Korean Food Safety and Labeling Regulations for Foreign F&B Companies
South Korea is one of Asia's most dynamic food and beverage markets, with a discerning consumer base increasingly interested in imported foods, health functional foods, and novel food categories such as plant-based proteins and cultivated meat. For foreign food and beverage (F&B) companies seeking to export products to Korea or establish local manufacturing operations, navigating Korea's rigorous food safety and labeling regulatory framework is essential to market success.
Korea's food regulation is primarily governed by the Food Sanitation Act (식품위생법, FSA), the Health Functional Foods Act (건강기능식품에 관한 법률, HFFA), the Special Act on Imported Food Safety Management (수입식품안전관리 특별법, IFSMA), and the Food Labeling and Advertising Act (식품 등의 표시·광고에 관한 법률, FLAA). The primary regulatory authority is the Ministry of Food and Drug Safety (MFDS, 식품의약품안전처).
1. Import Registration and Pre-Market Approval
Foreign F&B companies exporting food products to Korea must work through a licensed Korean importer. Under the IFSMA, all food products imported into Korea must be:
- Imported by a registered food importer (수입식품등 수입판매업자) with MFDS
- Subject to import inspection at the port of entry by MFDS inspectors or designated inspection agencies
- Pre-notified via the Food Safety Korea (식품안전나라) online reporting system before arrival
Certain food categories require additional pre-market approval or registration:
| Category | Approval Type | Regulating Authority |
|---|---|---|
| Health Functional Foods (건강기능식품) | Product registration or functional ingredient recognition | MFDS |
| Novel Foods (신소재식품) | Safety assessment and approval before first import/sale | MFDS |
| Genetically Modified Foods (GMO) | Safety review and approval by MFDS | MFDS |
| Food Additives | Must be listed on Korea's Positive List (식품첨가물공전) | MFDS |
| Irradiated Foods | Prior approval required; labeling mandatory | MFDS |
2. Korean Food Labeling Requirements
Korea has among the most comprehensive food labeling requirements in Asia. Under the FLAA and MFDS guidelines, all food products sold in Korea must carry Korean-language labels that include:
2.1 Mandatory Label Elements
- Product name (제품명)
- Food category (식품 유형)
- Name and address of manufacturer, importer, and distributor
- Volume/weight (내용량)
- Date of manufacture, expiry date, or best-before date
- Ingredients list (원재료명) — in descending order by weight
- Nutritional information panel (영양성분표시) — mandatory for most processed foods
- Allergen declaration — 22 allergen groups must be declared (shellfish, peanuts, tree nuts, eggs, milk, wheat, soybeans, fish, buckwheat, sulfites, etc.)
- Country of origin (원산지)
- Storage instructions
- GMO declaration if applicable
2.2 Nutritional Labeling Standards
Korea's nutritional information panel must display: calories, sodium, carbohydrates, sugars, fat, saturated fat, trans fat, cholesterol, and protein — based on a 100g/100ml or serving size reference. As of 2023 MFDS amendment, added sugar labeling is now required separately from total sugars for certain product categories.
2.3 Front-of-Pack (FOP) Nutrition Labeling
Korea introduced a voluntary front-of-pack nutritional labeling system in 2019, which has evolved into a conditional mandatory system for snack foods, beverages, and confectionery targeting children These products must display a simplified nutrition label on the front panel.
3. Health Functional Food (HFF) Regulations
Health Functional Foods (HFF) occupy a special regulatory category between food and pharmaceuticals. Under the HFFA, only products that contain MFDS-recognized functional ingredients (기능성 원료) may be marketed with health claims. There are two pathways:
- Pre-recognized functional ingredients (고시형 원료): Approximately 100 ingredients/forms officially recognized by MFDS (e.g., omega-3, probiotics, red ginseng, vitamin C). Products using these may register without separate efficacy proof.
- Individual functional ingredient recognition (개별인정형 원료): New or non-listed ingredients must submit a dossier to MFDS including: clinical trial data, safety assessment, stability data. Approval typically takes 18–36 months.
HFF products must be sold through licensed HFF sellers (건강기능식품판매업자) and may not make disease treatment or prevention claims. Permitted claims include statements about maintaining or improving specific physiological functions.
4. GMO Labeling Requirements
Korea has one of the world's most stringent GMO labeling regimes. Under the FSA, foods must be labeled as GMO if:
- They contain GMO-derived materials in the top 5 ingredients by weight
- GMO DNA or protein is detectable in the final product (detection threshold: 3%)
From January 2026, the threshold is being revised — foods where GMO DNA/protein is not detectable in the final product are exempt from labeling even if GMO ingredients were used during processing. Foreign exporters must ensure traceability documentation to support labeling compliance.
