Korean Design Rights and Trade Dress Protection for Foreign Companies
South Korea's dynamic consumer market and thriving manufacturing ecosystem make it one of Asia's most important jurisdictions for brand and product design protection. For foreign companies, protecting the visual identity of products—from industrial designs to packaging aesthetics and trade dress—requires a nuanced understanding of Korea's multilayered intellectual property framework. This guide provides a comprehensive overview of Korean design rights registration, enforcement, and strategic trade dress protection for international brand owners.
1. The Korean Design Protection Act: Core Framework
The primary statute governing design protection in Korea is the Design Protection Act (디자인보호법, DPA), administered by the Korean Intellectual Property Office (KIPO, 특허청). Enacted in its current form in 2004 and significantly amended in 2014 and 2023, the DPA provides comprehensive protection for the aesthetic features of products.
1.1 Definition of a Registrable Design
Under Article 2 of the DPA, a "design" (디자인) means the shape, pattern, color, or combination thereof of an article that creates an aesthetic impression through the sense of sight. To be registrable, a design must be:
- Industrial applicability: The article must be capable of mass production by industrial means.
- Novelty: The design must not have been publicly known before the filing date (Korea operates a 12-month grace period for the applicant's own disclosures).
- Creativity: The design must not be "easily created" from publicly known designs—Korea's analogue to the non-obviousness requirement.
- Not contrary to public order or morality.
1.2 Types of Design Registration
| Type | Description | Term |
|---|---|---|
| Standard Registration | Full examination; strongest protection | 20 years from registration |
| Divisional Application | Split from parent application for different articles | 20 years from registration |
| Multiple Design Registration | Up to 100 designs in one application (same Locarno class) | 20 years each |
| Secret Design | Design kept secret for up to 3 years after registration; useful for seasonal products | 20 years from registration |
| Part Design | Protects a specific part of an article (introduced 2014) | 20 years from registration |
The 2023 amendments extended the design protection term from 20 years from registration to 20 years, aligning Korea with international practice following the Hague Agreement revisions.
2. The Hague System: International Design Registration
Korea joined the Hague Agreement Concerning the International Registration of Industrial Designs in 2014. Foreign companies can use the Hague System administered by WIPO to seek design protection in Korea simultaneously with other member states through a single international application.
Key practical points for foreign applicants:
- Representation: Foreign applicants are not required to appoint a Korean patent attorney for Hague applications, but local representation is strongly recommended for prosecution and enforcement.
- Deferment: Applicants can defer publication of the international registration by up to 30 months.
- KIPO examination: KIPO performs substantive examination of Hague designations. The examination period is 12 months, with possible extension.
- Refusal rate: KIPO refuses approximately 15–20% of Hague designations in substantive examination, primarily on novelty and creativity grounds.
3. Trade Dress Protection in Korea: The Unfair Competition Prevention and Trade Secret Protection Act
While registered design rights protect specific articles, trade dress—the overall commercial image and appearance of a product or service—is primarily protected under the Unfair Competition Prevention and Trade Secret Protection Act
3.1 Trade Dress as a Form of Unfair Competition
Article 2(1)(a) of the UCPA prohibits use of a mark or container that is "well-known" in Korea and likely to cause confusion with another's goods. Article 2(1)(j) (added in 2013) provides a broader catch-all for misappropriation of another's considerable investment and effort in creating the appearance of goods—Korea's closest analogue to US trade dress protection under the Lanham Act.
Under Article 2(1)(j), a plaintiff must establish:
- The product's appearance (형태) resulted from considerable investment and effort (상당한 투자나 노력).
- The defendant copied the appearance without authorization.
- The copying constitutes free-riding on the plaintiff's efforts (무임승차).
- The appearance has not become the standard shape for the type of product.
Importantly, Article 2(1)(j) does not require proof of consumer confusion, making it a powerful tool for protecting innovative product designs before they have achieved marketplace recognition.
3.2 The Three-Year Sunset Provision
One critical limitation of Article 2(1)(j) protection is that it expires three years after the date of commercialization of the relevant goods. After this period, the product appearance may be freely imitated unless the owner has obtained design registration or the appearance has achieved the distinctiveness necessary for trademark protection under the Trademark Act.
Strategic implication: Foreign companies launching new products in Korea should simultaneously file design registration applications and monitor for competitors copying the design within the critical first three years. Allowing the three-year window to elapse without registration can significantly weaken IP protection.
4. Trademark Protection for Product Appearance
Under Korea's Trademark Act (상표법), product shapes, colors, and combinations can be registered as trademarks if they have acquired distinctiveness (식별력) through use. Korean courts apply a high distinctiveness standard—secondary meaning must be firmly established, typically requiring substantial sales, advertising expenditure, and consumer surveys showing that consumers associate the shape exclusively with a single source.
Notable Korean case law:
- Coca-Cola bottle (Supreme Court 2010 Hu 3073): The iconic Coca-Cola bottle contour shape was found to have acquired distinctiveness in Korea and was registered as a trademark.
- Hershey's Kisses shape: Registered as a three-dimensional trademark after evidence of extensive use and consumer recognition.
- Apple iPhone trade dress: Multiple Samsung-Apple litigations in Korean courts tested the boundaries of trade dress protection for smartphone designs.
5. Enforcement Options
5.1 Civil Enforcement
Design right holders can seek:
- Preliminary injunction (가처분): Courts routinely grant preliminary injunctions in design infringement cases, typically within 2–4 months. The applicant must post a bond.
- Permanent injunction: Available upon final judgment of infringement.
- Damages: Korean courts apply three alternative methods: (1) lost profits of the plaintiff, (2) profits of the infringer, or (3) a reasonable royalty. The DPA provides a statutory damages presumption.
