categories (similar) |
| Collection targets | 75% of average annual sales (2022 onward) | 65% of average weight placed on market |
| Hazardous substance restrictions | RoHS equivalent (6 substances) | RoHS 2011/65/EU (10 substances from 2019) |
| Producer registration | KECO portal (mandatory) | National registries (e.g., EAR in Germany) |
| PRO option | Yes (collective scheme available) | Yes (varies by country) |
Q4: Are single-use plastic bans enforced against B2B companies?
The 2022 single-use plastic bans primarily target food service establishments and retailers that directly provide products to consumers. However, B2B packaging used within the distribution chain remains subject to general EPR packaging obligations. MOE has signalled that B2B single-use plastics will be progressively included in the ban framework by 2025–2026.
Q5: What is the compliance deadline for new eco-design requirements?
Korea's MOE published draft Eco-Design Standards (생태설계 기준) in 2023, with final standards expected to take effect for major appliance categories by late 2025 and for plastic packaging by 2026. Foreign companies should begin internal product design reviews now, as retrofit compliance after standards take effect is typically costlier than proactive redesign.
Q6: Do online sellers on Korean marketplaces (Coupang, Naver) have EPR obligations?
Yes. The 2023 APSRR amendment extended EPR obligations to e-commerce sellers shipping products directly to Korean consumers. If a foreign seller's goods are fulfilled from within Korea (e.g., via Coupang Rocket Delivery or FBA-equivalent services), the seller — or the fulfillment platform on their behalf — must meet EPR packaging obligations. KECO has issued guidance that platform operators may register collectively on behalf of marketplace sellers under certain conditions.
Q7: What documentation do we need for hazardous industrial waste disposal?
For designated hazardous waste (지정폐기물, covering items such as waste oil, acid/alkaline solutions, asbestos, fluorescent lights, and medical waste), companies must maintain a consignment manifest (폐기물 인계서·인수서) documenting the type, quantity, transporter, and disposal facility for each shipment. These records must be retained for 3 years and submitted to MOE's electronic waste management system (올바로 시스템, Allbaro System) within 2 days of each transfer. Failure to use licensed transporters and disposers is a criminal offense.

(WEEE)EPR
- ✅ 选择自行履行或加入PRO(多数外资企业选择PRO以简化操作)
