Korean Pharmaceutical & Medical Device Regulatory Approval: A Complete Guide for Foreign Companies

South Korea is one of Asia's largest and most sophisticated pharmaceutical and medical device markets, with the sector generating over USD 20 billion in annual revenue. The nation hosts world-class clinical trial infrastructure, a universal healthcare system, and a regulatory authority — the Ministry of Food and Drug Safety (MFDS / 식품의약품안전처) — that is fully aligned with international standards including PIC/S, ICH, and ISO 13485. For foreign pharmaceutical and medical technology companies looking to enter the Korean market, understanding the regulatory approval process is not merely advisable — it is commercially essential.

This guide provides a practical, attorney-drafted overview of Korea's regulatory pathways for pharmaceuticals and medical devices, the structural requirements for foreign market entrants, post-approval obligations, and the interplay with Korea's National Health Insurance (NHI) reimbursement system.

1. The Regulatory Framework: Key Laws and Authorities

The core legislation governing pharmaceutical and medical device regulation in Korea includes:

  • Pharmaceutical Affairs Act (약사법, Act No. 19200) — the foundational statute governing drug manufacturing, importation, quality control, approval, and pharmacovigilance.
  • Medical Devices Act (의료기기법, Act No. 19434) — governs the classification, manufacturing, importation, quality management, and safety monitoring of medical devices.
  • Act on the Safety and Support of Advanced Regenerative Medicine and Advanced Biopharmaceuticals (첨단재생의료 및 첨단바이오의약품 안전 및 지원에 관한 법률) — a 2019 statute creating a dedicated pathway for gene therapies, cell therapies, and tissue-engineered products.
  • Health Insurance Act (국민건강보험법) and related HIRA/NHIS regulations governing drug and device reimbursement.

The MFDS — Korea's equivalent to the US FDA — serves as the primary licensing authority. It operates through functional divisions including the Pharmaceutical Policy Bureau, Bio-Pharmaceuticals Bureau, and Medical Devices Safety Bureau. For innovative products, applicants may engage the MFDS Regulatory Science Center for pre-submission consultations.

2. Drug Classification and Approval Categories

Under the Pharmaceutical Affairs Act and related MFDS regulations, pharmaceutical products are classified into the following approval categories:

  • 신약 (New Drug — Type 1): A drug containing a new chemical entity (NCE), new biological entity (NBE), or new combination not previously approved in Korea. Full clinical trial data (Phase I–III) is required unless a waiver is granted based on foreign data. Average review timeline: 18–24 months.
  • 자료제출의약품 (Data-Submitting Drug — Types 2–6): Includes drugs with new formulations, new routes of administration, new dosage forms, or new indications. The extent of clinical data depends on the sub-type.
  • 바이오의약품 (Biologics): Includes vaccines, blood products, allergenics, recombinant proteins, monoclonal antibodies, and advanced therapy medicinal products (ATMPs). Subject to the Biologics Review Division of MFDS.
  • 제네릭 (Generic Drugs): Require bioequivalence (BE) studies rather than clinical trials, plus demonstration of pharmaceutical equivalence (API, dosage form, strength, route).
  • 바이오시밀러 (Biosimilars): Require comparative analytical, clinical, and pharmacokinetic/pharmacodynamic data against the Korean reference biologic.
Drug TypeData RequiredTypical Timeline
New Chemical Entity (NCE)Full Phase I–III clinical data18–24 months
New IndicationPhase III or abridged clinical data12–18 months
Generic DrugBE study + pharmaceutical equivalence6–12 months
BiosimilarComparative analytical + PK/PD + clinical12–18 months
ATMP (Cell/Gene Therapy)Full clinical + special safety data24–36 months

3. Special Regulatory Pathways

Korea has introduced several expedited pathways modeled on FDA and EMA mechanisms:

  • 희귀의약품 (Orphan Drug Designation): Available for drugs targeting diseases affecting fewer than 20,000 patients in Korea. Benefits include fee waivers, priority review, clinical trial support, and 6-year market exclusivity.
  • 조건부 허가 (Conditional Approval): Allows marketing authorization for life-threatening conditions prior to completion of confirmatory clinical trials, subject to post-marketing study commitments.
  • 패스트트랙 (Fast Track / Priority Review): Applicable to innovative drugs for unmet medical needs, serious conditions, or public health emergencies.
  • Revolution Drugs (혁신신약 지정): A 2023 designation providing enhanced regulatory support and faster HTA evaluation for genuinely transformative medicines.

