Age Discrimination and Mandatory Retirement Law in Korea: A Compliance Guide for Foreign Employers
Korea's Act on Prohibition of Age Discrimination in Employment and Elderly Employment Promotion (고용상 연령차별금지 및 고령자고용촉진에 관한 법률, hereinafter "APDEA"), first enacted in 2008 and significantly amended over the years, establishes a comprehensive framework prohibiting age-based discrimination in recruitment, employment conditions, training, and dismissal. Simultaneously, Korea's labor law regime imposes a statutory minimum retirement age of 60, complicating workforce management decisions for foreign employers who may be accustomed to different retirement frameworks in their home countries.
This guide explains the key provisions of APDEA and the mandatory retirement age law, practical compliance obligations for foreign-invested companies, enforcement trends, and answers to the most frequently asked questions by international HR managers operating in Korea.
1. Legislative Background
Korea's workforce is aging rapidly. By 2025, approximately 20% of the Korean population was projected to be 65 or older — a "super-aged society" threshold. In response, the Korean government has pursued a dual strategy: prohibiting age discrimination to enable older workers to continue working, while also mandating a minimum retirement age that prevents employers from forcing workers out before age 60.
APDEA was introduced to align with this policy direction and to fulfill Korea's obligations under international labor standards. The mandatory retirement age provision (Article 19 of APDEA) was strengthened in 2016 when the minimum legal retirement age was raised from 55 to 60, with full enforcement applicable to all private-sector employers.
2. Scope of Application
APDEA applies to:
- All employers in Korea regardless of size, nationality of ownership, or industry
- Decisions regarding recruitment, hiring, job assignment, promotion, compensation, training, retirement, and dismissal
- Both regular employees and fixed-term/part-time workers
Foreign-invested companies operating in Korea — including subsidiaries, branches, and representative offices — are fully subject to APDEA. A Korean labor court will not honor an employment contract term that purports to establish a retirement age below 60, even if the foreign parent company's policy permits earlier retirement.
3. Prohibition of Age Discrimination
3-1. Protected Age Groups
APDEA prohibits age discrimination against workers who are 18 years of age or older. Unlike many Western jurisdictions (e.g., the U.S. ADEA which primarily protects workers 40+), Korea's law applies across all age groups, though enforcement tends to focus on older worker protections.
3-2. Prohibited Acts
Employers are prohibited from using age as a basis for:
- Setting age limits or age preferences in job postings and recruitment advertisements
- Refusing to hire, or imposing disadvantageous conditions, based on age
- Differential treatment in wages, working hours, or working conditions based on age
- Age-based exclusion from training programs or educational opportunities
- Forced retirement or dismissal based on age (other than the mandatory retirement age of 60)
3-3. Permitted Age-Based Distinctions
APDEA permits age-based distinctions in limited circumstances:
- Where age is a genuine occupational requirement (e.g., age-restricted professional licenses)
- Affirmative action programs targeting older workers (e.g., preferential hiring of workers 55+)
- Retirement at the statutory minimum age of 60 or above
- Age-graded pay systems based on seniority or years of service (not on age per se)
4. Mandatory Retirement Age of 60
4-1. The Statutory Rule
Under Article 19 of APDEA, all employers in Korea must set the retirement age at no lower than 60 years of age. Any company rule, employment contract, or collective bargaining agreement that establishes a retirement age below 60 is void and unenforceable.
4-2. Relationship with Voluntary Retirement and Resignation
The mandatory retirement age law does not prevent:
- A worker from voluntarily resigning at any age
- An employer from entering into a mutual separation agreement at any age, provided the worker's consent is genuine and free
- Dismissal for just cause (disciplinary grounds, performance grounds, economic redundancy) at any age — subject to the separate requirements of the Labor Standards Act
4-3. No Maximum Retirement Age Ceiling
While the law sets a minimum retirement age of 60, it does not cap the maximum retirement age. Many Korean public corporations and some private companies have extended retirement ages to 62, 65, or even beyond on a voluntary basis — consistent with the government's policy of extending productive working lives.
5. Wage Peak System (임금피크제)
Many Korean companies use a wage peak system (임금피크제) in conjunction with the mandatory retirement age of 60. Under this system, workers' salaries are gradually reduced once they reach a certain age (often 55 or 57) in exchange for continued employment up to age 60.
However, in a landmark 2022 Supreme Court decision (Supreme Court Decision 2017du53608), the Korean Supreme Court ruled that a wage peak system can be invalid as discriminatory if:
- It was not introduced to address the extension of the mandatory retirement age
- The salary reduction is excessive relative to the purpose of the system
- The employer provides no corresponding benefit (e.g., job security, redeployment) in exchange for the pay reduction
Foreign companies operating wage peak systems in Korea should review their arrangements against this Supreme Court standard immediately.
