Personal Insolvency and Individual Rehabilitation in Korea: A Complete Guide for Foreign Debtors and Creditors

South Korea has a well-developed and modern personal insolvency framework that allows individuals who are unable to repay their debts to seek judicial relief through two primary mechanisms: Individual Rehabilitation (개인회생, Gaein Hoesaeng) and Personal Bankruptcy (개인파산, Gaein Pasan). Both procedures are governed by the Debtor Rehabilitation and Bankruptcy Act (채무자 회생 및 파산에 관한 법률, DRBA), which was comprehensively revised in 2006 and has been further updated through 2023 amendments. For foreign nationals residing in Korea, foreign creditors with Korean-domiciled debtors, and foreign businesses engaged in consumer lending, understanding this framework is essential.

This guide explains the eligibility criteria, procedural steps, discharge consequences, and strategic considerations for personal insolvency in Korea.

1. Overview of Korea's Personal Insolvency Framework

Korea's personal insolvency system is administered exclusively by the courts. There is no out-of-court personal insolvency filing mechanism equivalent to some U.S. or EU administrative procedures. Debtors must file with the competent District Court (지방법원), and the process is overseen by a court-appointed trustee or, in simpler cases, directly by the court.

Two key procedures exist:

FeatureIndividual Rehabilitation (개인회생)Personal Bankruptcy (개인파산)
EligibilityWage earners and small business owners with regular incomeAnyone unable to repay debts
Debt CapSecured debts ≤ KRW 1.5 billion; Unsecured debts ≤ KRW 1 billion (2023)No debt ceiling
Income RequirementMust have regular incomeNone
OutcomeDebt repayment plan over 3–5 years; remainder dischargedLiquidation of assets; debts discharged
Asset ProtectionExempt assets retained; non-exempt assets contribute to planNon-exempt assets liquidated
Discharge Timeline3–5 years (if plan completed)Typically 1–2 years from filing

2. Individual Rehabilitation (개인회생)

2.1 Eligibility

To file for Individual Rehabilitation, the debtor must:

  • Have regular income (salary, business income, pension, rental income, etc.).
  • Have total secured debt ≤ KRW 1.5 billion and total unsecured debt ≤ KRW 1 billion.
  • Be insolvent — unable to repay debts as they fall due — or have debts that will make it impossible to repay obligations in the future.
  • Not be in a pending corporate rehabilitation or bankruptcy proceeding.

Foreign nationals domiciled in Korea (holding valid visas and habitually residing in Korea) are eligible to file. The court may also accept filings from foreign nationals with significant assets or liabilities in Korea.

2.2 Repayment Plan

Upon filing, the debtor must propose a 3-to-5-year repayment plan. The plan must allocate the debtor's "disposable income" (총처분가능소득) — income above a court-determined minimum living standard — toward creditor repayment. Creditors cannot vote on the plan; the court confirms it if it is "feasible" and meets minimum statutory requirements. Upon successful completion of the plan, the remaining balance of unsecured debts is discharged.

2.3 Automatic Stay

Upon filing an Individual Rehabilitation petition, an automatic stay (포괄적 금지명령) is imposed within approximately 2 weeks of filing. The stay prevents creditors from initiating or continuing collection actions, enforcement proceedings, or attachment of the debtor's assets.

3. Personal Bankruptcy (개인파산)

3.1 Eligibility

Personal Bankruptcy is available to any individual — regardless of income level or nationality — who is unable to pay their debts. There is no maximum debt ceiling. Common filers include debtors with irregular income who do not qualify for Individual Rehabilitation, and those with high debt levels relative to their assets.

3.2 Liquidation Process

Upon the court's declaration of bankruptcy:

  • A court-appointed trustee (파산관재인) takes control of and liquidates the debtor's non-exempt assets.
  • Exempt assets (기본재산) — including certain personal property and a minimum amount of income — are protected and returned to the debtor.
  • Proceeds from liquidation are distributed to creditors in a legally determined priority order.

3.3 Discharge (면책)

After the bankruptcy proceeding concludes (typically 1–2 years), the debtor applies for a discharge (면책 결정). If granted, the debtor is legally released from all dischargeable debts. Non-dischargeable debts under Korean law include:

  • Debts arising from fraud, willful misconduct, or gross negligence.
  • Tax obligations and social insurance contributions.
  • Child support and alimony obligations.
  • Fines and penalties imposed by courts or regulatory authorities.
  • Debts incurred within 1 year of filing where the debtor knew of insolvency (presumptive fraud).

4. Consequences of Insolvency for Foreign Nationals in Korea

4.1 Visa and Residence Status

Korean insolvency proceedings do not automatically affect a foreign national's visa status. However, the Korea Immigration Service may consider patterns of financial misconduct in visa renewal decisions, particularly for business or investment visas. Foreign nationals undergoing insolvency should consult immigration counsel alongside insolvency counsel.

4.2 Effect on Business Activities

A debtor undergoing Personal Bankruptcy is restricted from acting as a director of a Korean company during the proceedings and until discharge. Individual Rehabilitation does not carry the same restriction, making it preferable for business-active debtors.

