Korean Succession Tax Planning for High-Net-Worth Foreign Individuals: A Practical Legal Guide
South Korea imposes one of the highest inheritance and gift tax rates in the world — up to 50% on estates exceeding KRW 3 billion (approximately USD 2.25 million), with a maximum effective rate of 60% when the premium surcharge for controlling shareholders applies. For high-net-worth foreign individuals with assets in Korea — whether real estate, business stakes, financial investments, or intellectual property rights — understanding and proactively planning for Korean succession taxes is not optional; it is a financial imperative.
This guide examines the Korean inheritance tax (상속세) and gift tax (증여세) framework under the Inheritance and Gift Tax Act (IGTA, 상속세 및 증여세법), explores key planning strategies, and addresses the specific challenges faced by foreign nationals and cross-border estate situations.
1. The Korean Inheritance Tax Framework
1.1 Who Is Subject to Korean Inheritance Tax?
Korean inheritance tax applies based on the domicile (주소) and habitual residence of the decedent and, in some circumstances, the heirs:
- Korean residents (거주자): All worldwide assets of the decedent are subject to Korean inheritance tax, regardless of where assets are located.
- Korean non-residents (비거주자): Only Korean-situs assets (assets located in Korea) are subject to Korean inheritance tax.
- Foreign heirs: A foreign heir receiving Korean-situs assets from a non-resident decedent is subject to Korean inheritance tax on those Korean assets.
Residency is determined under IGTA Article 2, referencing the National Tax Act's domicile concept. A foreign national present in Korea for 183 or more days in a given year, or with a Korean "domicile" (defined as the center of one's life activities), may be classified as a Korean resident for tax purposes — triggering worldwide estate taxation.
1.2 Inheritance Tax Rates and Brackets
| Taxable Inheritance Amount | Tax Rate | Deduction |
|---|---|---|
| Up to KRW 100 million | 10% | — |
| KRW 100M – 500M | 20% | KRW 10M |
| KRW 500M – 1 billion | 30% | KRW 60M |
| KRW 1B – 3 billion | 40% | KRW 160M |
| Over KRW 3 billion | 50% | KRW 460M |
Largest Shareholder Premium: Where the decedent held 20% or more of shares in an unlisted company (or 10%+ in a listed company), the inheritance value of those shares is increased by 20% (effectively raising the applicable marginal rate to 60%).
1.3 Key Deductions and Exemptions
The IGTA provides several statutory deductions that significantly reduce the taxable estate:
- Basic deduction (기초공제): KRW 200 million (flat)
- Person-specific deduction (인적공제): Deductions for spouse (up to KRW 3 billion minimum KRW 500M), minor children (KRW 50M each), elderly dependents, and disabled persons
- Aggregate unified deduction (일괄공제): KRW 500 million, available instead of itemized personal deductions when more favorable
- Financial assets deduction (금융재산 상속공제): 20% of net financial assets (up to KRW 2 billion)
- Family business (가업상속공제): Up to KRW 60 billion deduction for heirs who continue to operate a qualifying family business for 5–7+ years
- Funeral expenses: Up to KRW 15 million
- Public interest deductions: Donations to qualifying public interest organizations are fully deducted
2. Korean Gift Tax Framework
The gift tax (증여세) applies to gratuitous transfers of property. It closely mirrors the inheritance tax structure:
- Same progressive rate schedule (10% to 50%)
- Annual exclusion (증여재산 공제): KRW 60 million from spouses (every 10 years), KRW 50 million from direct lineal ascendants to adult children (every 10 years), KRW 30 million to adult children from lineal ascendants (every 10 years), KRW 10 million from other relatives
- Gifts within 10 years of death are aggregated into the taxable estate (gift clawback)
For foreign nationals: Gift tax applies when the recipient is a Korean resident (worldwide gifted assets) or when Korean-situs property is gifted to a non-resident.
3. Valuation Rules for Korean Assets
3.1 Real Property Valuation
Korean real estate is generally valued at the "standard market value" (공시가격), which is typically 60–80% of actual market value. However, in practice, the National Tax Service (NTS) can assess at actual transaction values or appraised values when public announced values deviate significantly.
3.2 Unlisted Company Share Valuation
Unlisted company shares (비상장주식) are valued using a combination of: (a) net asset value (순자산가치), and (b) earnings-based value (순손익가치), with the weighted formula of 2:3 (assets:earnings) under IGTA enforcement ordinances. This methodology can produce significant tax liabilities for founders of profitable private companies.
3.3 Financial Assets and Foreign Assets
Foreign assets held by Korean residents are included at current market value converted at the applicable exchange rate (기준환율) on the date of death.
4. Key Planning Strategies for Foreign High-Net-Worth Individuals
4.1 Pre-Departure Planning: Becoming a Non-Resident
A foreign national contemplating departure from Korea should plan their departure to ensure non-resident status for Korean inheritance tax purposes. Key steps:
- Clear departure registration (출국신고)
- Termination of Korean "domicile" by transferring the center of life activities abroad
- Minimum presence of fewer than 183 days per year in Korea after departure
- Note: Even as a non-resident, Korean-situs real property, business stakes, and financial assets remain subject to Korean inheritance tax
4.2 Lifetime Gifting Strategy
Systematic lifetime gifts utilizing the 10-year rolling gift exclusions can significantly reduce future estate tax. A married couple with adult children can transfer up to KRW 120 million (KRW 50M + 50M from each parent + KRW 20M from other relatives) per child per 10-year period gift-tax-free. For larger transfers, early-stage gifting is preferable since future asset appreciation accrues to the heir's estate rather than the decedent's.