4. Medical Device Classification and Regulatory Pathway

Korea uses a four-tier classification system for medical devices:

ClassRisk LevelExamplesRegulatory Route
Class I (1등급)LowestBandages, tongue depressorsNotification (신고)
Class II (2등급)Low-MediumSyringes, hearing aidsRegistration with technical documents
Class III (3등급)Medium-HighInfusion pumps, orthopedic implantsFull conformity review + GMP
Class IV (4등급)HighestCardiac stents, pacemakersFull review + clinical data + GMP inspection

Korea recognizes GMP equivalence for manufacturers certified by the US FDA (21 CFR Part 820 / QMSR), EU Notified Bodies (MDR 2017/745), and member countries of MDSAP (Medical Device Single Audit Program). Manufacturers holding valid CE marking under EU MDR may receive an expedited review track for Classes II–IV devices.

For innovative medical devices, MFDS offers 첨단의료기기 지정 (Advanced Medical Device Designation), which provides priority review and conditional access during clinical data collection.

5. Requirements for Foreign Companies: Entity and Representation

This is a critical structural point that often surprises foreign market entrants: under the Pharmaceutical Affairs Act and Medical Devices Act, the 품목허가보유자 (marketing authorization holder / product license holder) must be a Korean resident legal entity. This means:

  • Foreign pharmaceutical and device companies must either: (a) establish a Korean subsidiary (법인 설립), or (b) appoint a licensed Korean import business entity as the permit holder.
  • The Korean entity is legally responsible for all regulatory submissions, GMP compliance, labeling, pharmacovigilance, and product recalls.
  • Contractual arrangements between foreign originators and Korean licensees must clearly address intellectual property ownership, regulatory data rights, and liability allocation.

Many multinational companies establish a Korean subsidiary under the Foreign Investment Promotion Act (FIPA) for this purpose, benefiting from various tax incentives and foreign investment support programs offered by KOTRA's Invest KOREA.

6. GMP Compliance and Manufacturing Site Inspections

All marketed drugs and devices must comply with Korean GMP standards. The MFDS conducts:

  • Domestic site inspections prior to initial product approval for most Classes III–IV devices and new biologic products.
  • Overseas manufacturing site inspections (해외실사) for pharmaceuticals and biologics — the MFDS dispatches inspection teams to foreign manufacturing facilities.
  • Equivalence recognition: If a site has been inspected by a PIC/S member authority within the past 2 years, Korea may accept the foreign inspection report in lieu of a MFDS inspection, subject to a document review.

Annual GMP compliance reports must be filed with the MFDS, and manufacturers must notify the MFDS of any significant manufacturing changes, product defects, or safety signals.

7. Post-Market Obligations

Approval is only the beginning of regulatory responsibility in Korea. Post-market obligations include:

  • 재심사 (Re-examination): New drugs are subject to a mandatory re-examination period (4–6 years) during which the license holder must submit accumulated safety and efficacy data. Failure may result in license revocation.
  • 부작용 보고 (Adverse Drug Reaction / ADR Reporting): Serious unexpected ADRs must be reported to the MFDS within 15 days; non-serious ADRs within 30 days. Periodic Safety Update Reports (PSURs) are required for most new drugs.
  • PMS (Post-Market Surveillance): Medical device manufacturers must maintain a PMS system, conduct periodic performance evaluations, and file annual reports with the MFDS.
  • Recall obligations (회수 및 폐기): If a product defect is identified, the license holder must initiate a recall and notify the MFDS within 5 days of becoming aware.

8. National Health Insurance Reimbursement

MFDS marketing authorization does not automatically guarantee NHI reimbursement. A separate process with the Health Insurance Review and Assessment Service (HIRA / 건강보험심사평가원) and the National Health Insurance Service (NHIS / 국민건강보험공단) is required:

  1. Health Technology Assessment (HTA): HIRA evaluates clinical efficacy and cost-effectiveness. For innovative drugs, the "positive list" review process applies.
  2. Price Negotiation: Conditional listing decisions trigger price negotiations with the NHIS Drug Price Negotiation Committee. For drugs meeting certain breakthrough criteria, risk-sharing arrangements (성과기반 계약) may be offered.
  3. Listed Price (상한금액) and Volume Control: Once listed, the drug price is subject to periodic reassessment, and usage growth may trigger price cuts under the Market Expansion Re-evaluation (MER) mechanism.

