Korea–EU and Korea–US Free Trade Agreement: Practical Compliance for Importers and Exporters
South Korea is party to some of the most comprehensive free trade agreements in the world, including the Korea–United States Free Trade Agreement (KORUS FTA, effective 2012) and the Korea–European Union Free Trade Agreement (Korea–EU FTA, provisionally applied from 2011, fully effective from 2015). Together, these two FTAs cover Korea's largest trading partners and offer substantial tariff reductions — but only to businesses that properly comply with the rules of origin, certification requirements, and customs procedures embedded in each agreement.
This guide provides practical compliance guidance for importers and exporters operating under the KORUS FTA and Korea–EU FTA, covering rules of origin, preferential tariff claims, certificates and declarations, customs audits, and dispute resolution.
1. Overview: Korea's Key FTA Partners and Trade Volume
| FTA Partner | Effective Date | Korea's Export Share (2024) | Key Sectors |
|---|---|---|---|
| United States (KORUS) | March 15, 2012 | ~18% | Automobiles, semiconductors, machinery, chemicals |
| European Union (Korea–EU FTA) | July 1, 2011 (provisional) | ~12% | Automobiles, machinery, electronics, pharmaceuticals |
Both FTAs follow a similar legal architecture but differ significantly in their rules of origin methodologies, certification systems, and dispute resolution mechanisms. Failure to comply can result in preferential tariff claims being denied, customs duties being retroactively imposed with penalties, and even criminal liability for fraudulent origin declarations.
2. Rules of Origin: The Core Compliance Challenge
Preferential tariff treatment under any FTA is contingent on the goods being "originating" — i.e., meeting the FTA's specific rules of origin (RoO). Both KORUS and Korea–EU FTA use a combination of criteria:
2.1 Wholly Obtained Criterion (WO)
Goods entirely produced in Korea (or the FTA partner country) from local materials qualify as originating without further analysis. This applies primarily to agricultural products, minerals, and basic manufactures.
2.2 Substantial Transformation Criterion
For manufactured goods, the key criterion is whether sufficient processing occurred in Korea. Both FTAs use two methods:
- Change in Tariff Classification (CTC): Non-originating inputs must undergo a change in HS tariff heading (typically at the 4-digit HS chapter or heading level) through Korean manufacturing processes.
- Regional Value Content (RVC): A minimum percentage of the good's value must be derived from Korean-origin materials and processing. KORUS generally requires 35–55% RVC depending on the method used (build-up or build-down).
- Specific Process Rules (SP): Certain sectors (e.g., textiles, chemicals) have product-specific rules requiring specific manufacturing processes regardless of tariff classification changes.
2.3 Cumulation Provisions
Both FTAs contain cumulation provisions allowing producers to treat inputs from the FTA partner country as originating. Under KORUS, materials sourced from the US can be treated as Korean-origin when incorporated into Korean goods destined for US export. Under Korea–EU FTA, inputs from EU member states count as Korean-originating, and vice versa.
3. KORUS FTA: Key Compliance Requirements
3.1 Certificate of Origin vs. Origin Certification Statement
Under KORUS, there is no mandatory government-issued certificate of origin. Instead, the FTA uses a self-certification system. Exporters must prepare an Origin Certification Statement (원산지증명서 자율발급) — a written declaration included in a commercial document (invoice, packing list, etc.) attesting that the goods meet KORUS origin rules.
The declaration must contain: the exporter's name and contact information; a description of the goods with HS tariff classification; a statement that the goods qualify under KORUS; and the exporter's signature. It is valid for 4 years from issuance.
