Korean AI Basic Act: Compliance Framework for Foreign AI Companies
South Korea enacted its AI Basic Act (인공지능 기본법, Framework Act on Artificial Intelligence) in December 2024, making it one of the first countries in Asia—and among the first worldwide—to establish a comprehensive statutory framework for artificial intelligence regulation. The Act entered into force on January 22, 2026, creating significant new compliance obligations for foreign companies operating AI systems, deploying AI services, or providing AI infrastructure within Korea.
This guide provides a thorough analysis of the AI Basic Act's key provisions, the risk-based regulatory structure, obligations for "high-impact AI" providers, and the practical compliance steps foreign companies must take to lawfully operate in Korea's fast-evolving AI landscape.
1. Background and Legislative Context
The AI Basic Act (officially Act No. 20710) was passed by the National Assembly on December 26, 2024, following years of deliberation. Unlike the EU AI Act, which imposes strict conformity assessment requirements and prohibitions, the Korean framework takes a promotion-first, risk-managed approach—prioritizing AI innovation while establishing safeguards for "high-impact AI" (고영향 AI) and mandating transparency for AI-generated content.
The Ministry of Science and ICT (MSIT, 과학기술정보통신부) is the primary supervisory authority, supported by the newly established National AI Commission (국가인공지능위원회) chaired by the President of Korea. The Act also creates a Presidential AI Committee and an AI Safety Research Institute under KISA (Korea Internet & Security Agency).
2. Scope and Applicability to Foreign Companies
The AI Basic Act applies to any entity that:
- Develops, operates, or provides AI systems to users within Korea, regardless of where the company is incorporated;
- Deploys AI-generated services (AI 서비스) accessible to Korean consumers or businesses;
- Provides AI infrastructure (data centers, cloud AI platforms, API services) used by Korean enterprises.
The extraterritorial principle (역외적용) mirrors the approach of Korea's PIPA and FSCMA: foreign companies with a substantial nexus to the Korean market are subject to full compliance obligations. This means US, EU, and Japanese AI companies serving Korean customers must designate a local representative (국내 대리인) in Korea if they lack a direct legal presence.
3. The Risk-Based Regulatory Structure
The Act establishes three tiers of AI regulation:
Tier 1: General AI Systems (일반 AI)
All AI systems deployed in Korea must comply with baseline transparency obligations: disclosure that users are interacting with an AI, basic documentation of the AI's purpose, and adherence to general data protection standards under PIPA 2024.
Tier 2: High-Impact AI (고영향 AI)
This is the most consequential category for foreign companies. "High-impact AI" is defined as AI systems used in domains where incorrect decisions could materially affect fundamental rights, safety, or significant economic interests. Designated sectors include:
- Employment and HR decisions (hiring, promotion, dismissal)
- Credit scoring and financial services
- Medical diagnosis and healthcare AI
- Public safety and law enforcement AI
- Critical infrastructure management
- Educational assessment and credentialing
Providers of high-impact AI must:
- Conduct and document a pre-deployment risk assessment (사전위험평가);
- Establish an internal AI governance framework including an AI Ethics Committee;
- Maintain detailed technical documentation and audit logs;
- Provide human oversight mechanisms and the right of affected persons to request human review of AI decisions;
- Register the high-impact AI system with MSIT within 30 days of deployment.
Tier 3: Prohibited AI Applications (금지 AI)
The Act prohibits AI systems that:
- Manipulate human subconscious or exploit psychological vulnerabilities;
- Conduct real-time biometric surveillance in public spaces (with limited law enforcement exceptions);
- Predict criminal behavior based solely on protected characteristics;
- Enable mass surveillance contrary to constitutional rights.
4. AI-Generated Content and Deepfake Regulations
A cornerstone of the AI Basic Act is its mandatory labeling of AI-generated content (AI 생성물 표시의무). Any content—text, image, video, audio—created by an AI system and distributed to the public must be clearly labeled as AI-generated. This requirement applies to:
- Social media platforms allowing AI content uploads;
- News aggregators using AI-written articles;
- Marketing and advertising materials generated by AI;
- Political campaign content (subject to enhanced rules under the Public Official Election Act).
Violations carry fines of up to 30 million KRW (approx. USD 22,000) per incident. For systematic violations, administrative penalties and business suspension orders may be imposed.
The Act also cross-references the Act on Special Cases Concerning the Punishment of Sexual Crimes, which since 2023 has prohibited non-consensual deepfake pornography with criminal penalties of up to 5 years' imprisonment.
5. General Purpose AI (GPAI) and Foundation Model Obligations
Companies developing or deploying General Purpose AI models (범용 AI)—large language models (LLMs), multimodal foundation models, or similar general-purpose systems—face enhanced obligations:
- Disclosure of training data provenance (including copyright compliance for training datasets);
- Technical safety evaluations including adversarial testing;
- Publication of capability assessments and limitations in a standardized format;
- Cooperation with the AI Safety Research Institute's evaluations.
This mirrors elements of the EU AI Act's GPAI provisions and places obligations on companies like OpenAI, Google DeepMind, Anthropic, and Korean AI leaders like KakaoAI and NAVER CLOVA, when their models are deployed in Korea.
6. AI Safety and Incident Reporting
The AI Basic Act establishes a formal AI incident reporting framework. Operators of high-impact AI systems must:
- Report "serious AI accidents" (중대 AI 사고) to MSIT within 72 hours of discovery;
- Submit a full incident investigation report within 30 days;
- Cooperate with MSIT and KISA investigations;
- Implement corrective measures and report remediation to MSIT.