- Destruction of infringing goods: Courts may order destruction of all infringing products and manufacturing equipment.
- Reputational restoration measures: Courts may order the defendant to publish a public apology or correction notice.
5.2 Criminal Enforcement
Design infringement under the DPA is a criminal offense. Penalties include imprisonment up to 7 years or a fine up to KRW 100 million. Criminal complaints can be filed with the police or directly with the prosecutor's office. The Korea Customs Service (KCS) also has authority to seize infringing goods at the border under the Customs Act.
5.3 KIPO Trial Division Proceedings
Foreign companies can challenge invalid design registrations through:
- Invalidation trial (무효심판): Filed before the KIPO Intellectual Property Tribunal. Can be filed at any time while the registration is in force.
- Scope confirmation trial (권리범위확인심판): Seeks a ruling on whether a specific product falls within or outside the scope of a registered design.
6. Strategic Design Protection Framework for Foreign Companies
| Stage | Recommended Action | Legal Basis |
|---|---|---|
| Pre-launch (6–12 months) | File Korean design registration (or Hague designation for Korea) | DPA |
| Pre-launch | Conduct clearance search in KIPO Design Database (KIPRIS) | DPA |
| Launch | Document commercialization date to trigger Article 2(1)(j) protection | UCPA |
| 0–3 years post-launch | Monitor market for copycat designs; send cease-and-desist if needed | UCPA Art. 2(1)(j) |
| Ongoing | Gather evidence of distinctiveness for potential 3D trademark registration | Trademark Act |
| Ongoing | Register Korean customs recordal for border seizure of infringing imports | Customs Act |
| On Infringement | Seek preliminary injunction in Korean courts | DPA / UCPA |
7. Recent Legal Developments (2023–2026)
- 2023 DPA Amendment: Extended design protection from registration date (previously from filing date for some provisions). Expanded the scope of protectable designs to include digital icons and user interface (UI) designs as screen designs (화상디자인).
- UI/UX Design Protection: As of 2023, KIPO accepts applications for "screen designs" (화상디자인) displayed on digital devices, including app icons, animated interface elements, and GUI components. This is a significant expansion for technology companies.
- AI-Generated Designs: KIPO issued guidance in 2024 clarifying that AI-generated designs are registrable if a human made "substantial creative contributions" to the final design. Purely AI-generated designs without human creative input are not registrable.
- Metaverse and Virtual Goods: The UCPA was amended in 2022 to explicitly cover copying of designs in virtual/metaverse environments (Article 2(1)(k)), making Korea one of the first jurisdictions to address virtual goods trade dress.

Frequently Asked Questions (FAQ)
Q1: What is the difference between a Korean design registration and trade dress protection?
A Korean design registration (under the DPA) provides a registered, time-limited exclusive right to an article's specific aesthetic features. Trade dress protection (under the UCPA, particularly Article 2(1)(j)) is unregistered but covers the overall commercial appearance of a product. Design registration provides stronger, more predictable protection; trade dress under Article 2(1)(j) is broader but expires three years after commercialization.
Q2: How long does it take to obtain a Korean design registration?
Standard examination typically takes 6–12 months from the filing date. KIPO offers an accelerated examination (우선심사) program that can reduce this to 2–3 months for designs that are already commercially used or for which an infringement concern exists. Hague System designations for Korea follow a 12-month examination period.
Q3: Can a foreign company protect packaging design and store interior design in Korea?
Yes. Packaging design (product containers and wrapping) is explicitly protectable under the DPA as an "article." Store interior design (trade dress) can be protected under the UCPA's unfair competition provisions if it is distinctive and another operator copies it to cause confusion. KIPO's examination standards for three-dimensional container designs require that the shape be primarily ornamental rather than functional.
Q4: What remedies are available if a Korean competitor copies our product design without authorization?
If you have a registered design right, you can seek: (1) preliminary injunction within 2–4 months; (2) permanent injunction after full trial; (3) damages calculated as lost profits, infringer's profits, or reasonable royalty; (4) criminal complaint. If the design is unregistered but within the UCPA three-year window, you can still seek injunctive relief and damages under Article 2(1)(j). Border seizure through Korean Customs is available for both registered and unregistered designs.
Q5: Are app icons and UI/UX designs protectable in Korea?
Yes, since the 2023 DPA amendment, KIPO accepts applications for "screen designs" (화상디자인)—visual designs displayed on digital device screens, including app icons, animated GUI elements, and interface components. These designs have a 20-year protection term from registration. This is particularly important for foreign technology and platform companies operating in Korea.
Q6: How does the Hague System work for seeking Korean design protection from abroad?
Foreign applicants file a single international application through WIPO designating Korea as a jurisdiction for protection. WIPO transmits the application to KIPO for substantive examination. KIPO has 12 months to issue a refusal; if no refusal is issued, the international registration takes effect in Korea. Local Korean patent attorney representation, while not mandatory for the application stage, is strongly recommended during prosecution and essential for enforcement proceedings.
Q7: What is the three-year sunset provision under Article 2(1)(j) of the UCPA, and how can foreign companies plan around it?
Article 2(1)(j) of the UCPA protects product appearances from copying for three years after the date the goods are first commercially sold in Korea. After this three-year window, protection under this provision lapses. To maintain protection beyond three years, foreign companies should: (1) file a design registration application before or concurrently with product launch; (2) build evidence of acquired distinctiveness (sales figures, advertising, consumer surveys) for a three-dimensional trademark application; (3) use copyright law where the design has sufficient artistic character to qualify as a copyrightable work. A design rights strategy with multiple overlapping layers of protection is ideal.
