Korean Immigration: Work Visa Types and Corporate Sponsorship — A Complete Guide for Foreign Companies and Employees

As Korea continues to attract foreign investment and multinational corporations, understanding the Korean work visa system has become a critical business and human resources challenge. Whether you are a foreign company establishing a Korean subsidiary, a multinational relocating executives to Seoul, or a skilled professional seeking to work in Korea, navigating Korea's immigration framework requires familiarity with specific visa categories, sponsorship obligations, and compliance requirements.

This article provides a comprehensive guide to Korea's major work visa categories, corporate sponsorship procedures, the role of the Ministry of Justice and the Korea Immigration Service, and practical compliance strategies for foreign companies and employees.

1. Legal Framework

Korean immigration is governed primarily by the Immigration Act (출입국관리법, Act No. 3746) and its Enforcement Decree and Rules, administered by the Korea Immigration Service (KIS) under the Ministry of Justice (MOJ). Additional regulations relevant to foreign workers include:

  • Act on the Employment of Foreign Workers (외국인근로자의 고용 등에 관한 법률, EPS Act) — governs non-professional foreign workers under the Employment Permit System (EPS)
  • Foreign Investment Promotion Act (외국인투자촉진법, FIPA) — provides preferential immigration treatment for foreign investors
  • Foreigner's Land Acquisition Act and bilateral Free Trade Agreements (FTAs) — contain specific immigration provisions for nationals of FTA partner countries
  • Act on Special Cases Concerning Immigration Procedures for Overseas Koreans (재외동포법) — governs overseas Koreans (F-4 visa)

2. Key Work Visa Categories

Korean work visas are designated by letter-number combinations. The most relevant categories for corporate and professional use are:

E-1: Professor

For foreign nationals employed at Korean universities or educational institutions recognized under the Higher Education Act. Requires an employment contract with a qualifying institution.

E-2: Foreign Language Instructor

For native speakers of designated languages employed at Korean educational institutions to teach their native language. Requires a criminal background check, health certificate, and degree verification from an apostille-certified country.

E-3: Research

For researchers employed at government-recognized research institutions or universities. Requires a research contract and institutional sponsorship.

E-4: Technology Transfer

For foreign nationals introducing specialized technology to Korean industry under a technology transfer agreement. Requires documentation of the technology and the receiving Korean entity.

E-5: Professional Employment

For foreign professionals licensed to practice specialized professions in Korea (e.g., law, medicine, accounting) under Korean law or bilateral recognition agreements. This category requires Korean professional licensing or official reciprocal recognition.

E-6: Arts and Entertainment

For performers, artists, and entertainment workers. Subcategories include E-6-1 (arts/music), E-6-2 (hotel/casino entertainment), and E-6-3 (sports). Corporate sponsors must hold proper entertainment venue licenses.

E-7: Special Occupation

The most significant category for multinational corporations. E-7 covers 82 designated occupation codes spanning specialized fields including IT, engineering, finance, management, design, and translation. To sponsor an E-7 holder:

  • The employer must demonstrate the position cannot be filled by a Korean national
  • A minimum salary threshold applies (typically at or above the average wage for the occupation)
  • The foreign employee must hold relevant educational qualifications or work experience
  • The employer files an immigration petition (초청장) with the KIS

D-7: Intra-Company Transferee

For employees of multinational corporations transferred from a foreign parent, subsidiary, or affiliate to a Korean entity. Requirements:

  • The Korean entity must be a branch, subsidiary, or affiliate of the foreign employer
  • The transferee must have been employed by the foreign entity for at least 1 year prior to transfer
  • The position must involve managerial, executive, or specialized knowledge functions

D-7 is particularly important for companies entering Korea under Korea's FTA intra-company transferee provisions (e.g., Korea-US FTA, Korea-EU FTA).

D-8: Corporate Investment

For foreign investors and their employees engaged in the operation of a foreign-invested company. Under the FIPA, foreign investors who invest KRW 100 million or more may obtain D-8 status. D-8 holders are subject to fewer restrictions than E-category visa holders and may engage in a broader range of business activities.

F-2: Long-Term Residency

Issued to foreign nationals who have legally resided in Korea for 5+ years (or less under special qualifications), holders of specific E-category visas, and spouses/children of Korean nationals. F-2 holders have broad employment rights.

F-4: Overseas Korean

For ethnic Koreans holding foreign citizenship. F-4 holders may engage in most employment activities without employer sponsorship, making them particularly flexible for companies hiring Korean-heritage professionals from abroad.

F-5: Permanent Residency

Available to foreigners with 5+ years of lawful residence, spouses of Korean nationals with stable income, and Point System immigrants. Permanent residents have full employment rights equivalent to Korean nationals.