"Serious AI accidents" are defined as events causing death, serious physical injury, significant financial harm, or widespread privacy violations resulting from AI system malfunction or misuse.
7. Data Governance and PIPA Integration
The AI Basic Act does not replace PIPA (Personal Information Protection Act) but supplements it for AI-specific contexts. Key intersection points include:
- AI training data: Companies using personal data to train AI models must comply with PIPA's lawful basis requirements (consent or legitimate interest). The 2024 PIPA amendments introduced a new lawful basis of "legitimate interest" specifically to facilitate AI training on responsibly sourced data.
- Automated decisions: Individuals have the right under PIPA Article 37-2 (introduced in 2024) to request explanation of automated decisions and to demand human review. AI Basic Act reinforces this right.
- Data localization: For high-impact AI in sensitive sectors (healthcare, finance, public safety), AI training data involving Korean personal information may be subject to localization requirements.
8. Incentives and the AI Promotion Framework
The Act is not purely regulatory—it also establishes a robust AI promotion framework:
- AI Regulatory Sandbox (AI 규제 샌드박스): Companies can apply to MSIT for temporary exemptions from specific regulations to test innovative AI applications for up to 4 years.
- AI Specialized Zones (AI 특화구역): Designated geographic zones (initially including Songdo, Pangyo) offer relaxed regulatory environments for AI development and testing.
- Government AI Procurement: Public institutions must develop AI adoption plans, creating market opportunities for foreign AI companies with compliant products.
- R&D Tax Incentives: Up to 30% tax credit on AI R&D expenditure for companies meeting certain criteria under the RSTA (Restriction of Special Taxation Act).
9. Enforcement and Penalties
| Violation | Maximum Penalty |
|---|---|
| Deploying prohibited AI applications | Criminal imprisonment up to 3 years or fine up to 30M KRW |
| Failure to register high-impact AI | Administrative fine up to 50M KRW |
| Failure to label AI-generated content | Fine up to 30M KRW per violation |
| Failure to report AI incident (72-hour rule) | Fine up to 20M KRW |
| Obstruction of MSIT investigation | Fine up to 20M KRW |
10. Practical Compliance Checklist for Foreign AI Companies
- Map your AI systems: Catalog all AI models and services accessible in Korea; classify each as general, high-impact, or potentially prohibited.
- Designate a Korean representative: If lacking a Korean legal entity, appoint a local representative per Article 56 of the AI Basic Act.
- Register high-impact AI: Submit registration to MSIT's AI Registration System within 30 days of deployment.
- Conduct pre-deployment risk assessments: Document risk evaluation processes; retain records for at least 5 years.
- Implement AI labeling: Embed AI-generated content labels in your content distribution pipeline.
- Update privacy notices: Align with both PIPA 2024 and AI Basic Act requirements regarding automated decision explanations.
- Establish incident response procedures: Designate an AI incident response team; prepare 72-hour reporting templates.
- Explore sandbox opportunities: If your AI product faces regulatory uncertainty, apply to the AI Regulatory Sandbox for a testing period.

Q3: What is "high-impact AI" and how do I know if my product qualifies?
High-impact AI includes any AI system making or substantially influencing decisions in designated sensitive sectors: employment, credit/finance, healthcare, public safety, critical infrastructure, and educational assessment. If your AI provides recommendations or decisions in any of these domains—even as a supporting tool—you should seek legal advice on whether it meets the statutory threshold and requires registration.
Q4: Are AI chatbots used for customer service considered "high-impact AI"?
Generally, customer service chatbots fall under the general AI tier unless they make credit decisions, employment decisions, or medical assessments. However, if the chatbot handles financial product advice (e.g., loan eligibility) or health information, it may cross into high-impact territory. A fact-specific risk assessment is recommended.
Q5: What are the copyright implications of using Korean-language data to train AI models?
Under Korea's Copyright Act (저작권법), using copyrighted works for AI training without a license may constitute infringement, unless it falls under the text and data mining (TDM) exception. Korea amended its Copyright Act in 2024 to introduce a limited TDM exception, but it requires the training to be non-commercial or to fall within specific permitted purposes. Foreign companies training on Korean data should conduct copyright clearance due diligence.
Q6: Is there an AI Regulatory Sandbox available for foreign companies?
Yes. The AI Basic Act's regulatory sandbox is open to both domestic and foreign companies. An application to MSIT can grant a temporary exemption from specific AI regulations for a period of 2–4 years, allowing real-world testing. Successful sandbox graduates may receive expedited regulatory approval for their AI products.
Q7: What obligations apply to AI-generated marketing content in Korea?
Under the Act, all AI-generated marketing materials must be labeled as AI-generated. Additionally, Korea's Act on Fair Labeling and Advertising (표시광고법) and the Electronic Commerce Act apply. Deceptive AI-generated content (e.g., fake testimonials) can trigger enforcement by the Korea Fair Trade Commission (KFTC).

2. Aplicación Extraterritorial a Empresas Extranjeras
7. Incentivos y Caja de Arena Regulatoria
- Caja de arena regulatoria de IA: posibilidad de solicitar exenciones temporales de hasta 4 años;
- Zonas especializadas en IA: entornos regulatorios más flexibles en Songdo y Pangyo;
- Incentivos fiscales a la I+D: deducción de hasta el 30% del gasto en I+D en IA.
8. Sanciones por Incumplimiento
| Infracción | Sanción Máxima |
|---|---|