4.3 Credit Reporting

Korean credit bureaus (NICE and KCB) record insolvency filings. Individual Rehabilitation filings are reported for up to 5 years from discharge; Bankruptcy filings remain for up to 7–10 years. This affects the debtor's ability to obtain loans, credit cards, and even certain employment in Korea.

5. Foreign Creditors with Korean-Domiciled Debtors

5.1 Automatic Stay Implications

Foreign creditors with claims against a Korean debtor in insolvency proceedings are subject to the Korean court's automatic stay. Cross-border debt collection actions initiated abroad may not be recognized or enforced in Korea if the Korean insolvency court issues a stay. Foreign creditors should promptly file claims in the Korean proceeding to protect their position.

5.2 Priority of Claims

In Korean insolvency proceedings, secured creditors have priority over the assets securing their claims. Among unsecured creditors, priority generally follows: labor claims (wages and severance), tax claims, then general unsecured claims. Foreign creditors are treated equally to Korean creditors of the same class (no discrimination based on nationality under DRBA Article 638).

5.3 Recognition of Foreign Insolvency Proceedings

Korea is not yet a signatory to the UNCITRAL Model Law on Cross-Border Insolvency (though academic and legislative discussion continues). However, Korean courts have, on a case-by-case basis, granted recognition and assistance to foreign insolvency proceedings under their general international private law principles. Foreign insolvency administrators seeking to enforce in Korea should apply for recognition at the Seoul Bankruptcy Court.

6. Practical Advice for Foreign Debtors

  1. If you are a foreign national with significant debt in Korea, assess whether your income and debt levels qualify for Individual Rehabilitation before considering Bankruptcy.
  2. File as soon as possible after recognizing insolvency — delaying filing while continuing to incur debt may constitute presumptive fraud and prevent discharge.
  3. Engage a Korean insolvency lawyer to prepare the petition, financial disclosures, and repayment plan accurately — errors cause delays and plan rejections.
  4. Disclose all assets and liabilities fully — concealment of assets is a criminal offense in Korea (파산범죄) and will result in denial of discharge.
  5. Attend all court hearings (기일) — non-attendance may result in dismissal of the petition.

Frequently Asked Questions (FAQ)

Q1: Can a foreigner file for Individual Rehabilitation in Korea?

Yes. Foreign nationals who are habitually domiciled in Korea (holding a valid visa and having their primary residence in Korea) are eligible to file. The courts generally look at the debtor's center of life — where they live, work, and have their primary financial obligations.

Q2: What happens to my debts in other countries if I file for insolvency in Korea?

Korean insolvency proceedings have limited extraterritorial effect. A Korean discharge order releases you from debts under Korean jurisdiction, but foreign creditors may still pursue collection in their own countries unless their home country recognizes the Korean discharge. Cross-border insolvency cases require careful multi-jurisdictional planning.

Q3: Will my employer be notified if I file for Individual Rehabilitation?

The court does not routinely notify employers. However, if your employer is a creditor, they will receive notice. The court may also require documentation of employment income. Individual Rehabilitation is not publicly announced in the same way as corporate rehabilitation proceedings, so there is relatively limited risk of employer notification for wage-earner debtors.

Q4: Can I keep my apartment if I file for bankruptcy in Korea?

This depends on the type of tenancy. If you are renting under a jeonse (전세) lease and have a registered jeonse deposit claim, that deposit is a secured claim and subject to complex priority issues with the landlord's mortgage creditors. Under Personal Bankruptcy, non-exempt assets are liquidated. The court determines exemptions on a case-by-case basis based on the debtor's household needs.

Q5: How long does an Individual Rehabilitation plan take to complete?

The standard repayment plan is 3 years for wage earners and up to 5 years for self-employed debtors. If the debtor maintains payments faithfully, the court will issue a discharge order at the end of the plan period, releasing the debtor from the remaining unsecured debt balance.

Q6: What is the difference between a Korean insolvency and a US Chapter 7 or Chapter 13 bankruptcy?

Individual Rehabilitation is broadly analogous to US Chapter 13 (repayment plan for individuals with income). Personal Bankruptcy is analogous to US Chapter 7 (liquidation). Key differences: Korean proceedings are exclusively court-supervised (no administrative filing); the debt ceilings for Individual Rehabilitation are specific; and Korean discharge law has different carve-outs from the US system. Korean proceedings tend to take longer but offer the same fundamental debt relief.

Q7: Are there alternatives to formal insolvency in Korea for individuals?

Yes. The Credit Counseling and Recovery Service (신용회복위원회, CCRS) offers a pre-court debt adjustment program called the "Rapid Recovery Program" (신속채무조정) and a "Voluntary Debt Adjustment" (자율조정 프리워크아웃) program. These are out-of-court settlements where creditors (primarily financial institutions) agree to reduce interest rates and extend repayment terms. CCRS programs are faster and less stigmatizing than court proceedings, but require creditor consent and cover fewer debt types than court insolvency proceedings.

KRW; No garantizada ≤ 1.000 mill.