3. Corporate Sponsorship Obligations

Korean employers sponsoring foreign workers bear significant legal obligations:

  • Employment contract in Korean: Required for most work visa categories; must specify wages, working hours, duties, and benefits consistent with the Labor Standards Act
  • Notification of changes: Employers must notify KIS within 15 days of any change in the foreigner's employment status (resignation, reassignment, promotion)
  • Immigration petition (초청장): For E-7, D-7, and D-8, the employer files an invitation letter with KIS before the foreign employee applies at a Korean consulate abroad
  • Workplace insurance: Sponsors must ensure foreign workers are enrolled in the 4 major social insurance schemes (national health, national pension, employment insurance, industrial accident compensation) if eligible under the respective Acts
  • No unauthorized employment: Allowing a foreigner to work in activities not covered by their visa status (e.g., an E-2 teacher working a second job) constitutes an immigration violation and exposes the employer to fines and immigration audit

4. The Employment Permit System (EPS) for Non-Professional Workers

Non-professional foreign workers (e.g., manufacturing, agriculture, fishery, construction, service sectors) enter Korea under the E-9 (Non-Professional Employment) and E-10 (Vessel Crew) visa categories through the Employment Permit System (EPS) administered jointly by the Ministry of Employment and Labor and the Korea Immigration Service.

EPS workers must:

  • Pass the Korean language proficiency test (EPS-TOPIK) administered in their home country
  • Be selected through a bilateral labor agreement between Korea and their home country (16 MOU countries as of 2026)
  • Work only in the employer-designated sector and workplace
  • Change employers only under prescribed conditions (employer closure, rights violations)

5. Points-Based Immigration System (Skilled Foreign Workers)

Korea operates a Points-Based System (점수제) for highly skilled foreign workers seeking F-2 or F-5 (permanent) residency. Points are awarded for education, Korean language ability, income level, age, and specialized skills. The Ministry of Justice periodically updates the scoring tables. Applicants exceeding the minimum threshold may apply for long-term residency status without employer sponsorship.

6. Practical Compliance Tips for Foreign Companies

  1. Establish a Korean entity first: Corporate sponsorship for work visas requires a registered Korean legal entity (branch office, subsidiary, or liaison office)
  2. Allow lead time: E-7 and D-7 petitions typically take 2–4 weeks at KIS; Korean consular processing abroad adds 1–3 weeks. Plan relocations 2–3 months in advance
  3. Use the Hikorea/EIPO portal: Foreign residents and their employers can track visa status, file extensions, and change employer registrations via the Hikorea online portal
  4. Annual status maintenance: Most E and D visas must be extended annually or every 2–3 years. Failure to extend on time constitutes unlawful stay
  5. Re-entry permits: Foreigners on long-term visas leaving Korea for more than 1 year must obtain a re-entry permit or their sojourn period may lapse
  6. Criminal compliance: Under recent Immigration Act amendments, employers found to systematically employ unauthorized foreigners face criminal prosecution alongside administrative penalties

Frequently Asked Questions (FAQ)

Q1: Can a foreign company sponsor a work visa for someone who has not yet been hired?

No. Korean work visa sponsorship requires an existing employment contract or a signed letter of appointment. The employer must file the invitation petition (초청장) with KIS, referencing a specific, identified employee and position.

Q2: What is the difference between E-7 and D-7 visas?

E-7 (Special Occupation) is for hiring a new foreign employee from abroad into one of 82 designated occupations. D-7 (Intra-Company Transfer) is for transferring an existing employee from a foreign entity to a Korean affiliate. D-7 is generally simpler because the relationship between the Korean and foreign entities is already established and the employee's track record is documented.

Q3: How much must an E-7 visa holder earn?

The minimum salary requirement for E-7 is determined by the Ministry of Justice based on the specific occupation. As a general benchmark, E-7 holders must earn at least the median wage for their occupation category. For 2026, the general floor is approximately KRW 2.5–3.5 million/month depending on occupation, but higher-skilled occupations require significantly more. An immigration attorney can confirm current thresholds.

Q4: Can an F-4 overseas Korean work without visa sponsorship?

Yes. F-4 visa holders (ethnic Koreans with foreign citizenship) may engage in most employment activities in Korea without employer sponsorship and without restriction to specific sectors or occupations. However, F-4 holders may not engage in simple manual labor (단순노무) activities.

Q5: What happens if a company employs a foreigner in violation of their visa status?

Employing a foreigner in activities outside their authorized visa status violates the Immigration Act (Article 18). The employer may face: (1) fines of up to KRW 20 million per unauthorized employee; (2) prohibition on sponsoring future foreign workers; (3) criminal charges in aggravated cases. The foreign employee may face deportation and entry ban.

Q6: Are there immigration fast-tracks for startups or tech companies?

Yes. Korea's Startup Visa (D-10-4) permits foreign entrepreneurs to reside in Korea while establishing a startup, without requiring immediate employment. The Digital Nomad Visa (F-1-D), introduced in 2023, permits foreign nationals employed by overseas companies to reside in Korea for up to 1 year while working remotely. Tech companies can also leverage the E-7-S (Start-up) subcategory introduced for graduates of Korean universities.

Q7: Does Korea have an immigration pathway for high-net-worth investors?

Yes. Under the FIPA, foreign nationals who invest at least KRW 500 million in a new business or KRW 300 million through a Public Investment Fund designated by the Korea Immigration Service may obtain an F-2 (Long-Term Residency) visa and, after 5 years, apply for F-5 (Permanent Residency). This investor immigration pathway is particularly popular with nationals from countries without FTA-based preferential immigration access.