Frequently Asked Questions (FAQ)

Q1. Can a foreign pharmaceutical company directly obtain a drug marketing authorization in Korea without establishing a Korean entity?

No. Under the Pharmaceutical Affairs Act (약사법), the marketing authorization holder (품목허가보유자) must be a Korean resident legal entity — either a Korean subsidiary of the foreign company or an independent licensed Korean import/distribution company. Foreign entities must appoint such a Korean license holder, who becomes legally responsible for all regulatory, safety, and recall obligations. However, the foreign innovator retains the option to license the product to a Korean entity contractually while retaining ownership of the underlying IP.

Q2. Does US FDA or EU EMA approval accelerate the Korean MFDS review process?

Yes, partially. While Korea does not yet have a full mutual recognition agreement (MRA) with the FDA or EMA, the MFDS does accept foreign clinical trial data generated in compliance with ICH guidelines, and may accept foreign inspection reports from PIC/S member authorities (including the FDA and EMA member states) for manufacturing site qualification. Fast Track designations from the FDA or EMA can also support a Korean Priority Review application. However, a standalone Korean regulatory dossier in the required MFDS format is still mandatory.

Q3. What is the typical timeline from Korean NDA submission to marketing authorization?

For new chemical entities (신약), the standard MFDS review timeline is approximately 18–24 months from submission of a complete application. Generic drugs (제네릭) typically receive approval in 6–12 months. Orphan drugs or products receiving Fast Track status can be processed in 10–15 months. Clinical trial authorization (IND) typically takes 30 days. The total time from entering clinical trials to commercialization in Korea is typically 5–8 years for an NCE, mirroring global development timelines.

Q4. How does Korea's medical device classification system compare to the EU MDR and US FDA systems?

Korea's four-class system (Class I–IV) broadly aligns with international frameworks. Class I/II broadly correspond to EU Class I/IIa and FDA Class I/II. Class III/IV correspond to EU Class IIb/III and FDA Class II/III requiring PMA. Notably, Korea is a member of the International Medical Device Regulators Forum (IMDRF), and the MFDS has been implementing convergence with IMDRF guidance. For EU MDR-compliant products, Korea offers a streamlined dossier review track, though a separate Korean approval (허가) is still required before marketing.

Q5. What penalties apply for marketing pharmaceuticals or medical devices without MFDS approval in Korea?

Violations are treated seriously under Korean law. Unauthorized drug marketing can result in up to 5 years imprisonment and/or fines up to KRW 50 million for individuals, and corporate fines under the Pharmaceutical Affairs Act. For medical devices, Criminal penalties under the Medical Devices Act include up to 3 years imprisonment and fines up to KRW 30 million. The MFDS also has authority to order product confiscation, business suspension, or license revocation. Critically, civil product liability claims under the Product Liability Act (제조물책임법) may also be available to injured consumers.

Q6. Can a foreign company conduct clinical trials in Korea without holding full MFDS product approval?

Yes. Korea has a robust clinical trial authorization (임상시험계획 승인, IND equivalent) system that allows foreign sponsors to conduct Phase I–III trials in Korea without a domestic marketing authorization. Korea is a globally attractive site for clinical trials due to its large patient pool, high compliance, ICHE6(R2) GCP-compliant hospitals, and competitive trial costs. Korean trial data generated under MFDS-approved IND is generally accepted by the FDA and EMA as part of a global NDA package.

Q7. How does the National Health Insurance reimbursement process work after MFDS drug approval?

MFDS approval and NHI reimbursement are separate, sequential processes. After MFDS approval, the license holder must file for NHI formulary listing with HIRA. HIRA conducts a health technology assessment (HTA) evaluating clinical benefit and cost-effectiveness against comparable treatments. If the HTA is positive (or the drug qualifies for direct listing), NHIS conducts price negotiations. The entire NHI listing process typically takes 12–24 months after MFDS approval. For ultra-rare diseases or urgent unmet needs, Korea offers an "emergency use provision" (긴급도입) for temporary NHI reimbursement prior to formal listing.

📋 Perspectiva Legal Coreana | Derecho Empresarial y Asuntos Regulatorios