4.3 Family Business Succession Planning (가업상속공제)
For foreign nationals who own Korean businesses, the family business inheritance deduction (가업상속공제) is one of the most powerful tax planning tools. Requirements include:
- Decedent held the business for 10+ years
- Heir continues operating the business for 5 years (reduced from 7 years post-2023 reform)
- Heir maintains employment levels and asset requirements
- Deduction up to KRW 60 billion (effective 2024)
4.4 Trust and Holding Company Structures
Korean law permits the establishment of domestic trusts (신탁) under the Trust Act (신탁법). Key estate planning uses include:
- Testamentary trusts (유언신탁) — assets transferred by will to a trust for beneficiaries' benefit
- Inter vivos trusts (생전신탁) — asset protection and succession planning during the settlor's lifetime
- Family holding companies — structuring Korean business assets through a holding company to enable systematic share gifting and succession
4.5 Korean-Foreign Tax Treaty Coordination
Korea has concluded estate tax treaties with a limited number of countries. The US-Korea estate tax treaty (1979) is one of the few bilateral instruments that provides for estate tax credit coordination. For other countries, domestic unilateral foreign tax credit rules under IGTA Article 29 may apply to avoid double taxation on foreign assets of Korean residents.
| Country | Estate/Inheritance Tax Treaty with Korea? | Key Benefit |
|---|---|---|
| United States | Yes (1979) | Tax credit for US estate tax paid |
| Germany | No | Unilateral foreign tax credit only |
| Japan | No | Unilateral foreign tax credit only |
| UK | No | Unilateral foreign tax credit only |
| France | No | Unilateral foreign tax credit only |
5. Estate Administration in Korea: Filing Requirements
Korean inheritance tax must be filed and paid within 6 months from the last day of the month in which the decedent died (Article 67, IGTA). For non-resident decedents whose heirs are Korean residents, the same 6-month period applies. For non-resident heirs with Korean-situs assets, the period is 9 months.
Filing is made with the appropriate Tax Office (세무서) based on the decedent's last Korean domicile or, for non-residents, the location of the Korean assets. Penalties for late filing include a 20% surcharge on unpaid tax plus 0.025% daily interest.
6. Recent Developments and the 2023–2024 IGTA Amendments
The Korean government's 2023 tax reform package introduced several significant IGTA changes effective from 2024:
- Family business deduction ceiling raised from KRW 30 billion to KRW 60 billion
- Post-succession business operation requirement reduced from 7 to 5 years
- Enhanced deductions for succession of agricultural land and fishing businesses
- Introduction of "inheritance of employment" protection requirements (고용승계) to qualify for the 60-billion deduction
- Gift tax anti-avoidance provisions strengthened for indirect gifts through listed company transactions

Frequently Asked Questions (FAQ)
Q1: Is a foreign national living in Korea subject to Korean inheritance tax on their worldwide assets?
Yes, if the foreign national qualifies as a Korean "resident" (거주자) under the IGTA — meaning they have a Korean domicile or spent 183+ days in Korea in any calendar year — their worldwide assets are subject to Korean inheritance tax. This is one of the most critical tax considerations for long-term foreign expatriates in Korea, particularly those with substantial foreign-country assets.
Q2: What Korean assets of a non-resident decedent are subject to Korean inheritance tax?
Korean-situs assets subject to inheritance tax include: Korean real property and rights thereto; shares in Korean corporations or investment funds; bank deposits and financial accounts held at Korean institutions; loans receivable from Korean borrowers; Korean intellectual property rights; and mining rights, fishing rights, and other Korean property rights. Foreign nationals who have divested Korean-situs assets before death (subject to anti-abuse rules) can reduce Korean inheritance tax exposure.
Q3: How does the family business deduction work for a foreign-owned Korean company?
A foreign national who has owned and operated a Korean company for 10+ years may qualify for the family business inheritance deduction (가업상속공제) if: (a) the heir is a Korean resident; (b) the business meets the SME/mid-size company criteria; and (c) the heir continues to operate the business for 5 years, maintaining employment levels. The 2024 reform raised the maximum deduction to KRW 60 billion, making this one of the most valuable tax planning tools for business owners.
Q4: Can a foreign will govern the distribution of Korean assets?
Yes, Korean law respects foreign wills for the disposition of Korean assets, provided the will is valid under the law of the decedent's domicile or nationality (Article 50, Act on Private International Law / 국제사법). However, Korean-resident compulsory heirship (유류분) rights may override will provisions, entitling statutory heirs to a minimum share regardless of the will's terms. Legal advice on both Korean succession law and relevant foreign law is strongly recommended.
Q5: What are the gift tax implications of transferring Korean real estate to foreign children?
Gifting Korean real estate to children (whether resident or non-resident) triggers Korean gift tax. The tax base is the property's assessed value (공시가격 or market value if higher). The KRW 50 million direct-lineal-ascendant 10-year exclusion applies per child. For high-value properties, a staggered gifting strategy or sale-leaseback arrangement may be more tax-efficient than outright gift.
Q6: How does Korea treat assets held in foreign trusts?
Korea's gift tax anti-avoidance provisions treat assets in foreign trusts as taxable in the hands of the beneficial owner (수익자) upon receipt of trust benefits. In 2023, the NTS issued guidance (예규) providing that Korean-resident beneficiaries of foreign trusts receiving distributions are subject to gift tax at the time of distribution. Proper structuring of foreign trusts to minimize Korean tax exposure requires careful legal and tax advice.
Q7: What is the inheritance tax treatment of Korean pension and retirement accounts?
Lump-sum withdrawals from Korean retirement accounts (퇴직연금) at or after death are treated as taxable estate. Individual Retirement Pension (IRP) and Defined Contribution (DC) plan assets are included in the decedent's estate for inheritance tax purposes. However, annuity benefits paid to survivors from retirement plans are subject to income tax rather than inheritance tax, offering a tax-efficient succession tool for high-net-worth planning.