3.2 Record-Keeping Requirements
Exporters must retain origin-supporting documentation for at least 5 years under the Customs Act (관세법) and KORUS implementation regulations. This includes:
- Bills of materials (BOM) showing the origin of all inputs
- Supplier declarations from upstream input providers
- Production records, cost accounting data, and quality control documentation
- Copies of all origin certification statements issued
3.3 Automotive Sector: Special KORUS Rules
KORUS has particularly complex rules for automobiles and auto parts — Korea's largest export category to the US. Key requirements:
- Passenger vehicles require 35% net cost RVC with a 10% super-regional value content from North America or Korea
- Auto parts have tiered RVC requirements (45–62.5% depending on part type)
- Light trucks had a phase-out tariff schedule extending to 2021, now fully eliminated
4. Korea–EU FTA: Key Compliance Requirements
4.1 Registered Exporter (REX) System
The Korea–EU FTA introduced a significant procedural change in 2017: the transition to the Registered Exporter (REX) system for claiming preferential tariffs on exports exceeding EUR 6,000 in value. Under REX:
- Korean exporters must register with the Korea Customs Service (KCS) to obtain a REX number
- Once registered, exporters complete a Statement on Origin on commercial documents (invoice, delivery note, etc.)
- For shipments under EUR 6,000, any exporter can self-certify without REX registration
- The REX number must appear on origin declarations
4.2 Origin Protocols Under Korea–EU FTA
The Korea–EU FTA includes Protocol 1 on the Definition of "Originating Products" and Methods of Administrative Cooperation. Key features:
- Product-specific rules (PSR): Annex II to Protocol 1 contains HS-based product-specific rules that must be consulted for each exported product
- Verification requests: EU customs authorities may request KCS to verify the origin of Korean exports; KCS must respond within 6 months
- Administrative cooperation: KCS and EU customs authorities have reciprocal verification and information-sharing obligations
4.3 Automotive Sector Under Korea–EU FTA
The Korea–EU FTA contains a "snapback" mechanism for automobiles. If Korean auto imports into the EU exceed defined safeguard thresholds, additional tariffs may be imposed under a bilateral safeguard clause. This mechanism has not been triggered as of 2025 but remains a compliance monitoring obligation for Korean automakers exporting to Europe.
5. Import-Side Compliance: Claiming Preferential Tariffs in Korea
Korean importers claiming preferential tariffs under KORUS or Korea–EU FTA must:
- Obtain and verify origin evidence: Certificate of origin (Form CO or self-certification) from the foreign exporter
- File customs declaration: Declare the preferential tariff claim in the import declaration form at Korean Customs (KCS)
- Post-clearance verification: KCS may conduct post-clearance audits within 2 years (extendable to 5 years for fraud) to verify origin claims
- Retroactive correction: If origin cannot be proved, customs duty shortfall plus penalties (10–40% surcharge) and interest are assessed
The Korea Customs Service offers a Tariff Ruling System (품목분류사전심사) allowing importers to obtain binding pre-import rulings on HS classification and FTA origin eligibility.
6. Common Compliance Pitfalls and Audit Triggers
| Compliance Risk | Description | Consequence |
|---|---|---|
| Incorrect HS Classification | Misclassification of goods affects both tariff rate and RoO determination | Duty shortfall + penalty up to 40%; potential criminal referral |
| Insufficient RVC | Third-country inputs exceed permitted thresholds | Origin claim denial; retroactive duty assessment |
| Missing Supplier Declarations | Unable to prove origin of upstream inputs | Origin certification invalid; duty shortfall |
| Expired Origin Certification | Using origin statements beyond the 4-year validity | Preferential treatment denied; back-duties assessed |
| Inadequate Record Retention | BOM, cost data, supplier declarations not retained for 5 years | Audit failure; potential customs fraud charges |
| Non-REX Exports (EU) Exceeding EUR 6,000 | Exporter without REX making origin declarations on high-value shipments | Preferential tariff denied by EU customs |
7. Dispute Resolution Under KORUS and Korea–EU FTA
Both FTAs contain government-to-government dispute resolution mechanisms:
- Consultation Phase: Parties must consult within 30 days of a request to resolve the dispute amicably
- Arbitration Panel: If consultations fail, an arbitration panel of 3 members is constituted; proceedings take 120–150 days
- Non-Compliance Measures: If a party fails to comply with panel findings, the prevailing party may suspend equivalent FTA concessions (retaliation)
For company-level disputes with Korean customs authorities, the available remedies are: (1) objection to the head of the customs office; (2) administrative appeal to the Tax Tribunal; (3) administrative litigation in the administrative court; and (4) Tax Court proceedings. The statute of limitations for customs duty disputes is 2 years from assessment date.
