Korean Patent Registration for Foreign Technology Companies: A Complete 2026 Legal Guide
South Korea is one of the world's most active patent markets. As home to global technology giants such as Samsung, LG, SK Hynix, and Hyundai, the Korean Intellectual Property Office (KIPO) consistently ranks among the top five patent offices in the world by application volume. For foreign technology companies seeking to protect inventions, enter licensing arrangements, or defend against infringement in Korea, understanding the Korean patent system is not optional — it is a strategic imperative.
This guide provides a comprehensive overview of the Korean patent registration process, enforcement landscape, patent licensing, and critical considerations for foreign companies navigating Korean IP law in 2026.
1. Legal Framework: The Korean Patent Act
Korean patent law is governed primarily by the Patent Act (특허법), most recently amended in 2023 to align with international standards and strengthen protection for software, AI-related inventions, and biotechnology. Korea is a signatory to the Patent Cooperation Treaty (PCT) and the Paris Convention, allowing foreign companies to use the PCT national phase route to enter Korea or claim priority from earlier filings in their home countries.
Additional relevant legislation includes:
- Utility Model Act – For simpler, device-related inventions with a shorter protection period (10 years)
- Design Protection Act – Protects the aesthetic appearance of a product
- Trademark Act – Separately governs brand names and logos
- Unfair Competition Prevention and Trade Secret Protection Act – Protects undisclosed know-how and trade secrets
2. Who Can Apply: Foreign Applicant Rights
Foreign individuals and companies may apply for Korean patents directly or through a Korean patent attorney (변리사). However, applicants without a domicile or business establishment in Korea must appoint a domestic representative (Korean patent attorney or agent) to act on their behalf before KIPO. This is a mandatory procedural requirement under Article 5 of the Patent Act.
Foreign companies can file through:
- PCT National Phase Entry (most common for international portfolios)
- Direct Korean Application with Paris Convention priority
- Direct filing without priority (for new inventions first filed in Korea)
3. The Patent Application Process in Korea
The standard Korean patent prosecution timeline involves several key stages:
Step 1: Filing
Applications are filed with KIPO electronically. Required documents include a request, specification (claims, description, abstract), drawings (if applicable), and a power of attorney if filed through a representative. Foreign language applications may be filed initially, but a Korean translation must be submitted within 14 months.
Step 2: Publication
Applications are laid open for public inspection 18 months after the filing date (or priority date). This triggers provisional protection rights — if the patent is ultimately granted, the applicant may seek compensation from parties who commercially exploited the invention after the publication date.
Step 3: Substantive Examination
Korea uses a deferred examination system. Applicants must request substantive examination within 3 years of the filing date; otherwise the application lapses. KIPO examiners assess novelty, inventive step, and industrial applicability. Office actions (거절이유통지) are issued when the examiner identifies issues, and applicants have at least one opportunity to respond with arguments or claim amendments.
Step 4: Grant and Registration
If examination is successfully completed, KIPO issues a decision to grant. Patent fees must be paid within 3 months of the decision, after which the patent is registered and published in the Patent Gazette. Korean patents have a term of 20 years from the filing date.
Step 5: Post-Grant Procedures
After grant, third parties may file an invalidation trial (무효심판) before the Intellectual Property Trial and Appeal Board (IPTAB) or raise invalidity as a defense in infringement proceedings. Patentees may also file a correction trial (정정심판) to limit or clarify claim scope.
4. Patent Costs in Korea
| Stage | Approximate Cost (USD) |
|---|---|
| PCT National Phase Entry (translation + filing) | $2,500 – $4,000 |
| Direct filing (simple invention) | $1,500 – $3,000 |
| Examination request fee | $300 – $600 |
| Response to Office Action | $800 – $2,000 |
| Grant registration fee (first 3 years) | $400 – $700 |
| Annual maintenance (years 4–20) | $200 – $2,000+/year |
Note: Costs depend on claim complexity, translation requirements, and attorney fees.
5. Software and AI Patents in Korea
Korea has progressively expanded patent protection for software and computer-implemented inventions. KIPO's Computer-Related Invention Examination Guidelines (revised 2022) confirm that software inventions are patentable if they produce a concrete technical effect using hardware resources. AI-related inventions — including machine learning models, training methods, and AI-assisted decision systems — are now widely accepted, provided the claims specify a technical problem and solution.
Key points for software patent applicants:
- Claims should be drafted as a "method," "system," or "computer-readable medium" format
- Abstract algorithms or business methods without a technical implementation are not patentable
- AI training datasets and the AI model itself may be protectable as trade secrets under the Unfair Competition Act
6. Patent Enforcement in Korea
Korean patent enforcement is handled through both civil and criminal routes:
Civil Litigation
Patent infringement cases are filed with the Seoul Central District Court (for civil damages and injunctions) or the Patent Court of Daejeon (for appeals from IPTAB decisions). The Patent Court was established in 1998 specifically to handle technical IP disputes with specialized judges.
Available civil remedies include:
- Preliminary injunctions (가처분) — available before trial if irreparable harm is shown
- Permanent injunctions after final judgment
- Compensatory damages (lost profits or reasonable royalty)
- Punitive damages up to 3× actual damages (for willful infringement, introduced in 2019)
- Destruction of infringing goods
Criminal Prosecution
Willful patent infringement is a criminal offense under Article 225 of the Patent Act, punishable by up to 7 years imprisonment or a fine of up to KRW 100 million (approx. USD 75,000). Criminal prosecution requires a complaint by the patentee (반의사불벌죄 — prosecution cannot proceed without the patentee's consent).
Customs Border Measures
Patentees may file a petition for suspension of customs clearance with the Korea Customs Service to seize infringing goods at the border. This requires prior registration of IP rights with customs and evidence of likely infringement.
7. Patent Licensing in Korea
Patent licenses (실시권 설정계약) in Korea must be registered with KIPO to be effective against third parties. Key types include:
- Exclusive License (전용실시권) — licensee has the exclusive right to work the invention; the patentee may not practice without the licensee's consent
- Non-exclusive License (통상실시권) — multiple licensees may be granted; patentee retains right to practice
- Compulsory License — KIPO may grant a license to a third party if the patent owner refuses to license on reasonable terms and public interest is at stake
Cross-border royalty payments are subject to withholding tax under the Korea-source income rules. The standard withholding rate is 20%, but tax treaty benefits may reduce this significantly (e.g., US-Korea Treaty: 10–15%; Japan-Korea Treaty: 10%).
8. Patent Strategy for Foreign Technology Companies
A well-designed Korean patent strategy typically includes:
- File early: Korean law follows a first-to-file system. Delay increases the risk of competitors filing first.
- Translate claims carefully: Korean claim language should be reviewed by a bilingual technical attorney to avoid scope limitations.
- Monitor competitors: Use KIPRIS (Korea IP Rights Information Service) to monitor competitor filings and publication.
- Register licenses: Unregistered licenses are not enforceable against third-party transferees of the patent.
- Coordinate with trade secret strategy: Not everything must be patented — some technologies are better protected as trade secrets.
- Plan for invalidation risk: Korean invalidation trial success rates are relatively high; ensure your claims are well-supported by the specification.

Frequently Asked Questions (FAQ)
Q1: Can a foreign company file a Korean patent without a local office?
Yes. A foreign company without a Korean office must appoint a registered Korean patent attorney to act as its domestic representative before KIPO. No physical presence or Korean subsidiary is required to obtain and own a Korean patent.
Q2: How long does it take to get a Korean patent?
From filing to grant typically takes 18–36 months for a standard application where examination is requested promptly. KIPO offers accelerated examination (우선심사) for certain categories including environmentally friendly technologies, national strategic industries, and applications by SMEs, which can reduce prosecution time to 6–12 months.
Q3: Is a US or European patent automatically valid in Korea?
No. Patent rights are territorial. A US patent or European patent does not provide any protection in Korea. Foreign companies must file separately in Korea (directly or via PCT national phase) to obtain Korean patent protection.
Q4: What is the difference between a Korean patent and a utility model?
A utility model (실용신안) requires lower inventive step than a patent and is granted for 10 years (vs. 20 years for a patent). It is generally used for simpler device improvements. Unlike patents, utility models are registered without substantive examination, but they can be invalidated through a trial.
Q5: Can AI-generated inventions be patented in Korea?
Currently, KIPO requires that a human inventor be named on the application. Inventions created autonomously by AI without human creative contribution cannot be patented in Korea under the current framework. However, inventions made by humans using AI tools remain patentable.
Q6: What evidence is needed to prove patent infringement in Korea?
The patent owner must demonstrate that the accused product or process falls within the scope of at least one patent claim (claim-by-claim comparison). Korean courts may order document production and on-site inspection to obtain evidence. Expert witnesses are commonly used in technically complex cases.
Q7: Are there special patent protections for pharmaceutical companies in Korea?
Yes. Korea has a Patent-Drug Linkage System (의약품 허가-특허 연계 제도) under the Pharmaceutical Affairs Act, which allows pharmaceutical patent holders to delay generic drug approval during the patent term. Korea also allows patent term extension for delays caused by regulatory approval of new pharmaceutical substances.
