Real Estate Lease Disputes in Korea (Jeonse/Wolse): A Complete Legal Guide for Foreign Tenants and Landlords

Korea's rental housing market features two distinctive lease systems found virtually nowhere else in the world — jeonse (전세) and wolse (월세). Understanding these systems and the legal framework that governs them is essential for any foreigner renting or investing in Korean residential or commercial property. Disputes in Korean lease relationships can be complex, and the consequences of getting it wrong — particularly for jeonse tenants who deposit large lump sums — can be financially devastating.

This guide explains how jeonse and wolse work, what protections the law provides, how disputes arise, and what legal remedies are available under Korean law as of 2026.

1. Understanding Korea's Unique Lease Systems

Jeonse (전세) — Lump-Sum Deposit Lease

Jeonse is a uniquely Korean arrangement in which a tenant pays a large lump-sum deposit (typically 50–80% of the property's market value) to the landlord, with no monthly rent during the lease term. The landlord invests or uses the deposit, and at the end of the lease (typically 2 years), returns it in full to the tenant.

Jeonse became extremely popular in Korea because it was mutually beneficial — tenants avoided monthly rent payments, and landlords could use the capital interest-free. However, rising property prices and falling interest rates have made jeonse increasingly risky, and "jeonse fraud" (전세사기) has become a national crisis, with thousands of tenants losing deposits when landlords default.

Wolse (월세) — Monthly Rent Lease

Wolse is the more conventional rental arrangement where the tenant pays a smaller deposit (보증금) plus monthly rent. The deposit is typically much lower than jeonse — ranging from a few million to tens of millions of Korean won. Monthly rent rates vary by location, property type, and market conditions.

2. Key Legislation Governing Lease Disputes

Several statutes govern residential and commercial lease disputes in Korea:

  • Housing Lease Protection Act (주택임대차보호법) — The primary law protecting residential tenants, offering security of tenure, deposit protection, and anti-eviction provisions.
  • Commercial Building Lease Protection Act (상가건물임대차보호법) — Protects tenants in commercial properties; provides preferential repayment rights and lease renewal protections.
  • Civil Act (민법) — General lease provisions in Articles 618–654, applicable where the special acts do not apply.
  • Housing Act (주택법) — Governs housing construction, supply, and registration.
  • Act on Registration of Real Estate (부동산등기법) — Governs the registration system critical for priority ranking in deposit recovery.

3. Tenant Protections Under the Housing Lease Protection Act

3.1 Guaranteed Minimum Lease Term

Under Article 4 of the Housing Lease Protection Act, residential leases have a minimum duration of 2 years, regardless of any shorter term stated in the contract. If the landlord attempts to terminate before 2 years, the tenant may insist on continuing the lease.

3.2 Lease Renewal Rights (계약갱신청구권)

Since August 2020, tenants have the right to demand one lease renewal of up to 2 additional years, giving effective security of tenure for up to 4 years total. The landlord may refuse renewal only in limited circumstances — notably if the landlord or an immediate family member intends to occupy the property personally.

3.3 Rent Increase Cap (전월세상한제)

When a lease is renewed (whether under the renewal right or by mutual agreement), the landlord may not increase rent by more than 5% of the existing rent or deposit amount per renewal. This cap applies in designated regions and helps protect tenants from sudden large rent hikes.

3.4 Opposing Power (대항력)

To protect their deposit, tenants must establish opposing power (대항력) — the right to claim their lease against third parties, including a new owner who buys the property. Opposing power is acquired by:

  1. Taking actual possession of the property, AND
  2. Completing resident registration (주민등록전입신고) — or, for foreigners, completing alien registration (외국인등록) and establishing the property as the declared place of residence.

Opposing power takes effect the day after completion of the above steps. Timing is critical — any mortgage or lien registered before opposing power is established has priority over the tenant's deposit claim.

3.5 Confirmed Date (확정일자)

In addition to opposing power, tenants should obtain a confirmed date (확정일자) on the lease contract from a district court, notary, or community service center (주민센터). This gives the tenant a preferential repayment right (우선변제권) to recover the deposit from the auction proceeds in the event of foreclosure, ranked by the date the confirmed date was obtained.

3.6 Small-Deposit Priority Protection (최우선변제권)

Tenants with small deposits (amounts vary by region — currently up to KRW 165 million in Seoul) are entitled to receive a portion of their deposit (up to KRW 55 million in Seoul) in absolute priority, even ahead of secured creditors, if the property is auctioned. This "super priority" protects the most economically vulnerable tenants.

4. How Jeonse Disputes Arise

The most common and financially devastating disputes involve the failure to return the jeonse deposit. Key causes include:

  • Fraudulent or over-mortgaged properties: A landlord rents out a property that is already heavily mortgaged, and when foreclosure occurs, the tenant's deposit is lost because the bank's mortgage has priority.
  • Landlord insolvency: The landlord simply cannot return the deposit at the end of the term due to financial difficulties.
  • "Gap investment" (갭투자) collapses: Landlords who leveraged jeonse deposits to purchase properties at thin margins are wiped out when property values fall.
  • Multiple jeonse layering: In fraud schemes, the same property may be used for multiple jeonse contracts, leaving multiple tenants competing for a single asset.

5. Legal Remedies for Tenants

5.1 Lease Deposit Return Lawsuit (임차보증금반환청구소송)

When a landlord refuses to return the deposit at the end of the lease, the tenant may file a deposit return lawsuit in the district court having jurisdiction over the property's location. The lawsuit seeks a judgment ordering the landlord to repay the deposit, plus any applicable interest.