8. Practical Compliance Checklist for Korean Exporters
- ✅ Verify HS tariff classification for all exported goods with binding advance ruling if uncertain
- ✅ Map production process to identify all non-originating inputs and their origin
- ✅ Calculate RVC using the applicable method (build-up / build-down / net cost) and confirm threshold is met
- ✅ Collect long-term supplier declarations from all input providers
- ✅ Register for REX (for EU exports of EUR 6,000+)
- ✅ Issue origin certification statement / statement on origin on commercial invoice
- ✅ Maintain all documentation for 5 years minimum
- ✅ Conduct internal compliance audit annually before customs audit risk materializes
- ✅ Train staff on FTA origin management — especially procurement and accounting teams
- ✅ Obtain professional legal advice when supply chain changes may affect origin qualification

Frequently Asked Questions (FAQ)
Q1: Does Korea have both KORUS and Korea–EU FTA benefits that can be claimed simultaneously?
A single shipment can only claim preferential tariffs under one FTA at a time (the FTA applicable in the destination country). However, a Korean exporter can use cumulation under both FTAs — for instance, using EU-origin inputs for goods exported to the US under KORUS, and using US-origin inputs for goods exported to the EU under Korea–EU FTA — as long as each FTA's cumulation rules are independently satisfied.
Q2: What is the penalty for fraudulent FTA origin claims in Korea?
Under the Customs Act (관세법) Articles 270–275, fraudulent origin certification to obtain preferential tariff treatment is a criminal offense. Penalties include: (a) up to 3 years imprisonment and KRW 30 million fine for origin fraud; (b) administrative surcharges of 40% of the evaded customs duty; (c) retroactive assessment of all underpaid duties for 5 years. Corporate officers may be personally liable in addition to the corporate penalty.
Q3: How does Korean customs verify FTA origin claims?
The Korea Customs Service conducts origin verification through: (a) document review requests (within 30 days of import); (b) factory visits and production process audits; and (c) requests to the exporting country's customs authority for cross-verification. KCS uses risk-based selection criteria identifying high-risk importers based on import history, industry type, and claim patterns. The post-clearance audit window is 2–5 years from import date.
Q4: We source components from China — can our Korean assembly still qualify as originating under KORUS?
Yes, provided the Korean manufacturing process creates sufficient transformation to meet KORUS rules of origin. Chinese inputs are non-originating, but if the Change in Tariff Classification (CTC) or Regional Value Content (RVC) threshold is met through Korean processing, the final product qualifies. For automotive parts especially, this requires careful BOM analysis and cost accounting. We strongly recommend a professional FTA origin analysis before filing origin declarations on goods with significant Chinese content.
Q5: What is the difference between an FTA Certificate of Origin and a regular commercial invoice?
A regular commercial invoice describes the goods and transaction for general customs purposes (value, HS code, seller/buyer info). An FTA origin certification (whether a formal certificate or an invoice self-declaration) specifically attests to the origin of the goods under the applicable FTA's rules and is the legal basis for claiming preferential tariff treatment. Without a valid origin certification, the importer cannot claim the FTA preferential rate and must pay MFN (Most Favored Nation) tariff rates.
Q6: Can we use a single supplier declaration to cover all shipments for one year?
Yes. Korean customs regulations permit "long-term supplier declarations" covering a specific product over a period not exceeding 12 months, provided the production process and input sourcing remain unchanged. This is strongly recommended to reduce administrative burden in high-volume trade relationships. However, the supplier must immediately update the declaration if the production process or input origins change materially.
Q7: Are there FTA origin rules specifically for digital goods and software?
Both KORUS and Korea–EU FTA primarily address physical goods. Digital goods (software, digital content, electronic transmissions) are generally addressed under the electronic commerce chapters rather than origin rules. However, as AI-generated products and cloud services increasingly blur the line between goods and services, Korean customs authorities have started issuing guidance on HS classification for digital products. This area remains legally unsettled and requires ongoing monitoring.

KORUS通常要求35-55%的RVC(视具体方法而定)

韓米FTA(KORUS FTA、2012年発効)と韓EU FTA(2011年暫定適用、2015年正式発効)は韓国の最大貿易相手国をカバーし、大幅な関税削減を提供しています。
3. KORUS FTA:
