Korean Pension and Employee Retirement Benefits Law: A Complete Guide for Foreign Employers

Korea's mandatory employee retirement and social insurance system is one of the most comprehensive in Asia — and one of the most frequently misunderstood by foreign employers. Failure to comply can result in back-payment orders, administrative fines, and even criminal liability for corporate officers. This guide explains the full framework: the Four Major Social Insurance programs, the retirement pension scheme, severance obligations, and special rules applicable to foreign employees and expatriates.

1. The Four Major Social Insurance Programs (4

Every employer in Korea — including foreign-invested enterprises — must enroll eligible employees in the following four mandatory insurance programs, collectively known as the 4대 사회보험 (Four Major Social Insurance):

ProgramGoverning ActEmployer Contribution (2026)Employee Contribution (2026)
National Pension (국민연금)National Pension Act (국민연금법)4.5% of standard monthly income4.5% of standard monthly income
National Health Insurance (건강보험)National Health Insurance Act (국민건강보험법)3.545% of standard monthly income3.545% of standard monthly income
Employment Insurance (고용보험)Employment Insurance Act (고용보험법)0.9%–1.85% (varies by size)0.9% of standard monthly income
Industrial Accident Insurance (산재보험)Industrial Accident Compensation Insurance Act (산업재해보상보험법)Varies by industry (0.6%–34%)None (employer-only)
⚠️ Key Threshold: All employees working an average of 15 hours or more per week over the preceding 4 weeks must be enrolled, regardless of employment type (full-time, part-time, contract, dispatched). Short-term workers with less than one month of employment and daily workers may be exempt from certain programs.

1.1 National Pension (국민연금법)

Under the National Pension Act (Act No. 17771), both employers and employees contribute 4.5% each (total 9%) of the employee's standard monthly income. The standard monthly income is capped at approximately KRW 5,900,000 (2026). Foreign nationals from countries that have bilateral social security agreements with Korea may be exempt or eligible for lump-sum refund upon departure. Korea has concluded bilateral agreements with 34+ countries, including the United States, Germany, Japan, and Canada.

1.2 National Health Insurance (국민건강보험법)

The combined health insurance rate is 7.09% (2026), split equally. Long-term care insurance (장기요양보험료) is levied additionally at 12.95% of the health insurance premium. Foreign employees are generally enrolled unless they hold an E-9 (non-professional employment) or H-2 (overseas Korean working holiday) visa and are covered by private insurance meeting minimum standards.

1.3 Employment Insurance (고용보험법)

The employer's unemployment insurance contribution rate ranges from 0.9% to 1.85% depending on company size and industry. Employer contributions also cover vocational skills development (0.25%–0.85%). Foreign employees on D-8 (corporate investment), D-9 (trade management), E-1 through E-7 visas are generally enrolled, but F-4 (overseas Korean) and F-5 (permanent resident) holders may request exemption through bilateral agreements.

2. Employee Retirement Benefits: Severance Pay vs. Retirement Pension

The Act on the Guarantee of Employee's Retirement Benefits (근로자퇴직급여 보장법, AGERB, Act No. 18250) requires every employer to establish either (a) a severance pay (퇴직금) reserve system or (b) a retirement pension plan (퇴직연금제도) for employees who have worked continuously for one year or more with an average of 15+ hours per week.

2.1 Traditional Severance Pay (퇴직금)

Under the Labor Standards Act (근로기준법), Article 34 (formerly) and AGERB, an employer must pay a departing employee at least 30 days' average wage per year of service. The average wage is calculated based on the 3 months immediately preceding the termination date, including base salary, fixed allowances, and pro-rated bonuses. Failure to pay severance within 14 days of departure triggers a 20% delay penalty under AGERB Article 9.

2.2 Defined Benefit Retirement Pension (확정급여형 퇴직연금, DB)

Under a DB plan (AGERB Articles 13–19), the employer bears the investment risk. Benefits at retirement are guaranteed to be at least equal to the severance entitlement. Employers must set aside contributions with licensed financial institutions (banks, insurance companies, securities firms) and are prohibited from using these funds for operating purposes. An actuarial reserve of at least 80% of projected benefit obligations must be maintained.

2.3 Defined Contribution Retirement Pension (확정기여형 퇴직연금, DC)

Under DC plans (AGERB Articles 20–25), the employer contributes at least 1/12 of annual wages per year to individual employee accounts. The investment risk lies with the employee. DC plans are favored by multinationals as they reduce long-term balance sheet exposure. Upon termination, employees transfer their DC account balances to an Individual Retirement Pension Account (IRP).

2.4 Individual Retirement Pension Account (개인형 퇴직연금, IRP)

Since 2022, employees with 1+ year of service who separate from employment must transfer their retirement benefits into an IRP account (AGERB Article 9). Immediate lump-sum cash withdrawal is only permitted in specific hardship cases (house purchase, medical expenses, bankruptcy). This preserves the retirement asset until the employee reaches age 55.

3. Compliance Obligations for Foreign-Invested Companies

3.1 Enrollment and Reporting

Employers must report new hires to the National Health Insurance Service (NHIS) within 14 days and to the National Pension Service (NPS) within the same period. Employment insurance and industrial accident insurance must be reported to the Korea Workers' Compensation & Welfare Service (COMWEL) and Korea Employment Information Service (KEIS). Monthly contribution reports are due by the 15th of the following month.

3.2 Penalties for Non-Compliance

Failure to enroll employees subjects employers to administrative fines of up to KRW 1,000,000 per employee per year. Late payment of contributions results in a surcharge of 0.1% per day (up to 9% total). Under AGERB Article 44, willful failure to pay severance or pension contributions may result in criminal prosecution with penalties of up to 3 years imprisonment or fines up to KRW 20,000,000. Corporate officers may bear personal liability.

