Enforcing Foreign Judgments in South Korea: Requirements, Process, and Practical Considerations

By Attorney NOH UJIN | HANBYOL LAW LLC, Seoul
⚖️ Korean Law Insight | Cross-Border Litigation

Introduction

When a party obtains a favorable court judgment in a foreign country, enforcing that judgment in South Korea requires navigating a distinct legal framework. Unlike some jurisdictions that offer streamlined recognition processes, Korea requires a formal court proceeding to recognize and enforce foreign judgments. This guide explains the key requirements, procedures, and practical considerations involved.

1. Legal Framework

The enforcement of foreign judgments in South Korea is governed by:

  • Article 217 of the Civil Procedure Act: Recognition requirements
  • Articles 26 and 27 of the Civil Execution Act: Enforcement procedures

Korea does not have a general treaty on mutual recognition and enforcement of judgments, though bilateral agreements with specific countries may apply.

2. Requirements for Recognition

Under Article 217, a foreign judgment is recognized in Korea if it meets ALL of the following conditions:

A. Jurisdictional Legitimacy

The foreign court must have had jurisdiction under:

  • International law principles, OR
  • Treaties between Korea and the foreign country, OR
  • The law of the country where the judgment was rendered

Note: Korean courts will not recognize a judgment if the foreign court assumed jurisdiction that Korean courts would not accept under similar circumstances.

B. Due Process (Service of Process)

The losing party must have received:

  • Proper notice of the lawsuit (service of summons and complaint)
  • Adequate opportunity to defend

Common issue: If service was made by publication or substitute service without genuine effort to locate the defendant, Korean courts may reject recognition.

C. No Violation of Public Policy

The judgment must not:

  • Violate Korean public policy (공서양속)
  • Conflict with fundamental principles of Korean law

Examples of public policy violations:

  • Punitive damages (Korean courts typically reduce these to compensatory levels)
  • Judgments obtained through fraud or corruption
  • Judgments that conflict with Korean mandatory laws (e.g., labor protections)

D. Reciprocity

The foreign country must recognize Korean judgments under similar conditions (reciprocity requirement).

Practical note: Korea has established reciprocity with many countries through case law, including the U.S., Japan, and most EU countries.

3. Procedure for Recognition and Enforcement

Step 1: File a Recognition Lawsuit (승인의 소)

The judgment creditor must file a lawsuit in a Korean court seeking recognition of the foreign judgment.

  • Court: District court where the defendant resides or where the property is located
  • Documents required:
    • Certified copy of the foreign judgment
    • Certificate of finality (proof that the judgment is final and no longer appealable)
    • Proof of service on the defendant in the foreign proceeding
    • Translation of all documents into Korean by a certified translator
    • Apostille or consular authentication (depending on whether the foreign country is a party to the Hague Apostille Convention)
  • Timeline: 6–12 months for a recognition judgment

Step 2: Obtain a Korean Recognition Judgment (승인판결)

The Korean court will review whether the foreign judgment meets the four requirements above. If satisfied, the court issues a recognition judgment.

Important: The Korean court does NOT re-examine the merits of the case. It only verifies that the procedural and policy requirements are met.

Step 3: Enforcement (집행)

Once recognition is granted, the creditor can enforce the judgment using Korean civil execution procedures:

  • Attachment of assets: Bank accounts, real property, wages, etc.
  • Auction: Court-ordered sale of the debtor's property
  • Garnishment: Direct collection from third parties (e.g., employers, debtors)

4. Arbitral Awards vs. Court Judgments

Foreign arbitral awards are generally easier to enforce than court judgments:

  • New York Convention (1958): Korea is a signatory; arbitral awards from 170+ countries are enforceable with minimal review
  • Simpler process: File for enforcement directly; no need for a separate recognition lawsuit
  • Limited grounds for refusal: Only procedural defects or public policy violations

Recommendation: When negotiating contracts with Korean parties, include arbitration clauses to simplify enforcement.

5. Common Challenges

Punitive Damages

Korean courts routinely reduce or refuse to recognize punitive damages awarded by foreign courts. Only compensatory damages are typically enforced.

Service Issues

Korean courts are strict about service requirements. Improper service is the most common reason for denial of recognition.

Jurisdictional Disputes

If the foreign court's jurisdiction was based on "tag jurisdiction" (physical presence alone) or other grounds not recognized in Korea, recognition may be denied.

Currency Conversion

Foreign currency judgments are converted to Korean won at the exchange rate on the date of the recognition judgment, not the original judgment.

6. Timeline and Costs

  • Recognition lawsuit: 6–12 months
  • Enforcement proceedings: 3–9 months (depending on asset location and debtor cooperation)
  • Court fees: Based on the judgment amount (approximately 0.5%)
  • Attorney fees: Typically 5–10% of the judgment amount
  • Translation costs: Varies by document length (approximately KRW 100,000–500,000)

7. Practical Tips

  • Document everything: Ensure all service records, court orders, and procedural documents are well-preserved
  • Obtain apostille/authentication early: This can be time-consuming in some jurisdictions
  • Consider settlement: Enforcement is costly and time-consuming; negotiated settlements are often faster
  • Identify assets in advance: Korean courts can only enforce against assets located in Korea
  • Use local counsel: Korean enforcement procedures are complex and require expert navigation

8. Alternatives to Enforcement

If enforcement proves difficult, consider:

  • Asset tracing: Locate Korean assets before filing
  • Negotiated settlement: Use the judgment as leverage in settlement talks
  • Re-litigation in Korea: In some cases, filing a new lawsuit in Korea may be faster than recognition proceedings

Ejecutar Sentencias Extranjeras en Corea del Sur: Requisitos, Proceso y Consideraciones Prácticas

Por el Abogado NOH UJIN | HANBYOL LAW LLC, Seúl
⚖️ Perspectiva Legal Coreana | Litigios Transfronterizos

A. Legitimidad Jurisdiccional