To file, the tenant must show: (1) the lease has ended, (2) the deposit has not been returned, and (3) the tenant has vacated or offered to vacate. Courts generally rule swiftly in straightforward cases.

5.2 Provisional Attachment (가압류)

To prevent the landlord from disposing of assets before judgment, a tenant can apply for provisional attachment of the landlord's property (including the leased property itself or other assets). Courts grant this when there is a credible risk of asset dissipation.

5.3 Forced Auction (임의경매 / 강제경매)

Once a tenant obtains a judgment (or has a confirmed date on a property with a defaulting landlord), they can apply to the court to order a forced auction of the property. The tenant then receives repayment from auction proceeds according to their priority ranking.

5.4 Jeonse Deposit Insurance (전세보증금반환보증)

Korea's Housing Finance Corporation (HF, 주택금융공사), Korea Housing Guarantee (HUG, 주택도시보증공사), and SGI Seoul Guarantee offer jeonse deposit return guarantee insurance. If the landlord fails to return the deposit, the insurer pays the tenant and then pursues the landlord. Foreign tenants who qualify should seriously consider this protection.

6. Commercial Lease Disputes

Commercial tenants benefit from the Commercial Building Lease Protection Act, which provides:

  • 10-year lease renewal right — tenants may demand renewals for up to 10 years total.
  • Rent increase cap of 5% per renewal.
  • Preferential repayment of deposits up to KRW 65 million (in Seoul as of 2024) in case of auction.
  • Protection from arbitrary eviction; landlords must compensate for goodwill (권리금) if they prevent the tenant from transferring their business to a new tenant.

Goodwill (kwonrigeom, 권리금) disputes are particularly common in Korean commercial leases. When a landlord interferes with the tenant's right to transfer goodwill to a new tenant, the tenant may claim damages under Article 10-4 of the Commercial Building Lease Protection Act.

7. Practical Tips for Foreign Tenants

  1. Check the property registry before signing. Obtain a certified copy of the property register (등기부등본) from a government portal (www.iros.go.kr). Look for existing mortgages, liens, or seizures.
  2. Check the landlord's identity. Confirm that the person signing the lease is actually the registered owner.
  3. Register as soon as you move in. Foreign nationals should complete alien registration (외국인등록) and declare the property as their residence to establish opposing power.
  4. Obtain a confirmed date immediately. Visit the nearest community service center (주민센터) on the day you move in or register.
  5. Consider jeonse deposit insurance. Especially for large deposits, this insurance is highly recommended.
  6. Consult a lawyer before signing. Korean lease contracts contain many terms that are disadvantageous to tenants if not carefully reviewed.

Frequently Asked Questions (FAQ)

Q1. I am a foreigner living in Korea. Does the Housing Lease Protection Act protect me?

Yes. The Housing Lease Protection Act applies to all residents of Korea, including foreigners. To claim opposing power, foreign nationals must complete alien registration (외국인등록) at the immigration office and declare the leased property as their place of residence. Once this is done, they have the same legal protections as Korean citizens.

Q2. My landlord is refusing to return my jeonse deposit. What should I do?

First, send a formal written demand (내용증명) to the landlord requesting return of the deposit. If the landlord does not respond within a reasonable period, file a deposit return lawsuit in the local district court. You can also apply for provisional attachment of the landlord's assets to prevent them from being hidden or transferred. If the property is auctioned, your priority ranking (based on confirmed date) determines how much you recover.

Q3. The property I rented was auctioned and I lost part of my deposit. Can I sue the landlord personally?

Yes. You can file a civil lawsuit against the landlord for the shortfall. If the landlord engaged in deliberate fraud (e.g., concealing mortgages or creating multiple jeonse contracts), you can also file a criminal complaint for fraud (사기), which may result in criminal prosecution and restitution.

Q4. My landlord wants to raise my monthly rent by more than 5%. Can they do that?

Not if your lease is being renewed. During renewal, landlords are capped at a 5% increase in Seoul and other designated regions. However, when an existing lease ends and an entirely new lease is negotiated (not a renewal), the landlord is free to set any rent they wish. Know your rights: if you are exercising the statutory renewal right, the 5% cap applies.

Q5. Can a landlord evict me to move in themselves?

Yes, but only under strict conditions. If the landlord or their immediate family members genuinely intend to occupy the property personally, they may refuse the tenant's renewal request. The landlord must actually move in — if the landlord rents to another tenant within 3 months, the evicted tenant can claim damages equal to 3 months of rent plus any loss suffered.

Q6. I have a commercial lease. My landlord blocked me from transferring my business to a new tenant. What can I do?

Under the Commercial Building Lease Protection Act, landlords cannot unreasonably obstruct the tenant from transferring goodwill (권리금) to a new tenant, except in the final 6 months of the maximum 10-year lease term. If they do, you can sue for damages equal to the goodwill amount that was lost, supported by appraisal evidence.

Q7. What is the difference between opposing power and a confirmed date?

Opposing power (대항력) allows you to enforce your lease against third parties (including a new owner). A confirmed date (확정일자) gives you the right to recover your deposit from auction proceeds in priority order. You need both for full protection. Opposing power protects your right to continue occupying; a confirmed date protects your right to get your money back.

📋 Perspectiva Legal Coreana | Derecho Inmobiliario y Arrendamientos

  • Subasta forzosa: Tras obtener sentencia favorable.