3.3 Expatriate and Short-Term Assignment Rules

Foreign nationals temporarily dispatched to Korea from a country with a bilateral social security agreement may be exempt from Korean National Pension and/or Employment Insurance contributions for up to 5 years (extendable), provided they submit a Certificate of Coverage (COC) from their home country's social security authority. This prevents double contributions in both Korea and the home country.

4. Special Rules for Foreign Employees by Visa Type

Visa TypeNational PensionHealth InsuranceEmployment Insurance
E-1 to E-7 (Professional)Required (bilateral exemption possible)RequiredRequired
D-8 (Corporate Investment)RequiredRequiredRequired
E-9 (Non-Professional Employment)Required (reciprocity basis)RequiredExempt (EPS coverage instead)
F-4 (Overseas Korean)RequiredRequiredRequired (exemption possible)
F-5/F-6 (Permanent Resident)RequiredRequiredRequired

5. Retirement Pension Plan Establishment Steps for New Foreign Employers

  1. Choose plan type: DB, DC, or a hybrid. Most foreign multinationals choose DC for flexibility.
  2. Select a licensed retirement pension provider: Must be a financial institution licensed by FSC (banks, insurance companies, securities firms). Popular choices include KDB, Hana Bank, Samsung Life, Mirae Asset Securities.
  3. Draft and register the retirement pension rules (퇴직연금 규약): Must include benefit formula, contribution schedule, investment options, and dispute resolution procedures. Register with the Ministry of Employment and Labor (MOEL) within 30 days of establishment.
  4. Notify employees: Employees must receive written notice and have the opportunity to review the plan rules. Employee representative consent is required for company-wide plan adoption under AGERB Article 4.
  5. Make regular contributions: DC plans require contributions at least annually; most multinationals contribute monthly for cash flow reasons.
  6. Annual disclosure: Employers must provide employees with annual statements of their retirement pension account balance and investment performance.

6. Practical Compliance Checklist for Foreign Employers

  1. ☑ Register company with Four Major Social Insurance agencies within 14 days of first hire
  2. ☑ Enroll all eligible employees (15+ hours/week average) within 14 days of hire
  3. ☑ Check for bilateral social security agreements for expatriate employees
  4. ☑ Establish retirement pension plan (DB or DC) within 1 year of company establishment if employing 1+ employees continuously
  5. ☑ Register retirement pension rules with MOEL
  6. ☑ Pay monthly social insurance contributions by 15th of following month
  7. ☑ Pay severance/pension transfer within 14 days of employee departure
  8. ☑ Transfer departing employee's retirement benefits to IRP account
  9. ☑ Provide annual pension account statements to employees
  10. ☑ Conduct annual actuarial review for DB plan (maintain ≥80% funded ratio)

Frequently Asked Questions (FAQ)

Q1: Does a foreign company with only one employee in Korea need to comply with all social insurance obligations?

Yes. There is no minimum headcount threshold for social insurance enrollment. Even a company with a single employee must register with the NHIS, NPS, COMWEL, and KEIS and make monthly contributions. However, an employer with fewer than 10 regular employees may have simplified reporting options. The retirement pension plan must be established if the sole employee works 15+ hours/week and completes 1 year of service.

Q2: What is the difference between severance pay and a retirement pension?

Severance pay (퇴직금) is a lump sum paid directly by the employer at the time of termination. The retirement pension system (퇴직연금) requires the employer to periodically contribute to a trust account managed by a licensed financial institution. Once deposited in the pension account, the funds are legally protected from employer insolvency — a key advantage for employees. Since 2012, new employers must establish a retirement pension plan; the legacy severance system is being gradually phased out.

Q3: Can an employer be exempt from severance pay obligations for probationary employees?

No blanket exemption applies. If a probationary employee works continuously for 1 year or more and averages 15+ hours/week, they are entitled to full severance. However, if the employment agreement stipulates a probation period of less than 3 months and the employee is terminated during this period, no severance accrues for that probation period. Employers cannot contractually waive statutory severance rights.

Q4: How does the IRP mandatory transfer work for foreign employees who leave Korea?

Foreign employees who depart Korea permanently may apply for a lump-sum pension refund (반환일시금) under the National Pension Act within 1 year of departure, provided their home country has a reciprocal agreement. For retirement pension (AGERB), departing employees may withdraw their DC/DB pension as a lump sum if they are leaving Korea permanently or converting to a different visa category that does not permit continued work. They must provide documentation of departure status to the pension provider.

Q5: What happens if a foreign company underpays or fails to make pension contributions?

The MOEL and the relevant social insurance agencies conduct periodic audits. Discovered underpayments must be corrected retroactively with a 0.1% per day late surcharge. Willful non-compliance can result in criminal referral. Additionally, employees who do not receive proper pension contributions may file civil claims against the employer and/or report to the MOEL Labor Standards Inspection Office. Foreign company officers (including resident representatives and CEOs) bear personal exposure.

Q6: Are family members of an insured employee covered under National Health Insurance?

Yes. Spouses, dependent children (under age 19, or under 25 if students), and dependent parents of enrolled employees may be added as dependents on the employee's health insurance plan at no additional premium cost. This is a significant benefit for foreign executives bringing families to Korea. Dependent enrollment must be applied for within 14 days of the employee's own enrollment.

Q7: Can a DC retirement pension plan's investment options be customized for foreign employees?

Yes. DC plan participants may choose from the investment menu approved by the FSC and offered by the selected pension provider. Options typically include domestic and international equity funds, bond funds, money market instruments, and (since 2022) ETFs. Foreign employees with shorter assignment terms often prefer more conservative investment options. Employers may provide investment education sessions, which is recommended but not mandatory.

1. Los Cuatro Grandes Seguros Sociales (4

No existe exención general.