5. Novel Foods and Plant-Based/Cultivated Meat
Korea recognizes "novel foods" (신소재식품) as food materials not traditionally consumed in Korea. Novel food approval requires a comprehensive safety assessment submitted to MFDS. Recent developments include:
- Plant-based proteins: Soy, pea, and mycoprotein-based products are generally approved but require standard food business registration and labeling as "analogues" (유사 제품)
- Cultivated meat: As of 2024, MFDS has issued draft guidelines for cultivated meat (배양육) safety assessment — foreign cultivated meat companies must engage with MFDS's novel food review process well in advance of planned market entry
- Insect proteins: Several insect species (mealworms, silkworms, crickets) are approved as food materials (식품 원료)
- CBD/hemp food products: Strictly prohibited from use in food products under Korean law
6. Import Inspection and Customs Procedures
All imported food products undergo inspection at the port of entry. MFDS inspection includes:
- Document review: Health certificates, certificates of analysis (COA), and import declaration forms
- Organoleptic inspection: Visual, odor, and sensory checks
- Sampling and laboratory testing: Pesticide residues, heavy metals, microbiological contamination, food additive compliance
- Country-of-origin-based screening: Products from countries with prior violation history may face enhanced inspection rates
Products that fail inspection may be returned to the country of origin or destroyed. MFDS may also impose an Import Suspension Order (수입중단) on specific products from specific manufacturers if recurring violations are found.
7. Food Business Registration for Local Manufacturing
Foreign companies wishing to manufacture food products in Korea must obtain a Food Business Permit (영업허가) or Food Business Registration (영업신고) from the local government (시·군·구) or MFDS, depending on the product category. All food manufacturing facilities must meet the standards in the Food Sanitation Act and comply with Korea's Good Manufacturing Practice (GMP, 우수제조기준) standards. Hazard Analysis Critical Control Point (HACCP, 식품안전관리인증기준) certification is mandatory for certain product categories including ready-to-eat products, milk, and infant formula.
8. Advertising and Claims Restrictions
Under the FLAA, food advertising in Korea is strictly regulated. Prohibited practices include:
- Claims that a food product can prevent, treat, or cure disease (pharmaceutical claims) — exclusively reserved for pharmaceuticals
- False or exaggerated comparative claims against competitors
- Claims using unofficial certifications or awards not recognized by MFDS
- Advertising targeting children (under 18) for high-calorie, high-sodium, high-sugar products on children's media platforms

Frequently Asked Questions (FAQ)
Q1: Does my food product need to be separately approved before exporting to Korea?
Most standard food products do not require separate pre-market approval — they can be imported after standard port inspection. However, health functional foods, novel foods, GMO foods, and irradiated foods require prior MFDS review and approval. It is critical to verify your product's category under Korean food classification before initiating export.
Q2: Can I use my existing EU or US labeling for products sold in Korea?
No. All food products sold in Korea must bear Korean-language labels meeting MFDS requirements. Bilingual labels (Korean + another language) are permitted, but the Korean label must include all mandatory elements. Labels may be affixed as stickers over the original foreign label during import, provided sticker labels meet MFDS standards and do not obscure original label information incorrectly.
Q3: What allergens must be declared under Korean law?
Korea mandates declaration of 22 allergen groups: eggs, milk, buckwheat, peanuts, soybeans, wheat, mackerel, crab, shrimp, pork, peach, tomatoes, sulfites, walnuts, chicken, beef, squid, shellfish (oysters, mussels, clams, scallops), pine nuts, and abalone. The declaration can be done within the ingredients list or in a separate allergen box. "May contain traces" precautionary allergen labeling is voluntary but recommended.
Q4: How does Korea's HACCP certification work for food manufacturers?
HACCP (식품안전관리인증기준) certification in Korea is mandatory for: (1) all food manufacturers with annual revenue above KRW 1 billion, (2) specific product categories (ready-to-eat, pasteurized milk, infant formula, meat products, etc.), and (3) school meal suppliers. HACCP certification is issued by the Korea Agency of HACCP Accreditation and Services (HAAS) or MFDS. Foreign manufacturers exporting to Korea are not directly required to obtain Korean HACCP certification but must meet equivalent food safety standards evidenced by documentation.
Q5: What are the penalties for labeling violations in Korea?
Under the FLAA, labeling violations can result in: administrative fines up to KRW 100 million, product recall orders, business suspension, and criminal prosecution for willful fraudulent labeling (up to 5 years imprisonment). MFDS publishes regular "Recall Notices" for products with labeling deficiencies — these have significant reputational implications for foreign brands.
Q6: Are there specific regulations for organic food labeling in Korea?
Yes. The "Organic" (유기농) label in Korea is governed by the Act on Environment-Friendly Agriculture and Fisheries and requires certification by MFDS-accredited organic certification bodies. Foreign organic products may use Korean organic labels if certified by equivalent foreign certification bodies recognized under bilateral recognition agreements, but must still be verified through the import inspection process. Foreign organic certifications (USDA Organic, EU Organic) are not automatically accepted without Korean authority verification.
Q7: How should foreign companies handle a product recall in Korea?
Under the FSA, food business operators must immediately report safety issues to MFDS and initiate voluntary recall if there is a risk of harm. MFDS may also issue a mandatory recall order. Foreign companies must work through their Korean importer/distributor to execute recalls. Korean law requires: public announcement of the recall, collection of affected products from the distribution chain, documentation and reporting to MFDS, and in serious cases, criminal investigation by the Ministry of Justice. Engaging Korean legal counsel early is strongly recommended for recall management.