6. Enforcement and Penalties
| Violation | Penalty |
|---|---|
| Age discriminatory recruitment advertisement | Fine up to KRW 5 million |
| Age discrimination in hiring, promotion, training | Administrative fine; civil damages; reinstatement order |
| Setting retirement age below 60 | Invalid provision; employer must treat worker as employed until 60; potential criminal penalty of KRW 5 million fine |
| Forced retirement before age 60 based on age | Unfair dismissal; reinstatement + back pay; damages of up to 3 months' wages per Korea Labor Relations Commission |
| Invalid wage peak system applied | Pay-difference recovery claims; potential class action exposure |
7. Elderly Employment Promotion Obligations
APDEA also imposes affirmative obligations on large employers to actively promote elderly employment:
| Employer Size | Obligation |
|---|---|
| 300+ employees | Must submit an Annual Elderly Employment Plan to MOEL; "preferred employment" of workers aged 55+ |
| All employers | Encouraged (not mandated) to hire workers 60+ post-retirement through re-employment contracts |
8. Practical Compliance Steps for Foreign Employers
- Audit all employment contracts and work rules: Ensure no provision sets a retirement age below 60. Void provisions do not automatically update — active amendment is required.
- Review job postings: Remove any age limits, age preferences, or age-coded language (e.g., "energetic young professional") from Korean job advertisements.
- Assess wage peak systems: Apply the Supreme Court's 2022 three-part test to existing systems. Consider restructuring to ensure proportionality and counterbalancing benefits.
- Train HR managers: Korean and expatriate HR personnel must understand that the foreign parent's age-based policies (e.g., forced retirement at 55 or 58) cannot be enforced in Korea.
- Handle separation agreements carefully: Ensure that any mutual separation agreement with an older worker is documented as genuinely voluntary and supported by adequate severance beyond the statutory minimum.
- Establish a non-discrimination grievance channel: APDEA violations can be filed with the MOEL or the Korea Labor Relations Commission. A robust internal grievance mechanism helps detect and address issues before they escalate.

Frequently Asked Questions (FAQ)
Q1: Can a foreign company enforce a retirement age of 55 for its Korean employees if that is the group policy?
No. Any contractual or policy provision setting a retirement age below 60 is void under Korean law, regardless of the foreign parent's group policy. The Korean mandatory retirement age of 60 is a minimum statutory protection that cannot be waived by contract, employer policy, or collective bargaining agreement.
Q2: Is a performance-based dismissal of a 58-year-old employee lawful?
Yes, provided the dismissal is for genuine, documented performance reasons that comply with the Labor Standards Act's requirements for ordinary dismissal (justified grounds, notice period, severance pay). The employer must demonstrate that age was not a factor in the decision, and that the performance standards applied equally to all age groups. Mixed-motive dismissals (partly performance, partly age-based) are legally risky.
Q3: If the retirement age in the employment contract is 58, what happens when the employee turns 58?
The retirement age clause is null and void. The employee's employment continues until age 60 at minimum. If the employer attempts to enforce the 58-year retirement age, this constitutes an unlawful dismissal. The employee can file an unfair dismissal claim with the Korea Labor Relations Commission within 3 months of the dismissal, seeking reinstatement and back pay.
Q4: Can an employer refuse to rehire a retired worker (aged 60+) because of age?
Post-retirement re-employment decisions are generally subject to the employer's discretion, but APDEA prohibits using age as the sole or primary criterion for refusing re-employment. Employers are encouraged to offer re-employment contracts to workers over 60 on changed conditions (e.g., reduced hours, fixed-term contract) — this is consistent with government policy but not strictly mandatory for private employers below 300 employees.
Q5: Does the mandatory retirement age of 60 apply to executive officers (directors)?
The mandatory retirement age of 60 applies to "workers" (근로자) under the Labor Standards Act — i.e., persons who provide labor in a subordinate relationship with the employer. Executive directors who are pure shareholders or who exercise independent managerial authority without being subordinate employees are generally not covered. However, "working directors" (사내이사) who also function as employees may be covered, depending on the substance of their relationship with the company.
Q6: Are age-based salary scales (seniority pay) lawful under APDEA?
Seniority-based pay systems (호봉제) that increase salary based on years of service are generally lawful, even if they correlate with age, because they are based on seniority, not age per se. However, systems that explicitly link pay to age (rather than years of service) may be challenged as age discriminatory. The key distinction is the basis for the differential: service-years are acceptable, age is not.
Q7: What is the statute of limitations for age discrimination claims?
Age discrimination complaints to MOEL must be filed within 3 years of the discriminatory act. Unfair dismissal claims with the Korea Labor Relations Commission must be filed within 3 months of the dismissal. Civil damages claims in court are subject to a general 3-year prescription period from the date the victim knew of the damage and the tortfeasor's identity.
